4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited: The Siemens SiPass Access Control and Management Software is an exclusive Siemens developed proprietary software and access control system. This system is currently installed in the BACH and is licensed to manage and control over 510 electronically accessed doors along with managing the database of over 1,500 card users. Siemens industry, Inc. Building Technologies Division (SBT) is the only source of this software and firmware that operates this access control system. Periodically Siemens will develop new firmware and software enhancement updates that are necessary to maintain reliability and functionality of the existing building security. These updates and enhancements are updated while a valid software support maintenance agreement is active.

The multiple ACC controllers along with all of the associated hardware will only work in conjunction with the individual door controllers, readers and locks. This SiPass software is designed to work exclusively with each of the Siemens proprietary parts and no other manufactures equipment. Likewise, the SiPass ACC controllers and peripheral hardware will only communicate with the SiPass software.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed.

7. Market Research: The Contract Specialist (Veronica Lamboy) for this requirement contacted the Siemens Sales Executive (Victor Harmon) on 25 JUL 2019. The sales Executive indicated that the Siemens SiPass Access Control and Management Software is solely provided by Siemens and there are no other resellers. An internet search for maintenance providers for the Siemens SiPass software did not yield any additional results. The market research for the two previous contracts were reviewed and both came to the same conclusion. Maintenance and updates to the Siemens SiPass Software can only be obtained from Siemens.
