X (a) FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization) ___ (b) FAR 13.106 (b) (1): Soliciting from a single source (SAT) ___ (c) FAR 13.501: Soliciting from a single source (CITP).

___ (c) Services/Supplies are needed immediately to satisfy mission requirements.
___ (d) Additional Information:
(i) What harm will come to the Government if desired supplies/services are not provided on time?
These machine gun / blast simulators can use the specific repair parts already in stock at the TSC, which is manufactured and stocked by Int’l Repo-Depo, Inc. These machine gun / blast simulators are necessary to meet the training objective of units training on Schofield Barracks. The TSC conducted extensive research and no other vendor was found that made/sold these items. However, selecting a different vendor would cause our organization additional cost in spare parts, compromise our safety standards of operations, and result in the new system not being compatible with the current systems we have in stock.
(ii) What harm will come to the Government if desired contractor doesn't receive the award?
The government’s intent is to have the simulators ready for use as soon as possible. Items procured through a recent award were delivered with exposed wiring, gas tubing and fittings which presents a safety hazard.
The wires could fray or break while being used or transported during training. The gas tubing could crack or fittings could be sheared off the simulators. This would create a safety hazard because propane and oxygen gases utilized to simulate live-fire conditions could prematurely ignite, inflicting bodily harm to the soldier. Items previously procured from Int’l Repo-Depo, Inc. did not present any such safety concerns.
The items were able to be used immediately upon receipt in comparison to the items from the current supplier needing to be returned and refitted / modified in order to be used with the current simulators. This has an adverse impact on TASC’s training capabilities by limiting the number of simulators available for use. The present units needed to be returned to the vendor to reprogram the remotes’ frequency. This reduced the training efficiencies because of the time the simulator was unusable.
6. Actions to Increase Competition: (State what actions will be taken to increase competition before subsequent acquisition of the supplies or services is required.)
To increase competition, ongoing market research will continue to be conducted for future acquisitions of a similar nature to determine if other vendors have developed capabilities to produce and/or provide for the same or similar items.
7. Market Research: (Describe the extent of the market research conducted to identify all qualified sources and the results thereof. "Market Research" is defined as those attempts you made to ascertain whether other qualified sources exist. Research of the market place may consist of written, telephonic, or world wide web inquiries.)
Recommendation from TSC-SB and TADDS Manager. Vendor source, Int’l Repo–Depo, Inc. requested as primary vendor and the items requested are readily available. Simulators current on hand are products of Int’l Repo-Depo. For this current acquisition, market research was conducted, along with a fully competed solicitation and only two vendors submitted offers, Int’l Repo-Depo, Inc. and the awardee of the brand name or equal solicitation, whose parts were found to be non-compatible. The government is currently having safety issues with product from current vendor that have yet to be resolved. The previous award will be terminated due to patent and latent defects. Therefore, Int’l Repo-Depo is the only source identified based on market research and open competition.
8. Procurement History:

Comparison of the proposed prices with previous contract and other contracts awarded by other contracting offices will be made.As such, I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
