The Government may reject any or all quotes if such action is in the public interest; and waive informalities and minor irregularities in quotes received.

2.4.3. The references submitted under this subfactor should be able to provide information about the quality of your past performance and will be used to evaluate past performance. The Offeror shall ensure the contact and contract information contained in each Reference Information Sheet is accurate. The Government will only evaluate contracts, in performance or completed within five (5) years (01 Jan 2011 through the issue date of subject solicitation), which are relevant to the efforts required by this solicitation.
Relevance means similarity to work contemplated under this RFP with respect to complexity, length of performance, scope, type of work, and value (minimum of Euro 1,000,000. Magnitude threshold of EUR 1,000,000.00 is an aggregate of up to three (3) Past Performance Questionnaires.)

2.6.3 Acknowledgment of Amendments to the RFP (if any amendments are released).
2.6.4. The completion and submission to the Government of the above items will constitute the quote. The quote shall communicate the Offeror’s unconditional assent to the terms and conditions in this RFQ, including any attachments and documents incorporated by reference. The Offeror’s failure or refusal to assent to any of the terms and conditions of this RFQ or the Offeror’s imposition of additional conditions or any material omission in its quote may constitute a deficiency which will make the quote unacceptable to the Government.
2.6.5 Any deficiency in an offer will render the quote unacceptable. The only way to correct a deficiency is through discussions (see FAR 15.306(d)). However, the Government intends to award a contract without discussions as permitted by FAR 15.306(a) and 52.215-1. The Government reserves the right to conduct discussions and to permit Offerors to revise their quotes if the Government thinks it is in its interest to do so.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
(i) Technical
a. Subfactor A - Experience
b. Subfactor B – Personnel Qualifications
c. Subfactor C - Contractor Self-Certification
(ii) Past Performance
(iii) Price
The basis for award is Lowest Price Technically Acceptable (LPTA).
(b) A rating of no less than “Acceptable” must be achieved for all non-price factors and sub-factors.
Receiving a rating of “Unacceptable” in any of the non-price evaluation factors and sub-factors as listed above will result in a rating of “Unacceptable”. The only way to correct an “Unacceptable” rating is through discussions. If discussions are held, the Government will select the most highly rated proposals to participate in discussions.
Offerors not invited to participate in discussions will be eliminated from competition and receive notice required by FAR 15.503(a) (1). The non-price evaluation will consist only of determining the acceptability of each offer. Offers will not be ranked based on the acceptability evaluation.
(c) The Government intends to evaluate offers and award a contract without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.
(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
EVALUATION APPROACH
FACTOR I – TECHNICAL: The Government will evaluate offers based on documentation provided. The Government will evaluate each offeror’s understanding of the Government’s requirements to determine the likelihood that the offeror will be able to perform the contract successfully.
Subfactor A – Experience.
This sub-factor is met when the proposal clearly describes and verifies that the offeror did submit an individual Reference Information Sheet (Attachment #1) for three (3) reference contracts within the last five (5) years (01 Jan 2011 through the issue date of subject solicitation), and clearly demonstrates that the offeror provided services relevant and recent to those required in the PWS of subject solicitation.
Recent experience is considered as the efforts that are completed or ongoing during the past five (5) years.
Relevant experience means similarity to the work contemplated under this solicitation’s PWS in terms of complexity, scope, type of work, and magnitude (minimum of Euro 1,000,000. Magnitude threshold of EUR 1,000,000.00 is an aggregate of up to three (3) Reference Information Sheets). The Government is not bound by an Offeror's opinion of the relevance of its organizational experience.
Subfactor B – Personnel Qualifications.
This subfactor is met when the offeror clearly demonstrates the availability of qualified personnel in order to perform the tasks set forth in the PWS, and that all personnel used to perform the contract are qualified in accordance with PWS paragraph 1.4.8.5.
Subfactor C – Contractor Self-Certification.
This sub-factor is met when the offeror provides a proposal that includes a signed and dated copy of the Contractor Self-Certification (Attachment 3), certifying that in performing the requirements of the PWS and resulting contract, they do not have any potential or actual Organizational Conflicts of Interest.
Technical Factor and Subfactor Rating Definitions:
Acceptable - Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable - Proposal does not clearly meet the minimum requirements of the solicitation.
FACTOR II – PAST PERFORMANCE: The Government will evaluate the offeror’s record of past and current performance to ascertain the ability of the offeror to successfully perform the required efforts of the PWS. The information presented in the Past Performance Questionnaires (Attachment 2) and information obtained from other available sources other than those identified by the offeror (such as past performance information obtained from Federal, State and local Government agencies, better business bureaus, published media, and electronic data bases available to the Government) will be the basis for evaluation of this factor.
Past performance is a measure of the degree of quality to which an offeror has satisfied customers in the past, and complied with Federal, state, and local laws and regulations. To be acceptable, information obtained from the offeror, POCs, or other sources must be from recent and relevant performance, and the quality of service is predominantly positive to provide the Government a reasonable expectation that the offeror will successfully perform the required effort.
Recent experience is considered as the efforts that are completed or ongoing during the past five (5) years (01 Jan 2011 through the issue date of subject solicitation).
Relevant means the efforts were similar in size, scope and magnitude (minimum Euro 1,000.000. Magnitude threshold of EUR 1,000,000.00 is an aggregate of up to three (3) Past Performance Questionnaires) to the services required by this solicitation. The Government will determine recency and relevancy by using the data provided in the responses from the questionnaires.
Offerors are cautioned that in conducting the past performance assessment, the Government will use data provided in the offeror's proposal and data obtained from other sources.
The Government may reject a quote if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.
Offerors shall provide information on problems encountered on the contracts identified in their past performance submissions and the offeror’s corrective actions (FAR 15.305). The Government will consider all this information, as well as information obtained from any other sources, when evaluating the offeror's past performance.
Past Performance Factor Rating Definitions:
Acceptable - Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable - Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Acceptable.”
FACTOR III – PRICE
The Government will evaluate proposed prices for fairness and reasonableness using one or more of the price analysis techniques described in FAR subpart 15.404-1.
After determination of technical and past performance acceptability, each offer will be evaluated and award made to the lowest Total Evaluated Price (TEP) determined to be reasonable, complete (all items are priced) and balanced.
Offerors are required to price the Phase-in, base period, 1st Option Period, 2nd Option Period, 3rd Option Period, and
4th Option Period for all CLINs listed in the schedule, by providing all unit prices and extended prices. Offerors shall not submit a price for the potential 6-months extension of services period. The successful Offeror will be contractually bound to all proposed prices and rates. Offerors must ensure there are no rounding errors to the nearest tenth. The Government will evaluate Total Evaluated Price (TEP) offered for award purposes as shown below.
TEP consists of the total price offered for all CLINs in the price schedule for the Phase-in, Base Period and Option Periods 1, 2, 3, and 4.
PLUS
Clause 52.217-8 Option to Extend Services (maximum six months): the Government will take the price for all CLINs of the final option period, and prorate it to a six-month value.
4. OPTIONS The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option period possible under Clause 52.217-8 Option to Extend Services (maximum six months), the Government will take the price for all CLINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
