The following items are applicable to this modification:
QUESTIONS FROM INDUSTRY
Q1. When we complete the solicitation with our pricing and availability, how exactly do we submit it to you, by email? I was looking at the user’s guide on the website, and it mentioned an electronic response option, but I didn’t see that available on the opportunity page.
A1. As per FAR 52.212-1 Instructions to Quoters - Commercial Items ADDENDUM, paragraph (b), page 55, submit signed and dated quotations to the office specified in the solicitation via email to SFC Fitho Simplice at fitho.simplice.mil@mail.mil, with courtesy copy to Rebecca Veliz at rebecca.s.veliz.civ@mail.mil at or before the exact time specified in the solicitation.
Q2. In FAR 52.212-1 paragraph (b)(9), it states that quotes must show “acknowledgement of solicitation amendments.” How is that accomplished?
A2. Government issued amendments to the solicitation are issued via an SF30.
Acknowledgement of amendments is accomplished by the offeror filling in blocks 8 and 15A- 15C of all amendments and submit a copy along with the quote.
Q3. FAR 52.212-1 (page 55) Section B, Number 8 - We have an active SAM registration and it has been updated within the last 12 months, but I am a little confused by the verbiage "representations and certifications." Is this just being sure all of our information is up to date, and that our account is active?
A3. If an offeror is registered in the System for Award Management (SAM) portal, then the representations and certifications have been completed in the SAM registration. It is the responsibility of the offeror to verify their submitted “Reps and Certs” are accurate in the SAM database. The offeror’s representations and certifications certify to the business size status for all of the North American Industry Classification Systems (NAICS) codes in the table.
Q4. 52.212-3 Offeror Representations and Certifications-Commercial Items, states that I only need to fill out section b since I have an active SAM registration. Since, I don't believe I need to make any changes for this solicitation, can I leave this blank?
A4. Yes.
Q5. CLIN Price sheets (Pages 3-16). Pages 6 & 13- this lists out the labor costs for the interpreters and translators. Where should I include the labor for the Equipment technician that is described in Part 5, 5.4 (page 24) of the prep conference and described in Part 5, 5.4 (page 42) of the PESCAA conference.
mailto:fitho.simplice.mil@mail.mil mailto:rebecca.s.veliz.civ@mail.mil
A5. Any costs associated with an equipment technician can be incorporated into the firm-fixed price line item for audio visual equipment, contract line items 0009 (Prep Conference) and 0023 (PESCAA Conference).
Q6. CLIN Delivery/Task order Minimum/Maximum Quantity and CLIN Order Value, pages 52-
53. CLIN 0010 - I was going to offer this complimentary for the Prep conference, but if I do, it will be below the minimum requirement listed on page 52. Is this ok, or should I make it $500 so it is in compliance.
A6. The minimum and maximum amounts refer only to the Government ordering amount. If an offeror is not intending to assign a dollar amount to this or any other line item, it can be stated on the quote for the specific line item “not separately priced (NSP).”
Q7. Line items 0007-0009, 0012-0013, 0021-0023, and 0026-0027 all state the following in the extended description: “Offerors shall provide unit pricing for this CLIN on Attachment 4, Unit Pricing Data.” Where is attachment 4 located?
A7. Attachment 4, Unit Pricing Data, is located within each Performance Work Statement (PWS). The attachment for the Preparatory Conference PWS is located on pages 33-34 of the solicitation. The attachment for the PESCAA Conference PWS is located on pages 50-51 of the solicitation. Along with the submitted quote for pricing of all of the line items, the attachment is required to be submitted for each conference pricing of the referenced CLINs.
Q8. Have you received bids for this contract?
A8. The quotes are not due from offerors until 12:00 PM Central Standard Time (CST) on 17 November 2016.
Q9. Can I be awarded the contract and then secure a suitable lodging facility to be a subcontractor?
A9. No. FAR 52.212-1 Instructions to Quoters - Commercial Items ADDENDUM has been modified to accommodate 3rd party brokers.
Q10. Is the award required to go to the host lodging facility?
A10. No. FAR 52.212-1 Instructions to Quoters - Commercial Items ADDENDUM has been modified to accommodate 3rd party brokers.
Q11. Is the same host hotel required for both events?
A11. Yes. The intent is to have the first conference (Preparatory Conference) as a dress rehearsal for the second conference (PESCAA Conference).
SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
The following have been modified:
FAR 52.212-1 Instructions to Quoters—Commercial Items ADDENDUM.
This addendum replaces provision FAR 52.212-1 in its entirety.
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of quotations. Submit signed and dated quotations to the office specified in this solicitation via email to SFC Fitho Simplice at fitho.simplice.mil@mail.mil with courtesy copy to Rebecca Veliz at rebecca.s.veliz.civ@mail.mil at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotations must show—
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotations;
(3) The name, address, telephone number and email address of the quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of quotations. The quoter agrees to hold the prices in its quotation firm for 30 calendar days from the date specified for receipt of quotations.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during pre-award testing.
(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of quotations.
(1) Quoters are responsible for submitting quotations, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations or revisions are due.
(2) Any quotation, modification, revision, or withdrawal of a quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is “late” and will not be considered unless it is received before award is made, and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.
(g) Issuance of Purchase Order. The Government intends to evaluate quotations in accordance with FAR 13.106.
The Government will not use the formal source selection procedures described in FAR Part 15. The Government may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Government may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order.
(h) Multiple Purchase Orders. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order on any item for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise.
(i) Contractor and Government Entity (CAGE) Code or NATO Contractor Government Entity (NCAGE) Code.
The quoter shall enter its CAGE or NCAGE code in the block with its name and address on the cover page of its quotation, in accordance with FAR 52.204-16.
(j) Data Universal Numbering System (DUNS) Number. The quoter shall enter, in the block with its name and address on the cover page of its quotation, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the quoter’s name and address. The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the quoter to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the quoter does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. A quoter within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. A quoter located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The quoter should indicate that it is a quoter for a Government contract when contacting the local Dun and Bradstreet office.
(k) System for Award Management. Unless exempted by the Contracting Officer, the quoter shall be registered in the SAM database prior to issuance of purchase order, during performance and through final payment. If the quoter does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered quoter. Quoters may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Requests for Information: The Contracting Officer will not notify unsuccessful quoters. Quoters may request information on purchase order(s) resulting from this solicitation.
(m) Solicitation Questions. Solicitation information and amendments will be posted to the Federal Business Opportunities website at www.fbo.gov. Offerors may submit questions regarding this solicitation via email to the Contract Specialist, SFC Fitho Simplice at fitho.simplice.mil@mail.mil and the Contracting Officer, Rebecca Veliz, at rebecca.s.veliz.civ@mail.mil by 12:00 PM Central Daylight Time (CDT) Friday, 28 October 2016. All e-mailed questions shall be submitted with the subject line as W912CL-16-Q-0036 – Questions. The Government reserves the right not to respond to any questions received concerning this solicitation after the required question receipt date and time. Offerors are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the solicitation process.
(n) Availability of Funds. Funds are not presently available for performance under this contract beyond FY2017. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond FY2017, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.
(o) The Government anticipates the award of a Fixed Price Requirements type contract. Task orders will be issued for the Preparatory Conference during the ordering period of 7 August 2017 - 8 September 2017 and the PESCAA Conference during the ordering period of 23 October 2017 - 24 November 2017.
