FAR 8.405-6 Limited Sources Justification Under the General Services Administration
Federal Supply Schedule Program
1. Contracting Activity:
MICC- Fort Buchanan 34 South Gate Road Suite 1104 Fort Buchanan, PR 00934
2. Description of Action: The contractor shall provide labor, supervision, insurance, and all necessary to perform “Purchase and Installation of new parts to upgrade the existing Electronic Security System at Fort Buchanan, Puerto Rico”. The work consists of upgrading the existing Electronic Security System and equipment.
The Department of Emergency Services / Physical Security Division requests a firm-fixed-price contract under the General Services Administration (GSA) Federal Supply Schedule (FSS) Program with Advantor System Corporation. The Government will execute this action against FSS contract GS-07F-039DA. The Government will be using Operations and Maintenance Army Reserve funds for this requirement.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
This action is a new requirement to upgrade existing system and equipment.
Advantor is the only source that can maintain, upgrade, repair and fully integrate the Electronic Security System that is currently in use at Fort Buchanan.
The Department of Emergency Services needs to ensure all equipment identified herein is operable to ensure the mission, personnel and equipment is not at risk, limiting the ability to support the Force Protection program.
The anticipated total value of this acquisition is . Of this amount, is for equipment and is for installation. Therefore, the installation can be identified as incidental to the purchase of the equipment.

4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by the following:
FAR 8.405-6(a)(1)(i)(A). An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
FAR 8.405-6(a)(1)(i)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
FAR 8.405-6(a)(1)(i)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with applicable Federal Supply Schedule ordering procedures. The original order or BPA was not previously issued under a sole-source or limited-sources procedures.
FAR 8.405-6(b)(1). Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
5. Reason for Authority Cited:
(a) Pursuant to FAR 8.405-6(b) (1), this requirement is available only from Advantor Systems Corporation. Advantor Systems Corporation designed and built the electronic security system that is currently installed on Fort Buchanan. The existing Fort Buchanan electronic security system architecture is built upon an Advantor Suite for Network (ASN) integrated monitoring system, including Advantor IDS and Access control, integrated with an Advantor compatible Pelco CCTV system. This system (including the integrated Pelco components) operates in a proprietary communication protocol that includes three elements: the ASN system (ASN 6.0) hardware and software, the Advantage plus communications processor and the Control Panel Military firmware.
It is the combination of these three elements that provides the level of security required to comply with AR 190-11, Physical Security of Arms, Ammunition, and Explosives, AR 190-13, The Army Physical Security Program and approved by the Defense Intelligence Agency (DIA) and Department of the Army-Product Manager Force Protection Systems. The same system is currently used to monitor all USAR Facilities off post. Advantor utilizes a proprietary communication protocol between the Alarm Control Panel (Infraguard and Plus

Base Module) and the (ASN) Monitoring System. This protocol is unique to the Advantor system and not used, nor known by, any other organization. No other manufacturer or vendor has the ability to match this protocol because it is proprietary and not a public data. Therefore, it would be impossible for an offeror proposing a non- Advantor equipment to comply with or assure compliance.
(b) Alternatives: In order for any contractor to be able to meet the requirement, the system must be fully integrated. Based on previous solicitation and its results, Advantor Systems Corporation remains the owner of the software (proprietary to Advantor), which makes it impossible for any other contractor to fully integrate the system with the software. At this time, the Department of Emergency Services does not have sufficient justification/funding to replace the software. For the reasons stated here, efforts to obtain competition would not be effective until the requirement is changed. No actions to increase competition can be made unless the software is replaced in its entirety
(c) The requirement will be needed for an unlimited time period. However, Advantor is the only source that can maintain, repair and fully integrate a system that is compatible with the electronic security system software already in place. No other contract is currently in place to integrate all IDS/CCTV system and no contractor has been identified with the rights to the particular system to appropriately maintain it. The Fort Buchanan Security System needs to be fully integrated to ensure it is always operable. The Department of Emergency Services needs to ensure all equipment identified herein is operable to ensure the mission, personnel and equipment is not at risk, limiting the ability to support the Force Protection program. In addition, not providing the required integration will create an unacceptable delay in fulfilling the agency requirements as it would affect the security to all buildings on Fort Buchanan being monitor by our system.
6. Actions to Increase Competition: In order for any contractor to be able to meet the requirement, the system must be fully integrated. Based on previous solicitation and its results, Advantor Systems Corporation remains the owner of the software (proprietary to Advantor), which makes it impossible for any other contractor to fully integrate the system with the software.
GAO Case B-299013 dated October 16, 2006 with a GAO decision date November 2, 2006.
At this time, the Department of Emergency Services Army wide does not have sufficient justification/funding to replace the software. For the reasons stated here, efforts to obtain competition would not be effective until the requirement is changed. No actions to increase competition can be made unless the software is replaced in its entirety.
7. Market Research: The items/equipment requested under this requirement are considered commercial in nature since they can be found in the commercial market. Advantor Corporation is the only company that can fulfill this requirement. The equipment to be installed has proprietary rights that belongs to this company; therefore, the Government doesn’t have any other option than to procure this requirement with Advantor Corporation.

9. Technical / Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
10. Best Value Determination/Fair and Reasonable Cost Determination: I hereby determine that the order represents the best value to the Government in accordance with FAR 8.405- 6(c)(2)(v). Additionally, I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.
Advantor holds contract GS07-F-039DA with General Services Administration (GSA). MICC Fort Buchanan anticipates that the award will be done through the GSA contract. The prices that are in this contract has been negotiated between GSA and Advantor and GSA has determined they are fair and reasonable. MICC Fort Buchanan will seek a further discount to these prices. FAR 8.404(b)(5) allows contractors to offer price reductions and spot pricing for one time procurements and pass on savings to users based on the dynamics of the commercial marketplace.
Therefore, in order to ensure that we receive the best value at the lowest overall cost, we will be seeking price reductions.
Price Comparison between Advantor and Commercial Market
In order to determine if the expected prices will be fair and reasonable, MICC Fort Buchanan conducted an informal analysis and comparison of Advantor Prices, which can be found at https://www.gsaadvantage.gov/advantage/main/start_page.do and prices found over the internet.
a. LED Monitors. Advantor price for each 32 inches LED monitor is and 42 inches LED monitor is . Prices of other GSA contractors fluctuates between and . The monitors shall be commercial grade since they will be in use for 24 hours/365 days. A commercial grade monitor features extensive advanced anti burn-in & image-retention and are designed to withstand long operating hours with thermal characteristics built in the internal design for proper heat dissipation in both portrait and landscape modes. Commercial grade displays typically incorporate additional fans to dissipate heat. The monitors requested in this requirement were developed and are manufactured by Advantor. Is not the typical LED monitor that can be purchased at a megastore. One additional benefit of procuring these monitors with Advantor is that with the contract for Preventive Maintenance that MICC Fort Buchanan has with Advantor, provides an extended warranty for most items, to include the replacement without additional cost of any equipment that malfunctions or that is damaged. This gives a value added to the equipment sold by Advantor. Therefore, the price found in GSA Advantage may be determined as fair and reasonable.
b. ADV Video Server. The requested video server was developed and is currently manufactured by Advantor Systems Corporation. Based on a search in GSA Advantage, the price for this item is . Prices of other GSA contractors fluctuates from low to above the hundred thousands, depending on the complexity of the equipment.
