13.2. General Liability: Comprehensive general liability insurance for bodily injury in the minimum limits of $500,000 per occurrence. Property damage liability insurance shall be required in an amount of at least $100,000.

14. WORK PLAN. The contractor shall furnish the Contracting Officer and the COR a work plan (production schedule) for all stages of production utilizing the Critical Path Method (CPM) of network calculation to generate all Project Schedules. A revised plan shall be furnished the Contracting Officer and the COR prior to the contractor making any date changes. Within 30 calendar days of contract award a work plan shall be submitted for all work required by this contract. This work plan is separate from any and all documents submitted before contract award and shall provide greater detail than pre-award submitted work plans.

Develop the Project Schedule to the appropriate level of detail to address major milestones and to allow for satisfactory project planning and execution. Failure to develop the Project Schedule to an appropriate level of detail will result in its disapproval. The plan shall include, as a minimum, details for all work listed in paragraph 1. above. The work plan shall include detailed fabrication methods and procedures, description of shop facilities, subcontractor work, and all equipment (including make, model, serial number, and date of last calibration). Provide activities which could negatively impact the work schedule (ie: Government approvals, inspections, etc). The standard for the Work Plan is AACE International 29R-03. Include in the work plan the Abrasive Blasting Plan.

The Work Plan shall address sequence of fabrication and methods to protect, transport, and label components during fabrication and shipping. The Work Plan shall include the measuring system and devices used in ensuring dimensional tolerances. Measuring devices and certificates of calibration described in the Work Plan shall be available for review and use during Government Witness Point Inspections.

Production activities and purchasing of materials shall not begin until the Work Plan has been approved by the Contracting Officer. The Contractor's work schedule (days of the week and hours per day) shall be stated.

The Government intends to use Primavera P6 for its internal requirements. If the Contractor has the capability to provide “xer” export files in a version of P6 importable by the Government system then the Government will accept those export files in lieu of other plan submissions.

15. SUBMISSIONS: Unless specifically noted in the requirement all submittals shall be provided free of proprietary markings and shall become property of the Government or shall have Governmental Rights assigned. Submissions which are disapproved by the Contracting Officer will be resubmitted with corrections within five (5) business days.

15.1. Contractor's Quality Control (CQC) System Manager shall check and approve all items prior to submittal and stamp, sign, and date indicating action taken. Proposed deviations from the contract requirements are to be clearly identified. Include within submittals items such as:

Contractor's, manufacturer's, or fabricator's drawings;

Descriptive literature including (but not limited to) catalog cuts, diagrams, operating charts or curves;

Test reports;

O&M manuals (including parts list);

Certifications;

Warranties;

and other submittals required in the Specification.

Submittals requiring Government approval are to be scheduled and made prior to the acquisition of the material or equipment covered thereby. Pick up and dispose of samples not incorporated into the work in accordance with manufacturer's Material Safety Data Sheets (MSDS) and in compliance with existing local, state, and federal laws and regulations.

15.2. Except where specifically noted, submittals shall be provided in electronic format. Adobe Portable Document Format (Adobe PDF) will serve as the primary file type. Adobe PDF files submitted shall be compatible with Adobe Acrobat Reader XI. In the event another file type is needed, the Contractor shall provide compact disc with file and file reader software, or provide hard copies to the Government.

15.3. Units of weights and measures used on all submittals are to be the same as those used in the contract drawings. Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements.

15.4. Drawings: Drawings, diagrams and schedules specifically prepared to illustrate some portion of the work. Diagrams and instructions from a manufacturer or fabricator for use in producing the product and as aids to the Contractor for integrating the product or system into the project. Drawings prepared by or for the Contractor to show how multiple systems and interdisciplinary work will be coordinated.

15.5. Test Reports: Report signed by authorized official of testing laboratory or testing entity that tests or examines a material, product, or system to demonstrate performance, design, or features in accord with specified requirements. Unless specified in another section, testing must have been within three years of date of contract award for the project. Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work or prototype prepared for the project before shipment. Report which includes finding of a test made or sample taken on portion of work during or after installation/completion.

15.6. Certificates: Statements printed on the manufacturer's letterhead and signed by responsible officials of manufacturer of product, system, or material attesting that the product, system, or material meets specification requirements. Must be dated after award of project contract and clearly name the project. Document required of Contractor, or of a manufacturer, supplier, installer or Subcontractor through Contractor. The document purpose is to further promote the orderly progression of a portion of the work by documenting procedures, acceptability of methods, or personnel qualifications.

16. SCHEDULED PROGRESS MEETINGS. Conduct a scheduled meeting with the Government for the purpose of jointly reviewing the actual progress of the project as compared to the as planned progress and to review planned activities. Use the current approved schedule update for the purposes of this meeting and for the production and review of reports. At the progress meeting address the status of outstanding reports, if any, and delivery schedules.

Meetings will initially be scheduled weekly but may be scheduled less or more often depending upon the progress of production. At a minimum the Contractor Project Manager and the COR will attend all meetings. Meetings may be scheduled telephonically.

52.209-1 QUALIFICATION REQUIREMENTS (FEB 1995)

(a) Definition: "Qualification requirement," as used in this clause, means a Government requirement for testing or other quality assurance demonstration that must be completed before award.

(b) One or more qualification requirements apply to the supplies or services covered by this contract. For those supplies or services requiring qualification, whether the covered product or service is an end item under this contract or simply a component of an end item, the product, manufacturer, or source must have demonstrated that it meets the standards prescribed for qualification before award of this contract. The product, manufacturer, or source must be qualified at the time of award whether or not the name of the product, manufacturer, or source is actually included on a qualified products list, qualified manufacturers list, or qualified bidders list. Offerors should contact the agency activity designated below to obtain all requirements that they or their products or services, or their subcontractors or their products or services, must satisfy to become qualified and to arrange for an opportunity to demonstrate their abilities to meet the standards specified for qualification.

AISC (American Institute of Steel Construction) Quality Certification Program and current designation as an AISC Certified Plant, Category IBR (Intermediate Steel Bridge), or Category ABR (Advanced Steel Bridge), or Category HYD (Hydraulic Steel Structure), and A copy of the Fracture Critical Endorsement (FC)

(c) If an offeror, manufacturer, source, product or service covered by a qualification requirement has already met the standards specified, the relevant information noted below should be provided.

(d) Even though a product or service subject to a qualification requirement is not in itself an end item under this contract, the product, manufacturer, or source must nevertheless be qualified at the time of award of this contract.

This is necessary whether the Contractor or a subcontractor will ultimately provide the product or service in question. If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate the contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the Government's best interests.

(e) If an offeror, manufacturer, source, product, or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government's interests, award of this contract shall not be delayed to permit an offeror to submit evidence of qualification.

(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification. The reevaluation must be accomplished before the date of award.

EXECUTIVE ORDERS—COMMERCIAL ITEMS (DEVIATION 2013-O0019) (JAN 2018)

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
