b. SECTION 00 73 15 WAGE RATES: Please delete pages 00 73 15-21 through 00 73 15-34, in their entirety, and substitute revised pages 00 73 15-21 through 00 73 15-34, annotated Amendment No. 0014, attached hereto.

c. Please indicate receipt of this amendment on Standard Form 1442 (SOLICITATION, OFFER, AND AWARD) as Amendment No. 0014. Failure to acknowledge all amendments may be cause for rejection of the bid.

Water Quality Certification

Special Condition 11 Per the posted Water Quality Certification granted to US Army Corps of Engineers by State of Delaware dated 12/18/2013 and expires 12/18/2018 states “to minimize the potential for unexploded ordinance to enter the dredge, a screen device capable of screening out objects 1.5 inches in damter or larger, shall be employed during all dredging operations. Screens shall be inspected daily to ensure their functionality”. However, screening requirements are not required as per plans and specifications. Will contractor be required to screen for unexploded ordinance?

No. Bid per the requirements of the plans and specifications.

Water Quality Certification

The Water Quality Certification Amendment on page one allows the contractor “to conduct dredging using economic loading” in Sub Reaches E-1, E-3 and E-

4. The contract specification indicates that Sub Reach E5 is the only location where economic loading is prohibited. (see table and notes in Section 35 20 23 pages 17 and 18). Water Quality Certification Special Condition 4 states that economic loading is not allowed in Reach 2. It does not even refer to E5 or E6.

Is economic loading allowed in E2 and E6? Please revise the specifications accordingly.

Economic loading is not allowed in Sub-Reach E-2, but is allowed in Sub-Reach E-6. No revisions to the specification are required as the contract work is delineated by Acceptance Section (e.g. AS-1, AS-2, etc.), not by Sub- Reach. There is no dredging required in Sub-Reach E-2, thus there are no Acceptance Sections in E-2. AS-19 to AS-23 and AS-42 to AS-46 correspond to Sub-Reach E-6.

Water Quality Certification

Water Quality Certification Special Condition 5 refers to the 15 NTU threshold for all areas that allow economic loading. It makes no mention of any areas that allow a 40 NTU threshold. The contract specification (Section 01 57 18. P 3.3.1) allows for 40 NTUs in Sub Reaches E6 (AS 19-23 and AS 42-46).

Please clarify that the specification and the Water Quality Certifications allow for a 40 NTU threshold in Sub Reach E6. Yes.

Water Quality Certification

Special Condition 5 states that economic loading shall be discontinued for the current dredging load if sampling exceeds 15 NTUs (consistent with the New Jersey Water Quality Certification) and provides downstream monitoring locations for Sub-Reaches 1,3, and 4.

a. What are the monitoring locations for Sub-Reaches 2 and 6?

b. The contract specification (Section 01 57 18. P 3.3.1) states that the contractor is to implement Best Management Practices after one exceedance of 15 NTUs (40 NTUs in Sub Reach 6) and to contact the Contracting Officer after three NTU exceedances. Which is the governing limit -- one time or the three time exceedances?

a. See response to Question 2 and refer to Section 01 57 18, Paragraph 3.2.2.2 Monitoring Distances.

b. Both apply. The former applies to exceeding the limit for a single dredge load. The latter applies to exceeding the limit for three consecutive dredge loads

We note that, in addition to the contract specification requirement to notify the Contracting Officer after three exceedance events, the New Jersey Water Quality Certification grants the State the authority to, at their sole discretion, prohibit the continued use of economic loading operations in any or all the Sub- Reaches. Notwithstanding Best Management Practices, if economic loading is prohibited and/or not achievable in any previously allowed Sub-Reach, would the USACE consider such a change under the contract and request a cost proposal from the contractor? Yes.

Upon clarification of the above, please allow for a reasonable one week extension to the bid date. See Amendment No. 0013.

Employees who have to work on Christmas Eve Day shall work four hours and be paid for eight hours pay for the holiday.

Any time worked beyond fours hours shall be paid at the double time rate plus the four hours holiday pay. To receive holiday pay, the employee must work the day before Christmas Eve and the first working day after Christmas Day.

Emloyee earns a personal holiday every two months, provided employee has worked twenty-six day in each consecutive two month period, up to a maximum of five per calendar year. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
