1. REQUEST FOR INFORMATION:
Further clarification is needed in Section 35 20 23, Dredging, Paragraph 1.1 and currently reads as follows:
1.1 DEFINITION
“Hard material is defined as material requiring blasting or the use of special equipment for economical removal, and includes boulders, ledge rock, wrecks, snags, stumps, piles or rock fragments too large to be removed in one piece or buried below project depth by the dredge.”
In consideration of the sentence that has been deleted via Amendment 9 from Paragraph 1.5 “MATERIAL TO BE REMOVED”, we still believe that the discrepancy continues to exist between the definition of Hard Material in Paragraph
1.1 (i.e. hard material = material requiring blasting or material requiring special equipment for economical removal) and more specifically how hard material requiring blasting is only referenced in context in Paragraph 1.5 and Paragraph 1.5.1, which reads as follows with our suggestions to adjust for clarity:
1.5 MATERIAL TO BE REMOVED
“The material to be removed under this contract is new material consisting primarily of clays, silts, sands and gravel, and may contain cobbles and boulders, with the exception of material which cannot be removed or buried below project depth without blasting, as identified in Paragraph “HARD MATERIAL”.
We suggest that the first sentence of the first paragraph in Paragraph
1.5 “MATERIAL TO BE REMOVED” (transcribed above for convenience) be replaced with the proposed language stated below to clarify that both hard material requiring blasting and hard material requiring special equipment for economical removal are both recognized as a Differing Site Condition:
“The material to be removed under this contract is new material consisting primarily of clays, silts, sands and gravel. The Contractor may encounter hard material as identified in Paragraph
1.1 “HARD MATERIAL” which is not part of the scope of works, and Sub-Paragraph 1.5.1 “Hard Material” shall govern how such hard material will be treated.”
1.5.1 HARD MATERIAL
“The removal of hard material is not included. Should hard material which cannot be removed without blasting be encountered, the Contractor shall remove therefrom all overlying material which in the judgment of the Contracting Officer can be removed.
Nothing in this paragraph shall be construed as prohibiting the removal of hard material by special means at prices agreed upon and approved in accordance with Contract Clause: "DIFFERING SITE CONDITIONS". Should the Government direct in writing that hard material be removed, the work shall be performed and an

We suggest that the first sentence in Paragraph 1.5.1 “HARD MATERIAL” (full paragraph transcribed above for convenience) be replaced with the proposed language stated below to clarify that both hard material requiring blasting and hard material requiring special equipment for economical removal are recognized as a Differing Site Condition:

SECTION 01 57 18
TURBIDITY MONITORING
PART 1 GENERAL
1.1 SCOPE
The work covered by this section consists of furnishing all labor, materials, and equipment, and performing all work required to obtain, analyze, and report the results of turbidity monitoring during overflow dredging (economic loading). This section does not apply to non-overflow dredging. Overflow dredging is not allowed 15 June through 15 September, except in AS-19 to AS-23 and AS-42 to AS-46. A summary of turbidity monitoring results from Contract No. W912BU-14-C-0015 (Lower Reach E - Broadkill Beach) is available upon request.

1.3 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

Calibration Standard; G,DO
Prior to commencing overflow dredging operations, submit a copy of the operating instructions and standard for calibrating equipment used in collecting turbidity measurements.

Submit required turbidity monitoring reports in the specified format, within 24 hours after completion of each test, daily during the first two weeks and once every week thereafter.

PART 3 EXECUTION
3.1 GENERAL MONITORING REQUIREMENTS
a. Monitor turbidity during overflow dredging (economic loading) operations. Use this data in real time to determine if turbidity during overflow dredging exceed specified levels over background measurements. If this level is exceeded, implement Best Management Practices (BMP's) in order to decrease water column turbidity below the allowable maximum level above background levels.
b. Conduct monitoring during daylight hours only. Suspend monitoring if inclement weather or sea conditions make monitoring unsafe.
3.2 TURBIDITY TESTS
3.2.1 Turbidity Monitoring Equipment
Monitoring required for turbidity shall be measured in Nephelometric Turbidity Units (NTU) using a standard Nephelometer. Global Positioning System (GPS) is also required to record sampling stations. Submit an equipment certification, attesting to the accuracy of the testing equipment and procedure. In addition, submit a copy of the Calibration Standard used to calibrate the testing instrument and a complete set of operating instructions for the turbidity testing equipment. Use this standard throughout the project to maintain the calibration of the equipment.
3.2.2 Turbidity Monitoring - Water Column
3.2.2.1 Monitoring Locations
Perform turbidity monitoring at the following locations:
Background (pre-dredge conditions):
One meter and seven meters below the water surface in the immediate vicinity of the next dredging load, approximately 30

Pre-Overflow:
One meter and seven meters below the water surface at the distance down-current of the working dredge specified below, after dredging has begun, but before overflow commences.
Compliance:
One meter and seven meters below the water surface at the distance down-current of the working dredge specified below, and within the center of the visible overflow plume, if any. Take initial measurements no more than 10 minutes after overflow commences.
Notation shall be made of the direction of the current (ebb or flow) at the time of sampling.
Post-Compliance:
One meter and seven meters below the water surface at the same location as the compliance monitoring location after overflow dredging has ceased.
3.2.2.2 Monitoring Distances
Monitoring distances down-current of the working dredge are as follows:
a. For AS-1 to AS-6 and AS-24 to AS-29, approximately 200 meters;
b. For AS-7 and AS-30, approximately 500 meters;
c. For AS-8 to AS-14, AS-19 to AS-23, AS-31 to AS-37, and AS-42 to AS-46, approximately 300 meters.
3.2.2.3 Monitoring Frequency and Duration
Perform turbidity monitoring at the frequencies and durations specified below.
Background (pre-dredge conditions):
Once for each dredging load. Measure turbidity for 5 minutes and record the average measurement.
Pre-Overflow:
Once for each dredging load. Measure turbidity for 5 minutes and record the average measurement.
Compliance:
10 minutes, 20 minutes, and 30 minutes after overflow commences for each dredging load. Measure turbidity for 5 minutes and record the average measurement.

Post-Compliance:
For each dredging load, after overflow dredging has ceased, measure turbidity continuously for up to one hour, or until turbidity returns to background levels, whichever occurs first.
3.2.3 Turbidity Monitoring - Oyster Beds
3.2.3.1 Monitoring Locations
For one dredging load per day, and additionally whenever Water Column turbidity at a depth of seven meters exceeds background levels by more than the limit specified in Paragraph IMPLEMENTATION, establish a transect co-linear with the direction of the dredge overflow plume as it moves out of the Main Navigation Channel and over the adjacent New Jersey oyster bed.
Measure turbidity at a depth of 1 meter above the river bottom at the following approximate locations along the transect:
Location 1:
Intersection of the overflow plume and the edge of the Main Navigation Channel ("start point" of the transect).
Location 2:
300 meters within the New Jersey oyster bed.
Location 3:
800 meters within the New Jersey oyster bed.
Location 4:
1,300 meters within the New Jersey oyster bed.
3.2.3.2 Monitoring Frequency and Duration
Measure turbidity at the transect locations within 2.0 hours after overflow commences. Measure Background (post-overflow) turbidity at the same transect locations not sooner than 2.5 hours after the cessation of overflow. Measure turbidity for 5 minutes and record the average measurement.
3.2.4 Reporting
Record the Turbidity Monitoring data specified in the following paragraphs and submit all data electronically. Submit data daily during the period of dredging. Provide reports in Excel Spreadsheet (.xls) files, Version 2003 or later.
3.2.4.1 Monitoring Reports
At a minimum, include the following information in the monitoring reports for each turbidity measurement taken:

a. Time of day and date measurement was taken.
b. Depth of water body.
c. Depth of measurement.
d. Antecedent weather conditions.
e. Tidal stage and direction of flow.
f. Dredge location at the beginning and end of the load (station location and map).
g. Measurement location in State plane coordinates (x and y).
h. Distance between measurement location and the dredge.
i. Wind direction and velocity.
j. Water temperature.
k. Salinity.
l. Dissolved oxygen.
m. NTU.
n. Monitoring personnel.
Also list and describe in the monitoring reports any BMPs implemented, if necessary, and include a description of any factors influencing the sampling program. When sampling is not conducted, a brief statement shall be given explaining the reason for not conducting the sampling, i.e. "no sampling taken due to high seas". Provide state plane coordinates (x and
y) for all sampling locations, including the coordinates of the dredge and the distance between the sampling location and dredge for each sampling event to demonstrate compliance with the stated sampling distances.
3.2.5 Total Suspended Solids (TSS)
Collect a water sample for analysis of TSS at the same time, location, and depth of all required turbidity measurements. Store and preserve samples as prescribed in Appendix B. Analyze water samples for TSS according to EPA Method 160.2. Submit the results of TSS analyses weekly during the period of dredging, not later than approximately 15-21 days after sample collection. Submit results (Paired TSS and NTUs) in an Excel Spreadsheet (.xls) file, Version 2003 or later.
3.2.6 Food Quality Analysis
Whenever Water Column turbidity at a depth of seven meters exceeds background levels by more than the limit specified in Paragraph IMPLEMENTATION, collect water samples for analysis of oyster food quality.
A sufficient volume of water shall be collected for laboratory analysis of chlorophyll a, carbohydrates, lipids and proteins (one gallon of water shall be collected for each sample). Water shall be collected at each of the four transect locations listed above, at a depth of one meter above the river bottom. Collect samples at the same time as the TSS and NTU measurements are made as specified in Paragraph 3.2.3.2. A total of eight samples shall be collected. Water samples shall be collected with a noncontaminating pump. Potential for contamination can be minimized by using a peristaltic or a magnetically coupled impeller design pump. Flush the system with the equivalent of 10 times the volume of the collection tubing prior to sample collection. Position the sample intake at least five meters away from potential contamination sources. Place samples on ice immediately after collection, and deliver to the USACE construction office no later than 8 PM that day.

3.2.7 Additional Testing
The Contracting Officer may direct that additional tests be performed, at no additional cost to the Government.
3.3 TURBIDITY CONTROL
3.3.1 Implementation
Establish and maintain communication between the dredge and the monitoring personnel to allow for real time reporting of NTU results. If Water Column turbidity exceeds background levels by more than 15 NTU at a depth of seven meters (40 NTU for AS-19 to AS-23 and AS-42 to AS-46), immediately implement Best Management Practices (BMPs) to allow turbidity levels to return to less than 15 NTU above background levels (40 NTU for AS-19 to AS-23 and AS-42 to AS-46). Maintain the BMPs to ensure the specified turbidity level is not exceeded. If compliance with the performance standard is not achieved after the second compliance monitoring measurement, cease overflow for that dredging load. If compliance with the performance standard is not achieved for three consecutive dredging loads, cease all overflow dredging until the Contracting Officer allows overflow dredging to resume.
3.3.2 Notification
If turbidity exceeds background levels by more than the specified turbidity level, immediately notify the Contracting Officer Representative, or on the morning of the following work day if it occurs after normal work hours.
Notification shall include a description of the BMPs implemented and a plan for avoiding further exceedances of the performance standard.
3.4 WORK DELAY
Delays in work due to the fault or negligence of the Contractor or the Contractor's failure to comply with this specification shall not be compensable. Any adjustments to the contract performance period or price that are required as a result of compliance with this section shall be made in accordance with the provisions of the Clause SUSPENSION OF WORK of Section 00 70 00 CONTRACT CLAUSES.
3.5 MEASUREMENT AND PAYMENT
The work specified in this section will not be measured for payment and all costs in connection therewith shall be included in the contract unit price for Bid Item titled "Removal & Satisfactory Disposal of New Material from Delaware River Channel".

1.5 MATERIAL TO BE REMOVED
The material to be removed under this contract is new material consisting primarily of clays, silts, sands and gravel, and may contain cobbles and boulders, with the exception of material which cannot be removed or buried below project depth, as identified in Paragraph "DEFINITION".
These materials might be encountered in other new dredging areas as well.
Vibracore data from current geotechnical investigations are included as Section 00 73 42. Historic vibracore data from previous geotechnical investigations are provided as Section 00 73 43. The information depicted on the vibrational core logs represent the results of subsurface explorations made on the dates indicated and can only be considered as conditions existing at that time.
a. The areas to be dredged under this Contract includes portions of the Liston, Elbow of the Cross Ledge, and Miah Maull ranges of the Delaware River. The locations and limits are shown on the drawings.
b. Material encountered during the previous dredging contract for Reach 'D' (Station 259+000 to Station 317+000) indicated the presence of boulders greater than 36 inches along the southern project limits. During the lower Reach 'E' dredging project (Station 432+000 to Station 512+000), difficulties were encountered dredging material from the northern limits of project (Station 432+000 to Station 447+432). The material encountered consisted of a higher percentage of gravel, as compared to to the remaining limits of work. This section was then excluded from the previous project and included in this project.
1.5.1 Hard Material
The removal of hard material is not included. Should hard material, as identified in Paragraph "DEFINITION", be encountered, the Contractor shall remove therefrom all overlying material which in the judgment of the Contracting Officer can be removed. Nothing in this paragraph shall be construed as prohibiting the removal of hard material by special means at prices agreed upon and approved in accordance with Contract Clause:
"DIFFERING SITE CONDITIONS". Should the Government direct in writing that hard material be removed, the work shall be performed and an adjustment in the contract price or time for completion, or both, will be made in accordance with "FAR 52.236-2, Differing Site Conditions." If hard material is to be removed, blasting will not be permitted.
1.5.2 Character of Materials
a. It is the Government’s position that sufficient information has been provided in this contract package to enable the Contractor to establish the type and quantity of material to be removed. However, prior to bidding, the Contractor may, at his discretion and expense, conduct additional investigation to further determine conditions at the site.
b. A permit is required to perform site investigations. The application shall be submitted to US Army Corps of Engineers, Philadelphia District.

1.6 SITE CONDITIONS
Bidders are expected to examine the site of the work, including the disposal areas and decide for themselves as to the conditions affecting their operations. See Contract Clause entitled: "SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK". The entire work site is designated as a hard hat area in accordance with EM 385-1-1.
1.7 DIFFERENTIAL GLOBAL POSITIONING SYSTEM (DGPS) EQUIPMENT
The Contractor must have a differential GPS, and shall conduct his survey work in accordance with the requirements for a Class 1 Survey, as defined in the U.S. Army Corps of Engineers Hydrographic Surveying Manual EM 1110-2-1003. Provide real time DGPS positioning of the dredge, on a computer screen during dredging operations, and have the capability of playback in 1 minute intervals. Record the dredge position on a disk every 1 minute and submit this to the Contracting Officer on a daily basis.
Provide data in ESRI ArcGIS 10.x Shapefile format (.shp), including all components and extensions, or in a Spatial Data Standard compliant geodatabase. Real time positioning data shall include northing, easting, elevation, date and time of information.
1.8 FUEL OIL HANDLING
Ensure that all fuel oil transfer operations to or from the plant comply with all Federal, state, and municipal laws, codes and regulations.
Incorporate in the accident prevention program, submitted in compliance with the Contract Clause: "ACCIDENT PREVENTION", sufficient information to demonstrate compliance with 33 CFR 156 and any other applicable laws, codes, and regulations.
1.9 GOVERNMENT PLANT
The Government reserves the right to utilize another plant in any of the work assignment areas during the contract period.
1.10 ENVIRONMENTAL PROTECTION REQUIREMENTS
Provide and maintain during the life of the contract, environmental protective measures specified in Section 01 57 20 ENVIRONMENTAL PROTECTION.
Also, provide environmental protective measures required to correct conditions, such as oil spills or debris, that occur during the dredging operations. Comply with Federal, State, and local regulations pertaining to water, air, and noise pollution.
PART 2 PRODUCTS
2.1 TIMBER FOR FLASHBOARDS AND SLUICE BOX WALKWAYS
Timber for flashboards and sluice box walkways shall be Southern Yellow Pine, Grade No. 1, and shall conform to the SPIB 1003 and the applicable requirements of U. S. Department of Commerce DOC PS 20-10. The timber shall be surfaced on four sides and the dress size shall conform to U. S.
Department of Commerce DOC PS 20-10. Treat wood as specified in AWPA U1, for UCS category UC4A (For Above Ground, Soil Contact or Fresh Water Use), in accordance with AWPA T1, with water-borne preservative listed in AWPA P5, except that chromated zinc chlorides, pentachlorophenol-ammoniacal systems, and alkyl ammonium compounds will not be allowed. Each piece of treated lumber or timber shall be branded, by the producer, in accordance with
