Water Quality Certifications are anticipated to be received prior to Bid opening.

Is the USACE aware of any Federal, State, or local licenses, permits or regulations applicable to this project? If so, please advise the source of such documents.

Water Quality Certifications are required and have been requested from the States of New Jersey and Delaware for the use of economic loading.

a. We do not have General Liability limits split between bodily injury and property damage. We have $1,000,000 each occurrence and $2,000,000 Aggregate. Is this acceptable?

Sheet C-115 Note 9 states that significant work has been performed in the disposal area since the date of the surveys. Would the work performed have increased or decreased the available fill capacity at this site.

Recent work in the disposal area may have affected the capacity of Area 3. However, Area 2 has been added to contract by Amendment 0004 for use if the capacity of Area 3 is exceeded.

Bid form lists 1,280,000cy to be dredged. This volume would then be significantly larger when considering overdig volumes. Our volume calculation based on the contours and data provided in the plans for available space within the Artificial Island Area 3 Disposal Site is 1,150,000cy. Does this sound accurate?

Recent work in the disposal area may have affected the capacity of Area 3. However, Area 2 has been added to contract by Amendment 0004 for use if the capacity of Area 3 is exceeded.

35 20 23, Dredging

1.1 DEFINITION

“Hard material is defined as material requiring blasting or the use of special equipment for economical removal, and includes boulders, ledge rock, wrecks, snags, stumps, piles or rock fragments too large to be removed in one piece or buried below project depth by the dredge.”

We believe that a discrepancy exists with Paragraph 1.5, which reads as follows:

a. MATERIAL TO BE REMOVED “The material to be removed under this contract is new material consisting primarily of clays, silts, sands and gravel, and may contain cobbles and boulders, with the exception of material which cannot be removed or buried below project depth without blasting, as identified in Paragraph “HARD MATERIAL”. The Contractor can expect to encounter compact clays, silts, sands and gravel, and may encounter cobbles and boulders in deeper areas not previously dredged.”

We suggest that the first two sentences of the first paragraph in Paragraph 1.5 “MATERIAL TO BE REMOVED” be replaced with the proposed language stated below to remove this discrepancy:

“The material to be removed under this contract is new material consisting primarily of clays, silts, sands and gravel. The Contractor may encounter hard material as identified in Paragraph 1.1 “HARD MATERIAL” in such new material or in deeper areas not previously dredged, which is not part of the scope of works, and Sub-Paragraph 1.5.1 “Hard Material” shall govern how such hard material will be treated.” See Amendment No. 0009.

Please clarify that the “…overlying material…” on top of the hard material that cannot be removed without blasting (Hard Material – Blasting) may include hard material that can be removed by special means (Hard Material – Special Means) and that such Hard Material – Special Means shall be priced and approved pursuant to Paragraph 1.5.1 “Hard Material” and/or Contract Clause “DIFFERING SITE CONDITIONS Bid as shown and specified.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average

As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

Hazardous waste removal work:

SHIFT WORK:

An owner mandated irregular shift staring any time other than between 6:00 am and 8:00 am to receive $1.00 per hour, for each hour worked, in addition to the regular rate of pay.

PAID HOLIDAYS:

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based.
