CONTRACTOR'S SITE OPERATIONS FOR SUPPLY AND SERVICE CONTRACTS

1.1 PERMITS AND RESPONSIBILITIES

The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, County, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence, and shall take proper safety and health precautions to protect the work, workers, public, and property of others. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.

1.2 WORK AREAS AND ACCESS

The Contractor shall take steps reasonably necessary to ascertain the nature and location of the work, and investigate the general and local conditions that can affect the work or its cost. Any failure of the

Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the Government. The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions that can affect the work by any of its officers or agents before the execution of this contract, unless the understanding or representation is expressly stated in this contract. Site conditions that should be investigated include, but are not limited to:

(1) Conditions bearing upon transportation, disposal, handling, and storage of materials.

(2) The availability of labor, water, electrical power, and roads.

(3) Uncertainties of weather, river stages, tides, or similar physical conditions at the site.

(4) The conformation and conditions of the ground and equipment and facilities to be replaced and/or rehabilitated.

(5) The character of equipment and facilities needed preliminary to and during work performance.

(6) Amount of work space, accessibility, lighting, etc.

1.2.1 Road Restrictions

No new access roads are required for this work. Any damage to existing roadways that are used for access purposes shall be repaired and the surface shall be restored to its "as found" condition. The Contractor shall comply with any special requirements of the State, County, Local authorities and Corps of Engineers for use of existing roadways. These special requirements include, but are not limited to, traffic regulations and load limits. The Contractor is responsible for investigating and understanding these restrictions. No time extensions or cost claims will be allowed due to road restrictions.

1.2.2 Access by Government Personnel

Clear access shall be maintained for Government personnel and equipment through all work areas.

1.2.3 Contractor's Staging Area and Employee Access

The Contractor's staging area shall be restricted to the area designated by the Government. The contractor's job-site office may be in the staging area, as approved. The project areas off-limits to Contractor shall be all areas other than direct work areas unless escorted by government personnel.

All buildings and facilities constructed or brought on site by the

Contractor shall be maintained in a satisfactory condition with strict observance of the rules of sanitation, safety and order as may be established by the Contracting Officer. Prior to final payment under the contract, all buildings and facilities constructed by the Contractor for his own use shall be removed from the site by the Contractor.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with SUBMITTAL PROCEDURES:

SD-06 Test Reports

Contractor's Agent(s);

Weekly reports shall be submitted by the Contractor giving project status and activities information, see paragraph 1.27

Daily reports shall be completed and submitted to the Contracting Officer or Representative within 24 hours of work, see paragraph 1.28

1.4 STORAGE OF EQUIPMENT AND MATERIALS

Outdoor storage of equipment and materials will be permitted only at designated storage areas in the vicinity of the spillway which will be coordinated with the Government Representative during the pre-work conference. A minimum access space of three feet shall be maintained between stored items and the existing spillway equipment. Due to high winds at the site, everything in the outside storage area(s) shall be securely tied down so it will not be blown into the tailrace.

1.5 PROJECT SECURITY, FEDERAL HOLIDAY AND WORKING HOURS

1.5.1 General

A procedure shall be prepared and submitted for approval for the identification and control of employees entering or leaving the project during the hours of closure. The security of the Contractor's property and items furnished under this contract are the Contractors responsibility, until accepted, whether stored inside or outside the powerhouse.

1.1 Personnel Risk Assessment

A minimum of seven days prior to engaging in work submit a complete, updated and signed list of all Contractor and subcontractor personnel (

Security Personnel List), including their titles and intended working hours to the CO or Project POC. This listing shall be revised and resubmitted when personnel changes occur. A Personnel Risk Assessment (PRA) for each employee requiring authorized unescorted access to the Jobsite. The

Contractor employee will only be allowed authorized unescorted physical access after the PRA is submitted to and approved by the Government. Upon approved authorization by the Government, a Project Specific ID Badge will be prescribed per subparagraph entitled Identification of Employees.

Immediately return all Government-prescribed identification badges to the

Project Administration Office for cancellation upon the release of the employee, end of Work completion, or termination of the Contract.

1.2 Authorized Unescorted Access Requirements

1.5.4 Working Hours

The contractor will have access to the spillway for work during normal plant business hours from 0700 to 1630 hrs Monday through Friday excluding any federally recognized holiday that it is observed on and the contractor shall plan all work accordingly to this work schedule. These hours will be strictly adhered to unless government determines work outside this time is beneficial to the government.

In addition to the work business hours listed previously all clearance

(Lock Out - Tag Out) and crane operations needed to be performed by the government shall take place during powerhouse maintenance personnel work schedule Monday through Thursday 0730 to 1600. This shall include any deliveries that would require government personnel for crane operations.

1.5.5 Site Work Schedule

A site work schedule shall be prepared and submitted. The schedule shall include major and minor work elements and stages of the work. These documents shall be updated and submitted to reflect the actual work elements and progress anticipated in the future.

1.6 VEHICLES

1.6.1 Use of Private Vehicles

Private vehicles of the Contractor and Contractor's employees shall use the spillway access road and staging area on the downstream side of the spillway control room. The Contractor shall follow all Contracting officer requirements regarding vehicle access to the project. Parking of private vehicles shall be restricted to the areas designated by the Contracting

Officer. Additional parking may be designated upon request, but could be located up to ½ mile from the spillway. The Contractor shall maintain the designated parking areas.

1.6.1.1 Identification of Vehicles

All Contractor's vehicles shall display approved permanent identification of such size and color to allow Government personnel to identify the vehicle.

1.7 UTILITIES

1.7.1 Government Furnished Utilities

All utilities that are required for use in performance of the work under this contract shall be Contractor-furnished except as noted below:

1.7.1.1 Water

The spillway does not have any water available from existing outlets, but a temporary pump can be placed to provide water from the river. In such case, the contractor will be responsible for providing his own pump. The

Contractor shall provide the materials and equipment and perform all work necessary to facilitate work and to protect the work from damage by water.

The Contractor shall make his own investigations and determinations of conditions, both existing and anticipated concerning care of water.

Plans for care of water are subject to approval by the Contracting Officer prior to work start. Facilities shall be removed upon completion of the work.

1.7.1.2 Electricity

Electric power may be obtained from existing sources located at various locations near the work areas. Supply voltages are 120V single phase and

480V three phase. Contractor is responsible for investigating receptacle requirements and providing necessary adapters.

Note: Many of the receptacles in the powerhouse are the twist-lock type, the Contractor shall investigate the available power sources and provide all necessary adapters.

1.7.1.3 Compressed Air

The Contractor will be responsible for providing his own air compressor for any required sources of compressed air.

1.7.2 Temporary Utility Connections

All utilities provided by the Government shall be at no cost. Care shall be exercised in conserving all utilities. The contractor shall at his own expense and in a workman like manner satisfactory to the CONTRACTING

OFFICER provide all necessary hoses, cords, couplings, plugs, GFI's and other appurtenances as required to connect to the system(s). All temporary connections shall be subject to approval. The location of all power lines and all temporary connections for electricity shall be coordinated with the

CONTRACTING OFFICER. All temporary circuits and devices shall be provided, connected, and maintained and removed prior to final acceptance. Ground fault protection shall be provided for all circuits used, inside and outside, and shall be Contractor-furnished. The temporary panel shall conform to current NEC standards in EM 385-1-1.

1.7.3 Use of Sanitation Facilities

1.7.3.1 Portable Toilets

Toilet facilities will not be available for Contractor's use. The

Contractor shall provide and maintain portable toilets for use by the

Contractor's staff . Toilet(s) shall be placed at the location directed by the Contracting Officer. To prevent overturning by high winds, all portable toilets shall be anchored down.

1.7.4 Telephone

There is no land line at the spillway available for the Contractor to use. The Contractor may use cellular phone service if available and functional.

1.8 COOPERATION WITH OTHERS

The Contractor shall cooperate and coordinate his work with that of others as required for orderly completion of all work. In the event of disagreement between the Contractor and others, the decision of the

Contracting Officer shall be final.

1.9 SAFE CLEARANCE PROCEDURES

A Hazardous Energy Control (HEC) procedures are implemented for all the maintenance and work activities on Corps property. These procedures are in accordance with OSHA regulation 29 CFR 1910.147, 1910.333, 1910.269 and USACE ER 385-1-31, The Control of Hazardous Energy

(safe clearance). Any work performed at the Big Bend project will be performed under safe clearance. The contractor shall request clearance on a piece of equipment or system before any work may begin. The Corps will establish the limits of the clearance, tag and lock the equipment or systems. The Contractor will be required to institute their own safe clearance procedures in accordance with OSHA and USACE regulations, within the perimeter or the Corps clearance. The Contractor's clearance shall not inhibit or interfere with the Corps operation of the plant. The clearances shall not be violated. Any violation of Hazardous Energy Control procedure

(Safe Clearance Procedures) will be grounds for removal of the offender(s).

1.10 SCAFFOLDING

Any scaffolding, platform, ladder, stairway, or other access schemes proposed to be used shall be submitted for approval, including type, layout, and connections. Approved anti-slip surface material shall be installed on scaffolding platforms. Scaffolding shall comply in every respect with EM 385-1-1.

1.11 CONTRACTOR'S AREA LIGHTING

The Contractor shall provide all lighting necessary to perform his work and to provide a safe work environment.

1.12 GOVERNMENT FURNISHED TOOLS AND EQUIPMENT

Government tools and equipment at the project, i.e., lathes, drill presses, hand tools, etc., are not available for use.

1.13 DAMAGED EQUIPMENT OR ABNORMAL CONDITIONS

The Government shall be informed immediately upon finding any damaged equipment or other abnormal conditions involving additional work. The failure or abnormality shall not be disturbed until witnessed by the

CONTRACTING OFFICER. Prior to proceeding further with work, the Contractor and the Government shall agree in writing as to the responsibility for the damage or abnormality.

1.14 PROTECTION AND RESTORATION OF EXISTING FACILITIES

The Contractor shall be responsible for the protection of the work area from damage. All existing grounds, property and facilities shall be protected whether or not shown on the drawings. Upon completion of the work, all the existing grounds, property and facilities, not included as a portion of the work, shall be left in a condition equal to the original condition prior to the contract. Costs for repair and restoration of any facilities shall be considered to be incidental to and included in the contract price. All work, storage of materials, and work plant shall be kept within the limits of the areas assigned. Prior to work operations, the Contractor shall confer with the Contracting Officer's representative to determine the proximity of any possible obstructions, pipe or equipment which could be damaged as a result of work operations. Existing utility lines shall be protected from damage, and if damaged, shall be repaired by the Contractor at no additional expense to the Government. In the event that the Contractor damages any existing utility lines report thereof shall be made immediately to the Contracting Officer. The Contractor will be responsible for the protection of structures from any structural damage during the work operations. At all times the plant and work areas shall be kept in a condition conducive to safety of workmen and the public and neat in appearance. Waste or surplus materials shall not be allowed to accumulate in the work areas.

1.15 DAILY CLEANUP AND DISPOSAL

All debris resulting from the work, such as waste metalwork, packing cases, scrap lumber, oil and grease, and other debris shall be collected, removed, and disposed of off site at least once per shift. Disposal shall be in accordance with Federal, State and Local regulations. The location of the

Contractor's off-site disposal area and a plan for safe disposal of material shall be approved. The Government's trash cans, dumpsters, etc.

shall not be used. Liquid waste shall not be disposed of in the spillway structure drains. All costs of removing debris shall be incidental to the work, and no separate payment will be made therefore. All temporary structures used by the Contractor in the course of the work shall leave the area looking "broom clean".

1.16 DISPOSAL OF MATERIALS

Title to all materials and equipment to be disposed of, except salvage items and hazardous waste, is vested in the Contractor upon receipt of signed contract and such materials and equipment are designated scrap only as directed. The Government will not be responsible for the condition, loss or damage to such property after notice to proceed. The Contractor may retain these items in usable form and take possession of them providing that there is no subsequent cost or inconvenience to the Government. The

Government does not guarantee that these items are complete or in working order, and the Contractor shall assume responsibility for any damages caused by their use immediately upon taking possession of them. Scrap materials shall be removed from the Government's property within 14 days.

Scrap shall not be sold on the site.

1.17 CARE OF DRAINS

Existing spillway structure drains shall not be used for disposal of any solid material or any liquids other than clear water. Drains obstructed by the Contractor shall be cleaned by the Contractor. All costs incurred in the cleaning and clearing of plugged drains, shall be borne by the

Contractor.

1.18 CONTRACTOR'S AGENT, WORK SUPERVISOR, AND PERSONNEL

1.18.1 Contractor's Agent(s)

The Contractor shall give personal attention to the faithful execution and completion of this work and shall be present either in person or by duly authorized representative(s) on the site of the work continually during its progress. The agent shall be fluent in the spoken and written English language. The agent's qualifications and identification shall be provided. The agent shall be fully authorized to act for the Contractor and to receive such orders as may be given for the proper continuance of the work. Written notice to do any work, to alter any work, or to cease work which the Contractor is obligated to do, or concerning any imperfections in work or any material furnished, when given to the agent shall be considered as notice to the Contractor. A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract. The agent shall have been engaged in similar work at a minimum of two different powerhouses. A verifying contact, with name and phone number, shall be provided for at least two such facilities.

1.18.2 Site Supervisor(s)

At least one full-time employee of the Contractor shall be available at the work site anytime other Contractor personnel are working on the site to supervise and direct the work specified herein. The Contractor's Agent and

Site Supervisor can be the same person, provided that all qualifications are met. The supervisor(s) shall be fluent in the spoken and written

English language. The supervisor shall be technically qualified to supervise the site work and commissioning and all other aspects related to completing this work. The supervisor shall report immediately in writing to the Government any work not in accordance with the manufacturer's recommendations, or any special conditions which may result in an unsatisfactory job. A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract.

1.18.3 Contractor's General Personnel

The Contractor shall prepare and keep updated, as a minimum weekly, a project organization chart reflecting at least those positions described herein and defining their work relationships, etc. All personnel employed by the Contractor shall be fully qualified in their respective fields to render the services necessary.

1.19 SPECIAL INSTRUCTIONS FOR PROGRESS CHARTS

1.20 PROJECT REPORTING

Weekly reports shall be submitted by the Contractor giving project status and activities information. An updated CPM should be included in this report, if appropriate. This report shall include a written summary, accompanied with detailed information relating to current status of procurement, work, and delivery activities compared to both the current project schedules and the schedule submitted at the time of the Request for Technical Proposal.

1.21 WEEKLY MEETINGS

Once each week, while on site, a general meeting will be held between the

Contractor and the Government. This meeting will be used to discuss progress in the last week and work planned in the upcoming week. A meeting time and place shall be mutually agreed upon.

In order to closely coordinate work under this contract, the Contractor shall prepare a written agenda/meeting minutes at the weekly coordination meeting with the Contracting Officer at which time the Contractor shall submit for coordination and approval, his proposed daily work schedule for the next two week period. The Contractor shall provide a copy of modifications (MODs), Serial Letters, Requests for Information (RFIs)and any other information that is needed in the minutes of the meeting.

Required temporary utility services, time and duration of interruptions, and protection of adjoining areas shall be included with the Contractor's proposed 2-week work schedule. At this meeting, the Contractor shall also submit his schedule of proposed dates and times of all preparatory inspections to be performed during the next 2 weeks. Coordination action by the Contracting Officer relative to these schedules will be accomplished during these weekly meetings. Daily reports shall be completed and given to the Contracting Officer or Representative within 24 hours of work.

1.22 PUBLIC ROADS

1.22.1 Road Closure

The road over the Big Bend spillway is a South Dakota state highway and the only river crossing point within approximately twenty miles. Therefore the

Contractor shall make every attempt to keep at least one lane open at all times through the use of flag men at each of the spillway bridge. The

Contractor is required to coordinate any road/lane closure with the SDDOT and USACE. Temporary closure of both lanes of traffic may require special permission from the SD DOT and the Contractor is encouraged to investigate that situation before assuming permission will be granted.

1.22.2 Traffic Control Devices

All traffic control devices (signage, barricades, lighting etc) by the

Contractor, must conform with the U.S. Department of Transportation, Federal Highway Administration, Manual on Uniform Traffic Control Devices.

1.22.3 Traffic Control

The Contractor shall, at his own expense, furnish all personnel, signal devices and signal necessary for the safe and efficient control of work traffic on road systems used by the Contractor. A plan for traffic control, including a listing of equipment and its employment, shall be submitted for review and approval prior to work.

1.22.4 Operations

When operations are being conducted near a U. S. or State Highway or when work equipment is being used on or adjacent to such highway, the Contractor shall furnish signalmen and such warning signs as are necessary to provide adequate warning to the traveling public.

1.22.4.1 Signalmen/Flagmen

The Contractor shall provide flagmen when:

a) Work equipment and/or vehicles are blocking the roadway making it difficult for vehicles to pass or see or due to terrain.

b) One-way traffic is required thru a work zone.

c) Trucks are pulling onto and/or off of a roadway or operating at a reduced speed causing a hazardous situation for drivers.

d) Anytime the Contractor feels that drivers are at risk due to Work activity.

1.22.5 Barricades

At each location designated by the Contracting Officer and where safe operation requires the closing of roads, streets or other travel arteries leading to the work under this contract, the Contractor shall maintain a heavy plank barricade or other effective barrier during work.

Arrangements for closure of roads, streets or other travel arteries shall be made by the Contractor with local State, County or City officials. The

Contractor shall notify the appropriate official in writing at least ten

(10) days in advance of the date he desires to close a road to traffic and shall furnish a copy of the agreement to the Contracting Officer prior to closure. A satisfactory sign shall be placed on each barricade stating that the artery is closed. The cost of barricades shall be at the expense of the Contractor.

1.1 SUMMARY

The Contractor is responsible for total management of his work including approval, scheduling, control, certification of all submittals and compliance with all applicable Buy-American Act and Trade Agreement Act clauses. The submittal management system provided in these specifications is intended to be a complete system for the Contractor to use to control the quality of materials, equipment and workmanship provided by manufacturers, fabricators, suppliers and subcontractors. Review each submittal for contract compliance. This review is based on the contract drawings and specifications. Compliance with all applicable Buy American

Act and Trade Agreement Clauses is to be included in this review. The

Contractor must provide the country of origin on ENG Form 4025 for each item submitted. Submittals that comply will be forwarded to the

Government. Submittals that do not conform will be returned to the originator to be corrected. The Submittal Register (ENG Form 4288) will be utilized to log and monitor all submittal activities. No work or installation activities are to be performed until required approvals of applicable submittals have been made. Check to assure that all materials and/or equipment have been tested, submitted and approved during the preparatory phase of quality control inspections.

The Contracting Officer may request submittals in addition to those specified when deemed necessary to adequately describe the work covered in the respective sections.

Units of weights and measures used on all submittals are to be the same as those used in the contract drawings.

Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements.

Contractor's Quality Control (CQC) System Manager shall check and approve all items prior to submittal; and stamp, sign, and date indicating action taken. Proposed deviations from the contract requirements are to be clearly identified. Include within submittals items such as:

Contractor's, manufacturer's, or fabricator's drawings; descriptive literature including (but not limited to) catalog cuts, diagrams, operating charts or curves; test reports; test cylinders; samples; O&M manuals

(including parts list); certifications; warranties; and other such required submittals.

Submittals requiring Government approval are to be scheduled and made prior to the acquisition of the material or equipment covered thereby. Pick up and dispose of samples not incorporated into the work in accordance with manufacturer's Material Safety Data Sheets (MSDS) and in compliance with existing laws and regulations.

1.2 DEFINITIONS

SD-01 Pre-work Submittals

Submittals which are required prior to start of work, includes schedules, tabular list of data, or tabular list including location, features, or other pertinent information regarding products, materials, equipment, or components to be used in the work. SD-02 Shop Drawings

Drawings, diagrams and schedules specifically prepared to illustrate some portion of the work.

Diagrams and instructions from a manufacturer or fabricator for use in producing the product and as aids to the Contractor for integrating the product or system into the project.

Drawings prepared by or for the Contractor to show how multiple systems and interdisciplinary work will be coordinated.

Catalog cuts, illustrations, schedules, diagrams, performance charts, instructions and brochures illustrating size, physical appearance and other characteristics of materials, systems or equipment for some portion of the work.

Samples of warranty language when the contract requires extended product warranties.

SD-06 Test Reports

Report signed by authorized official of testing laboratory that a material, product or system identical to the material, product or system to be provided has been tested in accord with specified requirements. (Testing must have been within three years of date of contract award for the project.)

Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work or prototype prepared for the project before shipment to job site.

Report which includes finding of a test made at the job site or on sample taken from the job site, on portion of work during or after installation.

Investigation reports.

Daily logs and checklists.

Final acceptance test and operational test procedure.

SD-07 Certificates

Statements printed on the manufacturer's letterhead and signed by responsible officials of manufacturer of product, system or material attesting that product, system or material meets specification requirements. Must be dated after award of project contract and clearly name the project.

Document required of Contractor, or of a manufacturer, supplier, installer or Subcontractor through Contractor, the purpose of which is to further quality of orderly progression of a portion of the work by documenting procedures, acceptability of methods or personnel qualifications.

Confined space entry permits.

Text of posted operating instructions.

SD-08 Manufacturer's Instructions

Preprinted material describing installation of a product, system or material, including special notices and (MSDS)concerning impedances, hazards and safety precautions.

SD-09 Manufacturer's Field Reports

Documentation of the testing and verification actions taken by manufacturer's representative at the job site, in the vicinity of the job site, or on a sample taken from the job site, on a portion of the work, during or after installation, to confirm compliance with manufacturer's standards or instructions. The documentation must be signed by an authorized official of a testing laboratory or agency and must state the test results; and indicate whether the material, product, or system has passed or failed the test.

Factory test reports.

SD-10 Operation and Maintenance Data

Data that is furnished by the manufacturer, or the system provider, to the equipment operating and maintenance personnel, including manufacturer's help and product line documentation necessary to maintain and install equipment. This data is needed by operating and maintenance personnel for the safe and efficient operation, maintenance and repair of the item.

This data is intended to be incorporated in an operations and maintenance manual or control system.

SD-11 Closeout Submittals

Documentation to record compliance with technical or administrative requirements or to establish an administrative mechanism.

Special requirements necessary to properly close out a contract. For example, Record Drawings, special warranties, posted operating instructions, training plan and as-built drawings.

Interim "DD Form 1354" with cost breakout for all assets 30 days prior to facility turnover.

1.2.2 Approving Authority

Office or designated person authorized to approve submittal.

1.2.3 Work

As used in this section, on- and off-site work required by contract documents, including labor necessary to produce submittals, except those

1.2.4 Administrative Submittals

The submittal items listed below are not to be included on the Submittal

Register (as discussed below). Unless directed otherwise by the

Contracting Officer, the following administrative submittals are submitted to the Area or Resident (as directed) Office, for acceptance, via a Serial

Letter: Submittal Register (this section), Quality Control Plans QUALITY

CONTROL, Accident Prevention Plans GOVERNMENTAL SAFETY REQUIREMENTS, Revisions to Environmental Protection Plans 10 ENVIRONMENTAL PROTECTION) and other submittals as directed by the Contracting Officer. Format for the Serial Letter is as directed by the Area or Resident Office.

Submit three (3) copies of administrative submittal items, unless directed otherwise.

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with this section.

1.4 ELECTRONIC SUBMITTALS

Electronic format will be utilized for submission of work submittal items required by the specifications, including ENG Form 4025 Transmittal Form, with exceptions noted below.

1.4.1 Exceptions

Submit all SD-04 (Samples) submittals and other submittals, where noted in the specifications to be in physical, hard-copy form. Other known exceptions include: Operation and Maintenance Data/Manuals. Number of hard copies shall be as required in the "SUBMITTAL ITEM PROCEDURES" paragraph below.

1.4.2 File Format

Electronic submittals may be submitted by any means readily accessible to the Government including, but not limited to, the following:

a. E-mails with text and all attachments less than or equal to 14MB in size. The Government IT system does not currently support e-mail transmissions of greater than 14MB. Should this e-mail transmission size limitation change during the course of the Contract, larger e-mail transmissions may become acceptable, but no time extensions will be granted for transmission errors resulting from oversized email attachments.

b. Internet Secure File Transfer Protocol (FTP) systems compatible with Government IT systems.

c. Mailed CD-ROM or DVD-ROM media.

d. Contractor-funded file sharing website compatible with Government

IT systems.

e. Any other secure, Government-approved means of transmitting digital media.

Means of transfer must provide documents freely accessible to the

Government. If the means of transfer is by e-mail, FTP repository, or similar, files shall be capable of being downloaded without errors or disruption. Regardless of the method of transfer, the files shall be able to be archived on Government IT systems without error or restriction.

Once provided, all submittal documents shall become Government property.

ZIP-file or similar archives requiring a password for access to the archive are permissible provided the password for the archive is static, permanent, not use-limited, and provided to the Government at the time of transmission. Any individual files provided electronically to the

Government in 'SECURED' format, password-protected, or utilizing any other such method of file restriction shall be deemed defective and returned to the Contractor for correction. Regardless of errors encountered during the electronic submittal process the Contractor shall be responsible for delays resulting from the inadequacy of media delivery method, file-formatting, or file restriction issues. No time extensions will be granted for delays resulting from improper file formatting, file restrictions, or inadequate file transfer methods.

Discussion and decisions on a consistent Means of transfer throughout the duration of the project will be made at the pre-work conference. The format of electronic submittals is Adobe Acrobat Portable Document Format

(PDF), compatible with Adobe X, unless agreed to and directed otherwise by the Contacting Officer's Representative. For As-built drawings, see

AS-BUILT DRAWINGS.

1.4.3 Digital File Naming

Label and name electronic files delivered to the Government in a manner that is logical and consistent throughout the duration of the project. A file naming convention that clearly indicates the transmittal number, component of submittal, and revision number associated with the submittal will be discussed and confirmed at the pre-work kickoff conference.

1.4.4 Content

Submit one (1) set of readily copied and legible electronic documents and associated matching ENG Form 4025 Transmittal Form. Duplicate copies of electronic submittals are not desired. Content and format of the electronic submittal shall conform to all requirements listed herein. Delivery methods of both electronic and hard-copy submittals shall remain consistent throughout the duration of the Contract, in compliance with Contract specifications.

1.4.5 Delivery

Delivery of submittals will be similar to those described in the "SUBMITTAL

ITEM PROCEDURES" paragraph below. Notifications of file transfers will be sent to the Government recipients listed below. The means of contact and notification by mail or email will be coordinated and confirmed at the pre-work conference.

1.5 SUBMITTAL CLASSIFICATION

Submittals are classified as follows:

Unless directed otherwise, the words "Government Approval" associated with

"G" designated submittals are interpreted in the context of the below defined submittal types. Submittal Reviewers include the following:

DO - District Office

AE - Architect Engineer

CR - Government Conformance Review

DA - Designer of Record

AO - Area Office or other designated Government Office

RO - Resident Office

1.5.1 Government Approved G

Government approval is required for extensions of design, critical materials, deviations, equipment whose compatibility with the entire system must be checked, and other items as designated by the Contracting Officer.

All submittals noted in the technical specifications and Submittal Register as "G-DO", "G-AE", "G-AO" and "G-RO" are subject to Government Approval.

Within the terms of the Contract Clause entitled, "Specifications and

Drawings" they are considered to be "shop drawings."

1.5.2 Information Only

Submittals not requiring Government approval will be for information only.

They are not considered to be "shop drawings" within the terms of the

Contract Clause referred to above.

1.6 PREPARATION

1.6.1 Transmittal Form

Use the attached sample transmittal form (ENG Form 4025) for submitting both Government approved and information only submittals in accordance with the instructions on the reverse side of the form. These forms will be furnished to the Contractor. Properly complete this form by filling out all the heading blank spaces and identifying each item submitted. Exercise special care to ensure proper listing of the specification paragraph and sheet number of the contract drawings pertinent to the data submitted for each item.

1.7 INFORMATION ONLY SUBMITTALS

Normally submittals for information only will not be returned. Approval of the Contracting Officer is not required on information only submittals.

The Government reserves the right to require the Contractor to resubmit any item found not to comply with the contract. This does not relieve the

Contractor from the obligation to furnish material conforming to the plans and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work;

and does not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the

Governmen…
