ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable No information or did not apply to your contract
Rating will be neither positive or negative.

Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: Contractor is to provide all contract work force and equipment required to perform Refuse/Garbage Disposal services at Benbrook Lake as defined in this Performance Work Statement, except for those items specified as government furnished property and services. General requirements include providing and placing dumpsters for use in public parks, and removal of accumulated waste as specified below.
1.2 Scope of Work: This is a Purchase Order Contract. Work will consist of furnishing all labor, materials, fuel, and equipment necessary to perform specified refuse services in public use areas at the lake. Contractor's work and responsibility shall include, but not be limited to, all job planning, programming, scheduling, administration, inspection, and management necessary to accomplish the required services. Contractor shall assure that all work is accomplished in accordance with the contract specifications, all applicable laws, municipal codes, regulations and/or written directives issued by the Contracting Officer. The areas covered, number of facilities, and frequencies of services are provided in the attached tabulation of park areas & facilities, frequency schedules, and park maps.
1.3 Project Descriptions and Information:
1.3.1 Location: Benbrook Lake is located entirely in Tarrant County. The Project Headquarters is located at 7001 Lakeside Dr., Fort Worth, Texas 76132, phone 817-292-2400. The lake is generally bounded on the west by Hwy 377, by FM 1187 on the South, Old Granbury Road on the East, and by Lakeside Drive on the North. Office hours are from 7:30 a.m. to 4:00 p.m. Monday thru Friday.
1.3.2 Climate: The climate in Tarrant County, Texas is generally mild with hot summers and cool winters.
Extreme temperatures, snowfall, rainfall, and drought conditions are experienced regularly. The average length of an annual growing season is 230 days. Annual mean precipitation is 31.3 inches.
1.4 Frequency of Service: The required frequency of service is provided in the list of attachments, Frequency Schedules, for each service required. It may become necessary for the Contracting Officer's Representative (COR), or Lake Manager when applicable, to decrease service frequencies in any or all parks or portions of parks. Payment for decreased services shall be adjusted according to the unit price shown on the bid schedule. It may become necessary at any time during the duration of this contract for the COR or Lake Manager to close any park or portion of a park and delete any subsequent service for the closed park or area.
1.5 Flood or Construction Activities, and Park Closures: The Government may, at any time during the duration of this contract, close any park or portion of a park, for reasons such as flooding or construction activities, and delete any subsequent service in the closed park or area. The Contractor shall be given notification as soon as possible to prepare for either contingency. This decrease shall be deducted from the monthly invoice and paid for in accordance with the bid schedule.
1.6 Preferred Sequence for Work Schedules: The COR or Lake Manager shall provide the Contractor with a preferred sequence, or order, of parks and/or areas in which work is to be accomplished. The schedules must be submitted within ten (10) working days after the preferred sequence has been issued, but no later than five (5) working days prior to the beginning of Refuse/Garbage Services. This schedule is extremely important as it controls the time at which the quality assurance inspections are performed, ensuring that said inspections are done only after the required service has been completed. Any variation or unforeseen change, such as being ahead or behind the approved schedule, must be reported immediately by phone or in person. Any proposed change to an approved schedule must be submitted in writing and approved by the Contracting Officer or COR or Lake Manager in advance of actual schedule changes.
1.7 Workday: Services scheduled to be performed may not commence before 7:00am, and must be completed by 4:00p.m. on all scheduled workdays. Any variation from this schedule must be approved in advance by the COR or Lake Manager. If for any reason the day's required service cannot be completed by the designated time, the Contractor must notify the COR or Lake Manager by 3:00p.m. of that day, either by phone or in person, (followed in writing), advising him/her of the facilities not serviced and the reason work was not completed. Should the COR or Lake Manager allow, and non-completion is very infrequent, services not completed may be rescheduled for the following day if it is an unscheduled workday. Otherwise, deductions in payment for services not performed shall be made in accordance with the bid schedule and the Payment Analysis.
1.8 Typical Drawings: The specification requirements shall override all typical drawings. Typical drawings are not to scale, nor are they intended to depict all facilities at the lake. Therefore, typical drawings are in the list of attachments and are included for general information purposes only.
1.9 Permits - The contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract. All requirements of Municipal Solid Waste Management Regulations, Texas Department of Health Resources, as amended shall be met.
1.10 Disposal - All current requirements of Municipal Solid Waste Management Regulations, Texas Water Commission, shall be met and maintained. No disposal area shall be provided on Government land. All refuse/garbage collected by the Contractor must be removed from Government land and disposed of in private or public disposal areas at the Contractor's expense. The Contractor must make all the necessary arrangements, obtain permits required, and make all payments for use of the disposal area. The Contractor must furnish the Contracting Officer a letter from the owner of the disposal area/landfill that is proposed to use stating that the Contractor is authorized to use the disposal area. If the proposed disposal area is not presently being utilized as a State authorized City or County garbage disposal area, the Contractor must furnish the COR or Lake Manager a letter from the Texas Water Commission approving the area for refuse/garbage disposal. This approval shall be required even if the Contractor owns the land.
1.11 Award of Other Contracts: The services provided under this contract shall be independent of all services provided under other contracts, at this project or any other project, at which the Contractor may receive award.
