ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions.

The contractor’s proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

1.2.2.1 Regulations and Permits: All current County, State, and Federal rules and regulations governing sanitary standards of drinking water, protection of public water sources and solid waste disposal shall be met and maintained throughout the performance of the work specified under this contract. All trash collected on Government property shall be placed in bulk refuse receptacles (BRR) in the park. If BRR are full in the park, the Contractor shall dispose of trash in nearest BRR in adjacent parks. If trash is hauled off Government property, the Contractor shall make all the necessary arrangements, obtain permits required and make all payments for proper disposal in a facility that is licensed by the Texas Commission on Environmental Quality. If the proposed disposal area is not presently being utilized as a State authorized City or County garbage disposal area, the Contractor must furnish the Government a letter from the Texas Commission on Environmental Quality approving the area for disposal. This approval will be required even if the Contractor owns the land. If fees are charged for use of the disposal area, the Contractor shall furnish to the Government, on a monthly basis, copies of all receipts for fees paid.

1.2.2.2 Traffic Regulations and Safety: The work to be performed under this contract shall be within the boundaries of land administered by the U.S. Army Corps of Engineers. The Contractor and contract employees are subject to all Title 36 regulations while completing work under this contract. No special provisions or entitlements shall be granted to the Contractor or contract employees. The attention of the Contractor and his employees shall be directed to the need for extreme caution and care while driving and operating equipment in these locations. The Contractor and employees shall comply with all state and local traffic laws. The Contractor shall comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, Safety and Health Requirement Manual.

An observed violation of safety requirements shall be grounds for the Government to stop work. Work shall not continue until the violation is corrected.

1.2.2.3 Accident Reporting: The Contractor shall maintain an accurate record of, and shall report to the Contracting Officer (KO) in the manner and time limitations and on the forms prescribed by the KO, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incidental to work performed under this contract. Medical expenses for Contractor personnel are the responsibility of the Contractor.

1.2.2.4 Condition of Equipment: All equipment used to perform work under this contract must be in good operating and mechanical condition and comply with Safety Manual. A regular schedule of preventive maintenance must be followed on all equipment. All maintenance shall be conducted off Government property. Contractor shall insure leaking and unsafe equipment is repaired immediately and shall be responsible for containment and clean-up of leaks. Contractor shall remove and dispose of contaminated soils resulting from leaks or spills in accordance with Federal, State, County and Municipal laws, codes and regulations.

1.2.2.5 Safety Inspections: Prior to work commencement, all equipment shall be inspected by the Government to ensure compliance with Section 18 of Safety Manual.

Contractor shall present all equipment to the Government for inspection whenever equipment is mobilized at the Lake. Contractor shall notify the Government at least two

(2) days prior to bringing equipment on-site so that the time and place of these inspections may be scheduled. The Government may inspect equipment at any time it is operated on Government Property. Any equipment found deficient shall be taken out of service immediately until faulty conditions have been corrected and passed by the Government. No such removal will reduce the Contractor's obligation to perform all work required within the time scheduled under this contract. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

1.2.2.6 Vehicles: All vehicles, including the Contractor’s and any Subcontractors’, utilized under this contract shall be maintained in a neat and clean condition, be serviceable and shall comply with insurance and safety standards as required by the State of Texas. Vehicles shall be identified with company name or logo conspicuously displayed on door panels. Professionally prepared hand-lettering, magnetic signs or pressure sensitive decals shall be used.

1.2.2.7 Maps: Cleaning Maps are specified in Attachment 6 and indicate the approximate areas where services shall be performed. Due to the large scale of service areas, actual boundaries on-site may not be discernible from the maps and delineation on-site by the Government will govern.

1.2.2.8 Typical Unit Drawings: Contract requirements will override all typical drawings.

Typical Unit Drawings provided in Attachment 5 are not to scale, nor are they intended to depict all facilities at all locations. Each unit varies considerably in structure, design and size. Therefore, Typical Unit Drawings are included for general information purposes only.

1.2.2.9 Reports: The Contractor shall prepare and submit Daily Activity Reports (DARs) and Quality Control Reports (QCRs) as specified. Contractor shall develop and provide their own reports. A Daily Activity Report shall be completed each day work is performed and shall be submitted to the Government as directed no later than the following day. A Quality Control Report shall be submitted to the Government at the end of each work week as directed. The Contractor’s Quality Control Inspectors (QCIs) shall ensure all reports are complete, legible and comprehensible.

1.2.2.10 Tabulation of Park Areas and Facilities: The Tabulation of Park Areas and Facilities is provided in Attachment 3. It shows acreage estimates and quantifies facilities within each park. The tabulation is provided for the convenience of the Contractor to determine the work required and to prepare a bid for the work. Lake personnel will show the Contractor the service limits and requirements during an on-site inspection of the areas where required services shall be performed. If the number of facilities listed on the tabulation sheets and maps differs from the number of facilities actually on the ground, then the tabulation sheets and maps will be used for contract purposes. This tabulation depicts all parks open at 100% with current facilities and does not reflect any future work such as remodeling, re-design upgrades, new construction, demolition or moving facilities within areas which may occur within required services areas during performance of contract. The Government reserves the right to perform any future work at its discretion and to modify any and all Schedules within the contract.

1.2.2.11 Frequency Schedules: The Frequency Schedule is provided in Attachment 3 for facility cleaning services required. Extra Services shall be required on specified days around the holidays of Easter, Memorial Day, 4th of July and Labor Day are also provided in Attachment 3.

1.2.2.12 Work Schedule: The Government will provide the Contractor with a preferred work schedule sequence for parks and/or areas at the lake for services to be performed.

The Contractor must provide sufficient personnel and equipment to accomplish services at the lake. The Contractor shall submit a work schedule for each service for the lake to include approximate times for beginning work and ending work for each required service listed by parks or areas. Work schedules must be submitted within ten (10) days after the preferred work sequence has been issued to the Contractor, but no later than ten (10) calendar days after the beginning of initial services and prior to frequency changes. This work schedule is extremely important as it controls the time at which the Government’s Quality Assurance (QA) inspections are performed, ensuring that inspections are conducted only after the required services have been completed. Any variation or unforeseen change, such as being ahead or behind the approved work schedule, must be reported immediately by telephone or in person to the Government’s Quality Assurance Inspector (QAI). Any proposed change to an approved work schedule must be submitted in writing and approved by the Government in advance of actual work schedule changes.

1.2.2.13 Additional Service Work Requirements:

1.2.2.13.1 Restrictions: Raw lake water shall not be used for cleaning except on fishing piers and courtesy docks.

1.2.2.13.2 Occupied Facilities: If a facility is occupied by the public at the time of the scheduled servicing, the Contractor shall ask their permission to service the facility. If the public objects to the performance of the service, the Contractor shall immediately record the unit (by park, facility type and number) on their DAR as a “non-serviced” unit. If the public allows partial cleaning, the Contractor shall note on their DAR as unit “occupied/cleaned” and the Contractor shall be paid the full price. If the facility becomes unoccupied while Contractor is still in the park, the Contractor may service the unit as required and note the unit as “cleaned”. If the facility remains occupied, the Contractor’s DAR shall remain as is and shall be turned into the Government for non-payment. The DAR must be kept current during work performance so that a unit which was not serviced and was later rejected by the Government's QAI can be verified as non-performed because the facility was occupied by the public. A site that is confirmed as being occupied may then be counted as non-performance, rather than as a reject.

1.2.2.13.3 All Quality Control Inspectors and Subcontractors, if used, shall possess as a minimum a copy of that portion of the contract specifications which governs the work in which they are engaged. Failure to comply will result in cessation of work and removal of employees until such time that this requirement can be met.

1.2.2.13.4 Payment: Payment for completed and accepted work will be done on a monthly basis. The Contractor shall only invoice after the end of each month.
