Federal Acquisition Regulation (FAR) Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

Contracting Activity: National Guard Bureau Operational Contracting Office (NGB-AQ-C, 111 South George Mason Drive, Arlington, VA 22204

DESCRIPTION OF ACTION: The proposed action is to execute a two (2) month bridge extension for continuation of critical services for Multifunctional Device services. The National Capital Region National Guard Bureau Network Enterprise Center (NCR NGB NEC) intends to utilize Army National Guard Operations and Maintenance funding for a period of two months to allow additional time for the Government to properly plan and execute a full-and-open competition for the follow-on contract. The period of performance for this Firm-Fixed Price modification will be 01 December 2019 through 30 January 2020. Anticipated award date for this contract extension is NLT 25 November 2019. The awardee of this anticipated action will provide continuity of critical services while NGB finalizes the contract award for the follow-on effort. The total estimated price of this action for months is

DESCRIPTION OF SERVICES: The National Guard Bureau Multifunctional Device (MFD) Support contract provides printing, scanning, and copying services to TARC 1 & 2 and NGB offices at the Pentagon. This contract covers the use of the equipment, maintenance, parts, services and all consumable supplies as required by the Contracting Officer Representative (COR), excluding paper. Temple Army National Guard Readiness Center is located at 111 South George Mason Drive, Arlington, VA 22204 and the National Guard Bureau offices at the Pentagon are located at Chief National Guard Bureau (CNGB), 1636 Defense Pentagon, 2A726, Washington, DC 20301-1636.

Authority Cited: 10 U.S.C. 2304c(b)(2) as implemented by FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

REASON FOR AUTHORITY CITED: These services are currently being performed satisfactorily by Xerox Corporation under task order W9124A-14-D-0001-2Y01; the period of performance for this contract expires on 30 November 2019. NGB intends to extend the Period of Performance two months to prevent a break-in-services after the current contract expires and until a follow-on contract can be properly awarded. During the course of the competition for the follow-on contract, offerors stated that because of the large number of MFDs, they required extra time to successfully deliver the MFDs in a timely manner. The current MFDs are leased and the Government prints, scans, copies approximately 500,000 thousands of pages each month. To end this contract and remove the MFDs would completely shut down operations within National Guard Bureau and the Pentagon. Personal printing devices are not authorized and there would be no ability to print, scan, or make copies on a daily basis. The Government would not realize any savings through the competition of this effort due to the short amount of time required by the Government. Additionally, the Government finds that this would take a substantial amount of time to replace 160 devices for a two month period of performance.
