Question & Answer Part 2-W91249-16-R-0006

Concerning SCA WG.

1. Did the previous award have SCA positions or were they exempt?

It is up to each contractor to deploy the correct labor mix/category to satisfy this requirement.

Concerning the Section C.3(b)(2) of ADDENDUM (52.212-1) from the Solicitation, it stipulates the following:

C.3(b)(2) The Offeror shall provide the names of all personnel performing under this contract and proof of their certifications, security clearances and other qualifications required for their designated positions. The Offeror shall provide letters of intent (signed within 60 days of proposal submission) and resumes for all personnel performing under this contract. Resumes and Letters of Commitment are not included in the page count.

2. Would the government accept a company only supplying the resumes and letters of commitment of key personnel who will perform work under this contract; if not the requirement may unfairly favor the current incumbent as the entire contractor workforce currently works for the incumbent?

Resumes and letters of intent are required for Key Personnel only.

3. Would the government consider specifying exactly which key positions require resumes and letters of commitment; as this will reduce the possible threat to the current contractor workforce ability to respond to employment offers and possibly jeopardizing their standing with the incumbent company?

Key personnel are identified in the PWS at section 1.6.13. The Contractor has the right to submit additional Key Personnel within their staffing plan.

4. Other than key personnel, would the government consider retracting the requirement to provide resumes and letters of commitment from entire contractor workforce, until “10 days” after contract award, when the current contractor workforce is more willing to discuss employment prospects with a new employer, otherwise this requirement unfairly favors the current incumbent?

This requirement has been changed. Resumes and letter of intent for other than Key Personnel will be required no later than 10 days after award. See Sub factor 1B in 52.212-1 Addendum

5. With regards to submission instructions on page 62, offerors are instructed to provide an original and five (5) copies of their proposal (Section C.2a). Based on the instructions in Paragraph C on the following page (Section C.2c Table), offerors are told to provide an original and three (3) copies. Can the government please clarify the submission requirements?

1 original and 4 copies for a total of 5.

6. Regarding submission instructions (page 66, Subfactor 1B, Section 4) Organization Structure Change History – Is this ‘Roadmap’ required if there have not been any changes to the organization’s structure since corporate inception?

If no changes have been made to the organization’s structure then please document in the “roadmap” section.

7. Page 11 of the solicitation identifies the Base Year period as 7/2/16 to 3/1/17, which is approximately 8 months. However, on page 3 of the solicitation, the number of months depicted for CLIN 0001 (the base year) is 12. Does the Government wish the Base Year unit price in schedule B to be based on a quantity of 12 or a quantity of 9?

CLIN 0001 has been changed to reflect 8 months

8. Reference page 62, C. Proposal Preparation Instructions 2. Proposal Format (a) Offerors shall submit an original and the five (4) copies, in paragraph (c) below of their proposal.

Is it an original plus four or Original plus five copies? 5 copies total are required.

9. Reference page 68, Evaluation: a. Basis for Contract Award (1) This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable offer.

Is this Best Value or an LPTA? This is an LPTA

10. Reference page 65, Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform 51% of the proposed effort based on the total proposed price.

Could the government please clarify the 51%? The FAR limitations on subcontracting still says the Prime must perform 50% of the work. Any subcontractors, teaming partners, and/or joint venture partners must submit past performance information if they are going to be performing 50% or more of the work. Changed to 50% in addendum 52.212-1

11. Reference page 65SubFactor 1B: Management Approach & Staffing Approach: The Offeror shall provide letters of intent (signed within 60 days of proposal submission) and resumes for all personnel performing under this contract. Resumes and Letters of Commitment are not included in the page count.

Is the government asking for us to submit both Letters of Intent and Letters of Commitment, or are they considered the same?

Sub factor 1B has been changed from Letters of commitment to Letters of intent.

12. Reference FAR, para 22.1202 Policy. (a) When a service contract succeeds a contract for performance of the same or similar services, as defined at 29 CFR 9.2, at the same location, the successor contractor and its subcontractors are required to offer those service employees that are employed under the predecessor contract, and whose employment will be terminated as a result of the award of the successor contract, a right of first refusal of employment under the contract in positions for which they are qualified. Executive Order 13495 generally prohibits employment openings under the successor contract until such right of first refusal has been provided, when consistent with applicable law.

In accordance with the FAR para 2.1202, the successor contractor is required to offer incumbents the "first right of refusal". Why is the Government requiring Letters of Intent on this RTOP?

Letters of Intent for key personnel are required for evaluation purposes. Letters of Intent for non-key personnel are required 10 days after award. This is an RFP not an RTOP.

13. Reference, Page 65, Sub Factor 1B: Management Approach & Staffing Approach:(6) Experience As part of the resumes under "Experience", does the government want a brief summary or all past work history?

The Government is interested in all past work history as related to this requirement.

14. Reference Page 64, TAB D, 52.213-3 Alt I, Offeror Representations and Certifications - The offeror shall ensure this section is submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely.

Will the Government please confirm that only FAR 52.213-3 Alt I, Offeror Representations and Certifications, should be included in Tab D of Volume I, and that it is not necessary to complete and include FAR 52.219-1 Small Business Program Representations (Oct 2014) that is also included in the Solicitation?

Yes, both are required.

15. Reference Page 67, (c) Regarding labor costs, the Price Proposal Section shall be submitted using the Direct Labor Table format below, or other similar comprehensive formats which include the similar information as referenced below.

DIRECT LABOR TABLE

*Applicable Overhead or G&A factor(s) Will the Government please tie the asterisked comment "*Applicable Overhead or G&A factor(s)" to the paragraph or table to which it applies? As the Direct Labor Table, based on the descriptions for subparagraphs (i) through (vi), appear to only relate to direct, unburdened wage rates, we are somewhat confused by the inclusion of the asterisked comment immediately following section (c).

*Applicable Overhead or G&A factor(s) has been removed.

16. Reference page 67, (a) Price

(ii) Price narrative portion in MS Word or compatible format, with a Table of Contents. The price narrative shall provide the basis of estimate for all major elements of the price proposed. The price Narrative Section shall contain all the narrative explanations used in deriving calculated costs (including appropriate references to individual spreadsheets as they appertain). These narratives shall clearly explain the methodologies, calculations, exceptions and assumptions used in developing each cost element.

Will the Government please elaborate upon the requirement to, "…provide the basis of estimate for all major elements of the price proposed."? [emphasis added]

Any reference to the word costs has been changed to price. Please see (a) Price for details.

Based on the reference to "individual spreadsheets as they appertain," is the Government requesting a narrative and numerical (e.g., direct rates plus fringe, overhead, general & administrative, and profit rates/percentages) breakdown of the fully-burdened rates that form the basis of the pricing proposed in Schedule B?

The Government is requesting both a narrative and numerical breakdown. This is other than cost and price data.

18. Reference page 67-68, (d) Volume IV – Price (1)(c) DIRECT LABOR TABLE PWS Para (f.i) (i) PWS Para. If multiple PWS paragraphs are being performed by cross-utilized employees, identify such approach by cross-referencing the cost of such PWS paragraphs.

Among other information, the Direct Labor Table and subparagraph (i) for same requires the identification of Labor Category and Hours for each "PWS Para." Will the Government please confirm that each "PWS Para." corresponds to Specific Tasks 5.2, 5.2.1, 5.2.2, and 5.2.3 of Part 5 of the PWS and does not correspond to the individual bullet points under each of those specific tasks?

Yes, that is correct.

19. Does the Combined Synopsis/Solicitation under solicitation number W9124916R0006 contain requirements similar to a current contract? If possible, please provide the current contract number.

Or, is this a new requirement for the government?

The Current contract is W91249-13-P-0168.
