FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: Mission and Installation Contracting Command (MICC) Fort Bragg, North Carolina

2. Description of Action: The United States Army Civil Affairs and Psychological Operations Command (Airborne) (USACAPOC (A)), a subordinate command of the United States Army Reserve Command (USARC) currently has an urgent and compelling need for a bridge contract for a two (2) month base period and three (3) one-month options, if required. The anticipated bridge contract shall be firm fixed (FFP) price and sole sourced to NTT Data Services Federal Government LLC (NTT) located at 13880 Dulles Corner Lane 200, Herndon, VA 20171. The Government requires this contract to be awarded 31 December 2018, with services to commence on 1 January 2019, in order to avoid a break in IT Support Services (ITSS). Fiscal Year 2019 OMAR funds shall be used to fund this requirement.

An Acquisition Plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: This requirement is for continuation of Information Technology Support Services (ITSS) in support of USACAPOC (A)’s Civil Information Enterprise (CIE) networks (both NIPR and SIPR), as well as support existing garrison and deployable systems at multiple USACAPOC (A) facilities at various CONUS locations. As indicated above, services will commence 1 January 2019.

Total: $ 2,467,200.00

4. Authority Cited: 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, Unusual and Compelling Urgency.

5. Reason for Authority Cited: As described at FAR 6.302-2, when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

a. USACAPOC (A) is made up of more than 88 Army Reserve units across 32 states and Puerto Rico and provides the U.S. Army and Joint Forces commanders with 82 percent of the DOD Civil Affairs forces and 83 percent of the DOD’s Psychological & Informational Operations forces. The mission is to ensure both soldier and organizational readiness for those units, including pre-mobilization training. USACAPOC also supports airborne oversight for USARC as the only strategic civil affairs structure in DOD. Units must be trained and ready as they are integrated in current global operations including, but not limited to CENTCOM, EUCOM, AFRICOM, INDOPACOM and SOUTHCOM. Its unique mission in DOD means that it is heavily reliant on the continued sustainment of its IT infrastructure, communications network(s) and training on tactical communications that are necessary to ensure the readiness of its assigned forces.

b. USACAPOC (A)’s core IT services network, like many other IT networks in the Army, is currently undergoing a mandatory migration process directed by the newly established US Army Cyber Security Command (ARCYBER). Pursuant to this ARCYBER’s Operation Order (OPORD) 180819-41G5, it requires all Army IT services to migrate to “a standardized enterprise network with baseline services designed, built, configured, secured, operated, maintained, and sustained by NETCOM on behalf of ARCYBER.” The need for USACAPOC (A) to be synchronized with the intent of OPORD 180819-41G5 for the follow-on requirement, and migrate its core IT services to USARC’s IT enterprise, represented a change in requirements from its previously contracted services. This required a complete re-write of the Performance Work Statement (PWS) and associated documentation to clearly define and articulate to potential offerors which core IT services were required to be de-scoped in order to ensure a level playing field and fairness to all offerors – which was not completed until early December 2018.

c. On 12 Dec 2018, USACAPOC (A) Commander requested the MICC execute a bridge contract by stating that a break in contracted USACAPOC ITSS will have an immediate, unacceptable and mission critical impact on USACAPOC (A)’s current military operations. More specifically, the loss of services will preclude USACAPOC (A) from supporting upcoming activities that sustain readiness, systems integrations and modernization efforts. A break in IT services will negatively impact the following events:

1) NTC Rotation 19-03;

2) JRTC Rotation 19-04;

3) NTC Rotation 19-04 preparation;

4) CPX-F 19-10 preparation;

5) JRTC Rotation 19-04 preparation;

6) WFX 19-04 preparation; and

7) CPX-F 19-10.

Failure to provide IT services for the above events negatively affects warfighter training, as well as USARC and USACAPOC’s mission readiness. In particular, the loss of these IT services, will expose the USACAPOC IT Network to unacceptable Cyber Security Threats that result in the shut down and failure of mission critical USACAPOC IT Systems. If the server shuts down, USACAPOC (A) does not have assigned personnel accredited to access higher level network services such as server, domain and print services. This would require units to update their USR status on stand-alone SIPR computers and mail their reports on disks or travel to the USACAPOC

(A) Headquarters. Without qualified contractor support, USACAPOC (A) cannot implement DISA and NETCOM directed security updates. USACAPOC (A) would be unable to conduct vulnerability remediation such as security patches. Further, NETCOM could suspend USACAPOC (A)’s Authority to Operate the CIE Network, which would negatively affect CTC rotations, Home Station training, and systems sustainment (i.e. tactical radios and networks, CPX- F, WFX, and JWA).

d. Justification. The current Task Order expires on 31 December 2018 and the follow-on competitive contract is anticipated to be awarded by 28 February 2019. For the reasons stated above, giving consideration to the negative impact to the training schedule and network operations, the only way to prevent serious injury to the Government resulting from a gap in mission critical IT Support Services is to issue a two-month Firm Fixed Price bridge contract IAW FAR 6.302-2 to the incumbent, NTT Data Services Federal Government LLC. No other contractor has the qualified personnel and other resources to immediately perform the requirements of this bridge contract. This short term bridge contract will allow USACAPOC (A) to meet the unusual and compelling requirements of the work to be performed under the contract and permit the Agency to enter into another contract for the required services through the use of competitive procedures.

e. Alternatives.

1) Use of In-House Resources: This is not a viable alternative because USACAPOC (A) does not have the qualified personnel to fulfill this service requirement.

2) Cease Support Services: This is not a viable alternative as it would result in failure to provide IT Services, maintain updated computer services, knowledge management and video teleconferencing. Without qualified contractor support, USACAPOC (A) cannot implement DISA.NETCOM directed security updates. USACAPOC (A) would be unable to conduct vulnerability remediation such as security patches. Further, NETCOM could suspend USACAPOC (A)’s Authority to Operate the CIE Network, ultimately creating an unacceptable risk of mission failure.

3) Compete the Immediate Requirement: This is not a viable alternative because the follow-on competitive contract projected award date is 28 February 2019.

6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(2), this action will not be synopsized.

a. Effective Competition: FAR 6.302-2 requires as much competition as practicable under the circumstances, but given the short duration and possible disruption to on-going operations, only the current provider is capable.

b. Subcontracting Competition: A subcontracting plan will be negotiated with the prime contractor and incorporated into the resultant contract.

7. Actions to Increase Competition: It would be unreasonable to solicit competition for this two-month bridge, given the short period of performance for the required services. Although FAR 6.302-2 requires as much competition as practicable under the circumstances, given the short duration of the two-month bridge, it would be impossible for a new contractor to conduct a phase-in over the first 30 day period, and full performance for the final 30 days. All of this would be disruptive to the Government and the contractor for the very short duration of this contract.

Therefore, a sole source to the incumbent is the only practicable solution under the circumstances.

A request for task order proposal (RTOP) for the follow-on ITSS requirement, for a twelve-month base period with one (1) twelve-month option period was posted to AFWAY on 27 December 2018, under its NETCENTS II IT enterprise solution. The cutoff for contractor questions is close of business on 8 January 2019, with a closing date for receipt of proposals by close of business on 22 January 2019. Date of award is projected for 28 February 2019.

8. Market Research: Market Research was conducted for the re-procurement between March and October 2018 and is relevant to the sole source services identified within this request for justification and approval.

9. Interested Sources: No Sources Sought notice was posted for this requested action, and the Notice of Intent is exempt from synopsizing IAW FAR 5.202(a)(2).

10. Other Facts:

a. This requirement has been supported by a United States Special Operations Command (USSOCOM) IT enterprise solution via task order H92222-11-D-0038-0004, Cost Plus Fixed Fee (CPFF) competitively awarded to NTT for performance January 1, 2012 through December 31, 2016.

b. The CPFF Task Order was extended from January 1, 2017 through December 31, 2018 by USSOCOM, utilizing an Exception to Fair Opportunity from January 1, 2018 through December 31, 2018.
