EVALUATION CRITERIA
52.212-2 Evaluation—Commercial Items.
EVALUATION—COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other technical factors considered. The evaluation approach for all factors is as follows: The offer will be evaluated to determine the extent to which each requirement has been addressed (through strengths and/or weaknesses) in accordance with the terms and conditions listed in this solicitation. Offers will be assessed using the following technical/risk ratings: Outstanding (exceptional approach and understanding), Good (thorough approach and understanding), Acceptable (adequate approach and understanding), and Marginal (does not clearly or has not demonstrate an adequate approach or understanding), or Unacceptable (requirements not met).
The following factors shall be used to evaluate offers (Technical Factors are A through D and are in descending order of importance with Factor A being significantly more important than Factors B, C, and D):
Factor A – Management:
Provide information on how you plan to accomplish both routine and non-routine work. Non-routine services are those that will utilize Section C-5 of the performance work statement. At a minimum the following information needs to be addressed:
Describe how mowing and maintenance services will be performed, including the number of employees and equipment to be used. If a subcontractor is proposed, include the name of the company (individual) and the service they will be providing. Also, provide a plan of how non-routine services will be performed which includes technical capabilities of your employees.
Provide a detailed quality control program to ensure total compliance with the contract requirements and a high quality product for the Government. This program must demonstrate the following regarding inspections: when, or with what frequency inspections shall be performed; specify if scheduled or unscheduled; and who will perform these inspections. The program shall also provide a method of identifying deficiencies and possible corrective action to be taken and describe how you will ensure that employees will have full knowledge of assignments and have the appropriate technical expertise to perform the work.
Submit an organization chart that includes all personnel to be utilized for this contract. Include resumes for management, supervisory, inspection and technical personnel, including skill levels and experience. Identify the on-site Contractor Representative(s) responsible for management of this contract, including authorities and responsibilities. Also, provide similar information on subcontractor(s) (if, proposed) including company names and qualifications and/or resumes. Indicate if personnel are currently working for your company or have committed for performance on the proposed contract.
Describe the contractor’s safety policy and safety plan for this contract. Address job hazard analysis, employees’ responsibilities, safety training and public safety. Demonstrate knowledge of the Corps of Engineer’s Safety Program and Occupational Safety and Health Act (OSHA) requirements.
Discuss how communication between employees, subcontractor (if, any) and Government representatives will be conducted. Include any planned meetings, or pre-work discussions, how employees will communicate with the Contractor Representative (CR) or their supervisor and how communication will be conducted with Government representatives, specifically the Contracting Officer Representative (COR) (email, cell phone or in person).
Factor B – Experience:
Provide experience with relevant projects, current or completed within the past five years. At a minimum, the following information should be addressed:
Ability to provide quality management and ability to perform the required work in the specified time.
Provide detailed information on prior experience in this or similar work that includes a list of relevant projects within the past five years that best demonstrate your experience with this type of work.
Include dates, location, types of contracts, dollar values, a description of work and references.
Factor C – Equipment:
Provide a complete list of the equipment to be used on this contract, its availability, and proposed work specified in this contract. At a minimum, the following information should be addressed:
Number of pieces of each type of equipment, the name, manufacturer, model, age and condition of each piece of equipment.
Provide a statement describing your preventative maintenance and breakdown maintenance program.
Factor D - Past Performance:
Provide any information for the Government to ascertain the probability of successful performance the required efforts of this contract. At a minimum, the following information should be addressed:
Information on performance on recent and/or relevant performance within the past five years including names and phone numbers of references and type of work performed. Also, provide this information on any proposed subcontractors. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and their quote will not be evaluated either favorably or unfavorably on past performance. The Government will evaluate past performance based on information from the Contractor Performance Assessment Reporting System (CPARS), the Past Performance Information Retrieval System (PPIRS) and from data obtained from the offeror. In addition, the Government may use data in Government files or and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services. Past Performance will be evaluated for relevancy of similar service/support (i.e.
recreational mowing and maintenance services), complexity (i.e. mowing on dams with steep slope), dollar value (i.e. NTE amount of contract), contract type (i.e. IDIQ contract) and degree of subcontracting/teaming (very relevant, relevant, somewhat relevant, not relevant) and confidence (substantial, satisfactory, limited or no confidence). An unknown confidence rating will be given if the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.
Notwithstanding any other provisions of these specifications concerning the method of award, the best value trade-off process will be used in this acquisition with award made, as a whole, to the offeror whose quote conforms to the solicitation and has been evaluated as most advantageous to the Government with appropriate consideration given to the four technical evaluation factors: Management Plan, Experience, Equipment and Past Performance.
Offerors will be cautioned that the award may not necessarily be made to the lowest price offered.
All non-priced factors, when combined, are more important than price. Thus, price is not expected to be the controlling factor in the selection of the Contractor for this solicitation. However, as the evaluated merit of competing technical offers becomes more equal, total price and other price factors will become more important in the selection. Total price and other price factors could become the deciding factor for selection, depending upon whether the most acceptable technical offer is determined to be worth the cost differential, if any.
The evaluation approach for all technical factors is as follows: The offer will be evaluated to determine the extent to which each requirement has been addressed in accordance with the terms and conditions listed in this solicitation.
Factor E - Cost/ Price:
Cost/Price will be evaluated for the purpose of determining the reasonableness and completeness of prices offered. Total price and price factors may become the deciding factor for selection, depending upon whether the most acceptable technical proposal is determined to be worth the cost differential, if any.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer will be mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer. The notice shall be signed by both the government and the contractor and shall result in a binding contract. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

DESCRIPTION / SPECIFICATIONS
SECTION C-1 General
C-1.1. PROJECT INFORMATION. Burnsville Lake is located on the Little Kanawha River, a tributary of the Ohio River in Braxton County near Burnsville, West Virginia. The project purposes served are flood damage reduction, recreation, water quality control and fish and wildlife management. Approximate annual visitation to Corps operated recreation areas is 200,000 people. The Riffle Run End of the Project is accessible via Exit 79, Interstate 79. The Bulltown End of the Project is accessible via Exit 67, Interstate 79 if traveling north or via Exit 91, Interstate 79 if traveling south.
C-1.2. PERFORMANCE WORK STATEMENT. The Contractor shall furnish all necessary management, personnel, materials, supplies, tools, equipment, fuel, and vehicles, except as otherwise provided herein, required to perform mowing, facility repair, maintenance and other non-routine work at the Burnsville Lake project, as specified and in strict accordance with all Terms, Conditions, General, Specific and Technical Provisions, Drawings, Attachments, Exhibits, etc., contained herein are incorporated by reference.
Award of a contract does not guarantee that the Government will order all of the types of services listed under the contract from the Contractor. The Government reserves the right to perform any portion of the services listed.
The quantities listed in the Price Breakout Schedule are approximate and are provided as information only to assist in preparation of quotes. They are not guaranteed and the actual quantities may be more or less than shown.
Variation in these estimated quantities shall not be justification for modification of the contract or request for additional payment.
Contractor's work and responsibility shall include, but shall not be limited to, all planning, programming, administration and management necessary to assure that all services provided are conducted in accordance with the contract and all applicable laws, regulations, codes, or directives. Contractor shall ensure that all work meets or exceeds critical reliability rates or tolerances specified or included in referenced documents.
Contractor shall perform all related Contractor administrative services necessary to perform the work such as supply, procurement, quality control, Contractor financial control, and maintenance of accurate and complete records and files.
It is emphasized that the work described in this contract is an important part of the USACE mission. Much of the work described will be performed in public recreation areas. USACE is committed to "Customer Care" and providing quality professional service. Failure of a Contractor to perform required work, to perform in a timely manner, or to perform quality work could risk public health and safety and result in the following problems:
a. Falls, snakebites, and reduced use and enjoyment of recreation facilities from lack of mowing.
b. Falls, cuts, infections, and accumulated animal feces from beaches not being cleaned and inspected.
c. Unsafe boating and limiting of lake surface recreation from a lack of drift removal.
d. Closed recreation areas from inoperable water, sewage and electrical systems.
e. Closed parking areas and road closures from lack of maintenance and repair.
f. Destroyed forests and natural areas from lack of emergency response capability.
g. Closed campgrounds, beaches and parks from lack of operators.
h. Significant dollar losses of recreational benefits.
i. Increased administrative and labor costs required for government performance of contracted work.
Therefore, it is the intent of the Government to ensure the required services are performed correctly, safely, timely and reliably for a fair and reasonable price. Because of the important nature of the work the Government cannot "trade off" contractor non- performance for increased Government liability. Further, due to lack of Government personnel, the Government cannot "trade off" a Contractor's lack of Quality Control for increased Government Quality Assurance.
Work included in this contract generally involves all work associated with operation and maintenance of recreation areas at the project except for certain specialized work, or repair or maintenance to major or complex components that the Government determines to require the use of a Contractor or professionals with specialized equipment, or training. In special instances the Contractor may be issued a task order under this contract for other Huntington District projects within the State of West Virginia and within 50 linear miles of the project boundary. Examples of these special instances may include but are not limited to damaging storms, wildfires, floods, blizzards, or other time-sensitive maintenance needs. Task orders issued in these circumstances will be negotiated on an individual basis using contract line items from the price breakout schedule.
Work which does not fall under the scope of this contract includes:
a. Repairs to major components of heating or air conditioning systems.
b. Major maintenance or repair to sewage and water treatment systems.
c. Repair to major or critical electrical components.
d. Maintenance or repair to special architectural features.
e. Work involving Government functions pertaining to flow regulation, dam safety, maintenance of permanent operating equipment, and maintenance and repair work (except for vegetative control and cleaning) at dams, intake structures, spillways, embankments, outlet works, levees, pump stations, and other similar structures.
f. Work which requires formal preparation of Government plans and specifications.
g. Work determined by the Government to be more efficiently handled by a specialty contractor such as fencing, carpet shampooing, etc.
h. Work on articles covered by separate warranty.
i. Service and repairs to vehicles and equipment.
C-1.3. TASK ORDERS. All work under this contract will be ordered by issuance of individual Task Orders (DD Form 1449). No work shall be performed under this contract before an individual Task Order has been issued by the Contracting Officer (KO). USACE has four basic ways to order work using this contract: Fixed Price Task Orders, Negotiated Task Orders, Estimated Task Orders, and Emergency Task Orders. The type of Task Order used will be at the discretion of the Contracting Officer (KO). The Task Order will list those items from the price breakout schedule that are to be performed, or used to perform the work (with the exception of Negotiated Task Orders).
Under normal conditions Task Orders require response within 24-hours after receipt, excluding weekends and holidays. All Task Orders must be completed by the date shown on the Task Order Form. When the Contractor is notified of emergency work required under these specifications, the Contractor shall respond and begin work within 2 hours after receipt of notification.
C-1.4. NEGOTIATION. Task Orders that are to be performed on an hourly basis (e.g., using items from C-5 of the Price Breakout Schedule) will be agreed upon by negotiation between the Contractor and the KO. This procedure is typically initiated by the Government, unless otherwise specified in the Request for Proposal letter, the Contractor shall return the completed proposal within 48 hours of receipt of the request. If the Contractor’s proposal is acceptable, the KO will issue a Task Order. If the Contractor’s proposal is considered unacceptable, the KO and the contractor will attempt to reach a fair and reasonable price through negotiation. If an agreement cannot be reached, the Government reserves the right to obtain services in question by whatever means deemed to be in the best interest of the Government, including use of its own workforce.
The purpose of negotiation is to establish a fair and reasonable price for the job under consideration. The KO and the Contractor will negotiate the CLINs and number of hours required. Once negotiated, the Contractor must perform the job using the line items agreed upon during negotiations. Task Orders will be issued for the negotiated price for services listed in Section C-5.
C-1.5. WORKING HOURS.
a. Normal Working Hours. Normal working hours, except as otherwise specified herein, shall be Monday through Friday, 7:30 a.m. to 4:00 p.m. Eastern or as specified on the Task Order. Work inside Government buildings or other secured areas shall be performed during the above referenced work hours.
Work that interferes with other ongoing functions at the project shall be scheduled around normal working hours, as specified by the Contracting Officer Representative (COR). Refer to individual sections of this specification for specific schedules of work.
b. Holiday Work. The ten Federal holidays observed are:
New Year's Day (January 1st) Martin Luther King Day (3rd Monday in January) President's Day (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th)
When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work shall be scheduled around the above listed Federal holidays except as specified herein or as approved by the
KO.
Work may be required on holiday periods during heavy visitation, emergencies, or for other reasons as determined by the KO. Additional personnel may be required to handle the additional work load during holiday periods because of heavy visitation. The COR will notify the Contractor of actual work requirements.
