3. BID EVALUATION AND AWARD
The Government will evaluate bids in response to this solicitation based upon the Total Evaluated Price without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors specified elsewhere in the solicitation. The Government may reject any or all bids and/or waive informalities or minor irregularities in bids received.
The Government will evaluate offers for award purposes by adding the total price for all optional items to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the optional items. Optional items, if exercised, will be awarded in accordance with clause 52.217-7.
The Government may –
Reject any or all bids;
Accept other than the lowest bid (refer to Responsibility Determination below); and Waive informalities or minor irregularities in bids received.
4. RESPONSIBILITY DETERMINATION WITH DEFINITIVE RESPONSIBILITY
CRITERIA
Definitive Responsibility Criteria (DRC) are specific and objective standards established to inform the Contracting Officer’s responsibility determination in accordance with FAR Subpart
9.1. The apparent low bidder must submit and the Contracting must make an affirmative determination of the apparent low bidder’s ability to perform the contract based on the general standards for responsibility defined in the FAR. These DRC specifically address whether the apparent low bidder has a satisfactory performance record performing the functions critical to successful performance of this contract; have the necessary technical capability or ability to attain them; and are otherwise qualified and eligible to perform the contract. The inability of a contractor otherwise eligible for award to demonstrate minimally acceptable experience as measured against the DRC will result in the Contracting Officer determining the contractor is not responsible and ineligible for contract award.
Document Submission Requirements of the Apparent Low Bidder
Within twenty-four hours of the time set for bid opening in the solicitation, the apparent low bidder must submit documentation to the Contracting Officer that substantiates previous contract experience meeting or exceeding the minimum requirements defined in the DRC below.
The apparent low bidder must substantiate its previous experience by submitting information relating to previous contracts performed. At a minimum, the following information must be submitted:
Contract number (or unique identifier) and name of organization awarding each contract
Contact information for the Contracting Officer or equivalent official Period of performance of the contract, i.e., the dates when performance began and was completed Annual dollar value of the contract, or pro rata equivalent A narrative describing the work performed under the contract clearly addressing each element of the DRC described below
In the event the prime contractor intends to have a subcontractor perform a key element of the contract, the apparent low bidder must submit the information required above for each contract or subcontract responsive to the DRC that was performed by an intended “key subcontractor.” In addition, the narrative must explain exactly what aspects this contract would be performed by the key subcontractor if the apparently low bidder is awarded the contract and must describe the role the subcontractor performed on the submitted contract. A “key element” of the contract involves the performance of any aspect critical to successful performance, including those aspects detailed in the DRC below.
In addition, the apparent low bidder must submit a letter of commitment by each key subcontractor. The letter of commitment must be signed by the key subcontractor and presented on its company letterhead. It must clearly state the subcontractor’s unequivocal intent to perform that aspect of the project in the event the prime contractor is awarded the contract.
The documentation submitted shall not exceed one (1) page per previous contract performed by the prime contractor or applicable key subcontractor to substantiate the minimum experience required in the DRC. The documentation must demonstrate successful completion of six (6) months project experience for each of the DRC listed below.
Definitive Responsibility Criteria (DRC):
The Government will evaluate the submitted documentation to determine whether the bidder meets the minimum requirements of the Definitive Responsibility Criteria. The bidder may use one or more projects, per defined work criteria, to demonstrate past experience. Each defined work criteria must be addressed. The DRC are defined as follows:
Upland Site Rehabilitation and Beach Nourishment Work. The apparent low bidder shall provide documented contract experience comparable in size and scope described in the drawings and specification sections contained in Division 35 – Waterway and Marine Construction, included as part of the solicitation.
Dredging. The apparent low bidder shall provide documented contract experience comparable in size and scope described in the drawings and specification sections contained in Division 35 – Waterway and Marine Construction, included as part of this solicitation.
The ability to pump sandy material in excess of 10,000 feet with appropriate booster pump use. The apparent low bidder shall provide documented contract experience comparable in size and scope described in the drawings and specifications sections contained in Division 35 – Waterway and Marine Construction, included as part of the solicitation.
The apparent low bidder may use previous contracts performed up to five (5) years prior to the solicitation date, provided that the period of performance began within that five year period.
In the event that the contractor submits a contract for which it received an interim or final unsatisfactory evaluation rating, was issued cure notice or show cause, or was defaulted for termination, the apparent low bidder must explain the circumstances associated with this.
In the event the apparent low bidder intends to utilize a key subcontractor in the performance of the contract, the experience of the subcontractor must meet each element of the above described DRC relevant to that aspect of the contract that will be performed by the key subcontractor. If an intended subcontractor served as the subcontractor on a previous submitted contract, the narrative must explain why the subcontractor’s role was critical to performance of the contract.
5. AWARD TO RESPONSIBLE OFFEROR
To be determined responsible, a bidder must –
a) Have adequate financial resources to perform the contract, or the ability to obtain them;
b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
c) Have a satisfactory performance record. A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history;
d) Have a satisfactory record of integrity and business ethics;
e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors);
f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations
In accordance with FAR Part 9.1, responsibility will be determined, prior to award, by the Contracting Officer through the performance of a pre-award survey or utilizing information from a previous pre-award survey and/or any performance data available. The apparent low bidder may be required to show that he has the necessary capital, experience, and owns or can procure the necessary plant or other resources to commence the work at the time prescribed in the specifications and thereafter to prosecute and complete the work safely and satisfactorily within the time specified. The below information will be requested of the apparent low offeror. This information is not required to be responsive to the invitation for bid.
a) Banking Information to include Branch/Location, Point of Contact and
Telephone Number. Please insure the Bank is prepared to provide necessary information regarding average balances in your operating accounts, lines of credit and credit history.
b) Current commitments and expected dates of completion
6. CONSTRUCTION TIME
For the base contract bid items, begin performance within 10 calendar days and complete all work within 120 calendar days of receipt of Notice to Proceed (NTP). It is the Government’s intent that the successful bidder will dredge to the optional depth, if so exercised by the Government, concurrent with dredging to the depth required in the base scope of work. Thus, optional items will be awarded with the base award. If optional items are exercised, additional performance time will be added to the contract based on one additional day per 1,500 cubic yards of dredged material added.
Should the total quantity of material to be paid for and actually placed under this contract exceed the estimated quantity from the Bidding Schedule, to include optional items, additional time will be allowed at the rate of one day for each 1,500 cubic yards in excess of the estimated base contract quantity.
7. EVIDENCE OF AUTHORITY TO SIGN OFFERS
Evidence of the authority of individuals signing offers to submit firm offers on behalf of the offeror is required except where the offer is signed, and shows that it is so signed, by: the President, Vice-President, or Secretary of an incorporated offeror; a partner in the case of a partnership; or the owner in the case of a sole proprietorship. Failure to submit with the offer satisfactory evidence of the authority of all other persons may be cause for rejection of the offer as invalid or nonresponsive.
8. PREAWARD SAFETY CONFERENCE
a. Where an apparent low bidder, in performance of contracts during the previous three-year period, incurred one or more accidents, or where, in the opinion of the Contracting Officer, there is any question regarding this compliance with any safety or accident prevention requirement, such bidder, on request of the Contracting Officer prior to any award under this solicitation, shall attend a conference with representatives of the Contracting Officer to discuss any such accidents or non-compliance, the reason for their occurrence, and measures which will be taken to preclude any recurrence thereof.
b. Information elicited at this conference will be used by the Contracting Officer, in conjunction with other information obtained in a preaward survey, in determining the bidder's responsibility.
c. The items discussed, the preventive measures considered, and any conclusions reached in this conference shall be recorded in minutes of the meeting, which shall be authenticated by the signatures of representatives of the bidder and the Contracting Officer, and any procedures noted therein as agreed upon shall become an obligation of the bidder, along with all other safety and accident prevention requirements of the contract, if award is made to him.
9. INCURRING COSTS
The Government is not liable for any costs incurred by the offeror submitting an offer in response to this solicitation.
10. AGENTS
Offers signed by an Agent must be made in the name of the Principal and must be accompanied by evidence of said Agent’s authority to act on behalf of its Principal.
11. UNBALANCED BIDS
Any offer which is materially unbalanced as to prices for the Base Items and the Optional Items may be rejected as non-responsive or otherwise not considered for award. An unbalanced offer is one which is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
12. UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT OR OTHER
PERSONNEL
The contractor shall not accept instructions issued by any person, employed by the U.S.
Government or otherwise, other than the Contracting Officer or the Authorized Representative of the Contracting Officer acting within the limits of his/her authority as defined in the Designation of Authority letter. A copy of the Designation of Authority letter will be furnished to the contractor at time of contract award.

Contractor's performance will be evaluated using the respective contractor performance evaluation report entry system located on the website http://cpars.gov/. Prior to commencement of work the contractor is required to provide the Government with the name, phone number, and email address of the " Contractor's Representative" that will be responsible for receipt and review of draft performance evaluations prepared by the Government in the appropriate system.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
