SUMMARY OF WORK
1.1 WORK COVERED BY CONTRACT DOCUMENTS
1.1.1 Project Description
The project consists of dredging portions of the Langley/Back River Federal Navigation Channel starting in Hampton, Virginia and ending in Poquoson, Virginia. The channel is approximately 193,000 feet long with an average width of 100 feet. The work extends from the Langley Air Force Base Fuel Pier at the west end of the channel to the channel’s entrance into the Chesapeake Bay at the east end. This contract includes maintenance dredging of almost the full length of the channel and the Fuel Pier’s turning basin and new dredging along the turning basin’s south side. The last 4,552 feet of the channel between 147+00 and 192+52 shall not be dredged under this contract. All dredging shall be to the maintained depth of 12 feet MLLW plus 2 feet paid over-depth dredging will be allowed.
This work shall be performed by a mechanical dredge with delivery by either ocean barge or scow to a specified location within the Norfolk Ocean Disposal site (NODS) in the Atlantic Ocean that is approximately 35 miles south-east of the bay end of the channel. The movement of the barges in the Bay to and from NODS is considered as travel in an ocean environment. All dredged material must be delivered to NODS on or by August 26, 2019.
1.1.2 Location
The work starts in Hampton, Virginia and includes almost the entire length of the Langley/Back River Channel Federal Project from the Langley Air Force Base Fuel Pier at the west end to the channel’s entrance into Chesapeake Bay at the east end near the town of Poquoson, Virginia. The last 4,552 feet of the channel between 147+00 and 192+52 shall not be dredged under this contract.
1.1.3 Additional Requirements
1.1.3.a Federal Aviation Authority Clearance Permit
Langley/Back River Channel and the Fuel Pier are within the restricted flight path associated with the Langley Air Force Base Airport which requires the procurement of a Federal Aviation Authority (FAA) Clearance Permit based on the height of the contractor’s dredging equipment. The Government has been coordinating initial permit documentation and the Contractor is responsible for finalizing this permit documentation and issuance before mobilization of equipment to the site and dredging can begin.
1.1.3.b Surveying of the Disposal Site
The Contractor is responsible for surveys of the designated disposal zone within the Norfolk Ocean Disposal Site (NODS) before placement begins and after placement has been completed with submittals of the surveys to the Government as per specifications.
SECTION 01 11 00 Page 3
1.1.3.c NODS Disposal End Date and Barges
All dredging with associated delivery and disposal at the NODS disposal site must be completed on or before August 26, 2019. Delivery to NODS requires the use of ocean-going barges and/or scows which have been certified and licensed by the U.S. Coast Guard.
1.1.3.d Protection of Oyster Grounds
The Contractor shall be aware of both public and private oyster grounds in the vicinity of the work area. Contract drawings indicate the locations of these leases. The Contractor shall not disturb these oyster grounds, particularly the grounds located adjacent to the channel and pier area, in accordance with the guidance provided as part of these specifications.
Disturbance shall constitute both physical disturbance AND incidental disturbance via sediment plumes, prop wash, etc.
In particular, the Oyster Rock Lease on the south side of the Langley Fuel Pier Basin, as shown in the drawings, shall not be disturbed. No construction or dredging activities are authorized within this lease zone.
The lease’s northern boundary is along the same boundary line as the Pier Basin’s southern border therefore a 25 foot offset from the north edge of the lease is designated as a “NO” construction or dredging zone.
1.1.3.e Acceptance Areas
The Contractor may choose between defining all dredging work areas as belonging to one acceptance area with only one Before Dredging Government survey and one After Dredging Government survey; or they may choose to divide the dredging work area into a maximum of two(2) channel acceptance areas and one(1) Fuel Pier Turning Basin acceptance area with each area surveyed as a separate work area as the work progresses. See SECTION 35 20
23 DREDGING.
1.1.4 Time Extensions for Additional Quantity
Should the total quantity of material to be paid for and actually delivered under this contract exceed the total quantity from the Bidding Schedule, additional time will be allowed at the rate of one day for each 1,000 cubic yards in excess of the estimated quantity. This is limited by the requirement that ALL material must be dredged, transported and placed at NODS on or before August 26, 2019.
1.1.5 Time Extension for Unusually Severe Weather
This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default:(Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
c.
SECTION 01 11 00 Page 4
d. All awards or extensions for time shall be at the sole discretion of the Contraction Officer or their representative.
1.1.5.a Limitations to Time Extensions
While time extensions may be granted to the overall duration of the contract, this does not change the requirement that ALL material must be dredged, transported and placed at NODS on or before August 26, 2019.
1.1.5.b Schedule
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays as part of all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON A FIVE (5) DAY
WORK WEEK:
JAN FEB MAR APR MAY JUNE JUL AUG SEP OCT NOV DEC
10 9 9 6 6 7 8 7 5 7 9 9
1.1.5.c Adverse Weather Records
Upon acknowledgement of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.
1.1.5.d Impacted Days
The number of actual adverse weather days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month); shall be calculated chronologically from the first to the last day in each month; and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in the schedule of monthly anticipated adverse weather delays, as listed above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract Clauses entitled "Default (Fixed Price Construction)" of Section 00 72 00 Contract Clauses.

MEASUREMENT AND PAYMENT
This section describes how Line Items will be measured and paid for when making progress payments for this Langley/Back River Maintenance Dredging contract. Work to be measured is described in the applicable specification sections listed for each Line Item.
Measurement procedures for payment, required quantity surveys and/or procurement documentation and payment restrictions are also described in applicable specification sections. Allocate costs for work not specifically mentioned to the Line Item most closely associated with the work involved.
Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items. The lump sum prices and unit payments made for each item listed shall constitute full compensation for furnishing all plant, labor, materials and equipment; and performing any associated Contractor quality controls, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
The terms "Contract Line Item Number (CLIN)" and "Line Item" are interchangeable herein (e.g. CLIN 0001 is the same as Line Item 0001).
The term "CLIN" is a contracting term used in the Quality Control System (QCS) payment system.

Payment items for the work of this contract for which contract lump sum payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular lump sum or unit price payment item, shall be included in the listed lump sum item most closely associated with the work involved. The lump sum price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
SECTION 01 22 00 Page 3
1.3.1 Payment Item No. 0001 Mobilization and Demobilization. Payment is by
Lump Sum.
All costs connected with the mobilization and demobilization of all of the Contractor's dredging plant and equipment as defined below will be paid for at the contract lump sum price for this item. Sixty percent of the lump sum price will be paid to the Contractor upon completion of his mobilization at the work site. The remaining forty percent will be paid to the Contractor upon completion of demobilization. In the event the Contracting Officer considers that the amount in this item, sixty percent which represents mobilization and forty percent which represents demobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer may require the Contractor to produce cost data to justify this portion of the bid. Failure to justify such price to the satisfaction of the Contracting Officer will result in payment of actual mobilization costs, as determined by the Contracting Officer, at the completion of mobilization, and actual demobilization costs, as determined by the Contracting Officer, at the completion of demobilization. The determination of the Contracting Officer is not subject to appeal.
1.3.1.1 Mobilization
Mobilization shall include all costs for operations accomplished prior to commencement of actual dredging operations. This shall include as a minimum the following:
a. Transfer of dredge and attendant plant, barges and scows, and other like equipment and machinery.
b. All costs for any other associated work that is necessary in advance of the actual dredging operations.
c. All costs associated with preparations required for delivery and disposal of material at NODS, the ocean disposal site.
1.3.1.2 Demobilization
Demobilization shall include general preparation for transfer of plant to its home base and completion of all required documentation.
1.4 UNIT PRICE PAYMENT ITEMS
Payment items for the work of this contract on which the contract unit price payments will be made are listed in the BIDDING SCHEDULE and described below. The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.
1.4.1 Payment Item No. 0002, "Maintenance Dredging of Langley/Back River Channel and Fuel Pier Basin". Payment is by the cubic yard.
Payment to be made for all costs associated with dredging shall include the cost of removal, transportation and disposal of dredged material at the Norfolk Ocean Disposal Site (NODS) placement area, exclusive of the mobilization and demobilization as defined above. The total amount of material removed and to be paid for under this payment item will be measured by the cubic yard in place by computing the volume between the bottom surface shown by soundings of the last surveys made before dredging, SECTION 01 22 00 Page 4 and the bottom surface shown by the soundings of surveys made as soon as practicable after the work has been completed. The volume for measurement and payment shall include the material within the limits of overdepth and side slopes described in paragraph "Required Dredging Prism, Overdepth, and Side Slopes" of SECTION 35 20 23: DREDGING, less any deductions that may be required for misplaced material described in subparagraph "Misplaced Material", below. The drawings are believed to accurately represent conditions at the time of the surveys indicated. New soundings will be taken immediately before dredging as specified in paragraph "Before Dredging Surveys" of SECTION 35 20 23: DREDGING. The Contractor's unit price for dredging, based on the above method of computation of the quantity for payment, shall include his evaluation of shoaling, other natural changes in the waterway, or changes caused by the Contractor's operations that might occur during the period between the surveys before dredging and the surveys for acceptance of the work. Computations for payment purposes will be made by the Government for the scheduled dredging using, as defined in the USACE Hydrographic Survey Manual EM 1110-2-1003, the Average End Area (AEA) method, Triangulated Irregular Network (TIN) method, or a combination of these methods at the discretion of the Government, utilizing electronic data processing software and machines for the calculations. Determination of quantities removed and the deductions made to determine quantities in place to be paid for in the areas specified, after having once been made, will not be reopened except on evidence of collusion, fraud, or obvious error.
1.4.2 Optional Payment Item No. 0003, "New Dredging of the South Side of Langley Fuel Pier Basin". Payment is by the cubic yard.
OPTIONAL ---
Payment to be made for all costs associated with dredging shall include the cost of removal, transportation and disposal of dredged material at the Norfolk Ocean Disposal Site (NODS) placement area, exclusive of the mobilization and demobilization as defined above. The total amount of material removed and to be paid for under this payment item will be measured by the cubic yard in place by computing the volume between the bottom surface shown by soundings of the last surveys made before dredging, and the bottom surface shown by the soundings of surveys made as soon as practicable after the work has been completed.
SECTION 01 22 00 Page 5
1.4.2.1 Dredging Option Notes
The basis of award shall be the sum of all CLINs inclusive of mobilization/demobilization; the maintenance dredging of the channel and the Fuel Pier existing dredged area; and the optional new dredging area on the south side of the Fuel basin area. The Government may exercise the option at the time of contract award. The successful bidder shall be prepared to complete the base work and the option within the stated period of performance. If the bid option is exercised, it will be awarded at the same time as the base items to provide an increasingly wider Fuel Pier basin.
1.5 MISPLACED MATERIAL
Any material that is deposited elsewhere than in places designated or approved by the Contracting Officer will not be paid for, and the Contractor may be required to remove such misplaced material and deposit it where directed by the Contracting Officer at the Contractor's expense.
1.6 EXCESSIVE DREDGING
Material taken from outside the specific areas to be dredged or beyond the limits as extended in paragraph "Required Dredging Prism, Overdepth, and Side Slopes" will be considered as excessive overdepth dredging, or excessive side slope dredging, for which payment will not be made. Nothing in these specifications shall be construed to prevent payment for the removal of shoals performed in accordance with the applicable provisions of Paragraphs SHOALING and FINAL EXAMINATION AND ACCEPTANCE of SECTION 35 20
23: DREDGING.
1.7 MONTHLY PARTIAL PAYMENTS
Monthly partial payments will be based on estimated quantities determined by the Contracting Officer.

The Contractor’s Quality Control (CQC) representative shall be responsible for the preparation and certification as complete all required project Progress Schedule submittals and reports. Each submittal shall be complete and in sufficient detail to allow ready determination of compliance with contract requirements.
Not Used
3.1 GENERAL REQUIREMENTS
Prepare for approval a Project Schedule, as specified herein, pursuant to the Contract Clause, SCHEDULE FOR CONSTRUCTION CONTRACTS. Show in the schedule the sequence in which the Contractor proposes to perform the work and dates on which the Contractor contemplates starting and completing all schedule activities. The scheduling of the entire project, including the
SECTION 01 32 01 Page 3 design (if any) and construction sequences, is required. The scheduling of construction is the responsibility of the Contractor. Contractor management personnel shall actively participate in its development.
Subcontractors and suppliers working on the project shall also contribute in developing and maintaining an accurate Project Schedule. Provide a schedule that is a forward planning as well as a project monitoring tool.
3.1.1 Approved Project Schedule
Use the approved Project Schedule to measure the progress of the work and to aid in evaluating time extensions. Make the schedule cost loaded and activity coded. The schedule will provide the basis for all progress payments. If the Contractor fails to submit any schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
3.1.2 Schedule Status Reports
Provide an updated Schedule Status Report on at least a monthly basis. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, take steps necessary to improve its progress including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction/dredging plant, and to submit for approval any supplementary schedule or schedules as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.
3.1.3 Default Terms
Failure of the Contractor to comply with the requirements of the Contracting Officer shall be grounds for a determination, by the Contracting Officer, that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in the contract. Upon making this determination, the Contracting Officer may terminate the Contractor's right to proceed with the work, or any separable part of it, in accordance with the default terms of the contract.
3.2 BASIS FOR PAYMENT AND COST LOADING
Use the schedule as the basis for determining contract earnings during each update period and therefore the amount of each progress payment. Lack of an approved schedule update, or qualified scheduling personnel, may result in the inability of the Contracting Officer to evaluate contract earned value for the purposes of payment. Failure of the Contractor to provide all required information will result in the disapproval of subsequent schedule updates. In the event schedule revisions are directed by the Contracting Officer and those revisions have not been included in subsequent revisions or updates, the Contracting Officer may hold retainage up to the maximum allowed by contract, each payment period, until such revisions to the Project Schedule have been made. Activity cost loading shall be reasonable, as determined by the Contracting Officer.
3.3 PROJECT SCHEDULE DETAILED REQUIREMENTS
The Contractor shall submit his Progress Schedule to the Contracting Officer for approval at the Pre-Construction Conference specified in SECTION 01 30 00, ADMINISTRATIVE REQUIREMENTS. The Progress Schedule shall be submitted and certified as complete by the Contractor's Quality Control Representative in the form of a chart graphically indicating the sequence
SECTION 01 32 01 Page 4 proposed to accomplish each work feature or operation. The chart shall be prepared to show the starting and completion dates of all work features on a linear horizontal time scale beginning with date of Notice to Proceed, arrival date of Contractor's plant to the job site, all activities scheduled prior to dredging, dredging start and completion dates for each individual ACCEPTANCE section (if applicable) and/or the project as a WHOLE, calendar days to completion of all work, and contract completion date. Each activity in the construction shall be represented by an arrow and shall have a beginning and ending node (event). The entire project shall have only one beginning node and one ending node. The arrangement of arrows shall be such that they flow from the left to right. Each arrow representing an activity shall be annotated to show the activity description, duration and cost. The Contractor shall indicate on the chart the important work activities that are critical to the timely overall completion of the project. Key dates for important features or portions of work features are milestone dates and shall be so indicated on the chart.
3.3.1 PROGRESS SCHEDULE FORMAT
Contractor may prepare the Progress Schedule in the form of a Bar Chart (ex: a Gantt Chart) OR may use the Critical Path Method (CPM) network calculation to generate the Project Schedule by preparing the schedule using the Precedence Diagram Method (PDM). Contractor may use a computer software system or a manual method to produce the Progress Schedule. If computer scheduling software is used, it should meet all applicable requirements for the software. Failure of the Contractor to meet/include all the specified detail requirements may result in the disapproval of the schedule.
3.3.2 Level of Detail Required
Develop the Project Schedule to an appropriate level of detail. Failure to develop the Project Schedule to an appropriate level of detail, as determined by the Contracting Officer, will result in its disapproval. The Contracting Officer will consider, but is not limited to, the following characteristics and requirements to determine appropriate level of detail:
3.3.2.1 Activity Durations
Reasonable activity durations are those that allow the progress of ongoing activities to be accurately determined between update periods.
3.3.2.2 Procurement Activities
The schedule must include activities associated with the submittal, approval, procurement, fabrication and delivery of long lead materials, equipment, fabricated assemblies and supplies as applicable. Long lead procurement activities are those with an anticipated procurement sequence of over 90 calendar days. A typical procurement sequence includes the string of activities: submit, approve, procure, fabricate, and deliver.
3.3.2.3 Critical Activities
The following activities shall be listed as separate line activities on the Contractor's Project Schedule. This list represents a partial lists and is not considered complete:
a. Submission and approval of Accident Prevention Plan.
b. Submission and approval of all environmental submittals.
c. Submission and approval of dredge plan and auxiliary equipment.
d. Submission and approval of pre-work plan and schedule.
e. Submission and approval of dive plan (if applicable).
SECTION 01 32 01 Page 5
f. Submission and approval of Quality Control Plan.
g. Coast Guard Mariners Notification USACE notification.
h. Submittal of current marine plant certification and recent plant inspection.
i. Submission of Final Environmental Incidence Report.
3.3.2.4 Government Activities
Show Government and other agency activities that could impact progress.
These activities include, but are not limited to:
a. Government surveys for payment
b. Required Contractor submittals for Government approval
c. Inspections required by the contract.
3.3.2.5 Definable Features of Work Coding (FOW1, FOW2, FOW3)
Assign a Definable Feature of Work Code to appropriate activities based on the definable feature of work to which the activity belongs. Definable Feature of Work is defined in Specification SECTION 01 45 00 QUALITY CONTROL. An activity shall not have more than one Definable Feature of Work Code. Not all activities are required to be Definable Feature of Work Coded.
3.3.3 Scheduled Project Completion and Activity Calendars
The schedule interval shall extend from NTP date to the required contract completion date. The contract completion activity (End Project) shall finish based on the required contract duration in the accepted contract proposal, as adjusted for any approved contract time extensions. The first scheduled work period shall be the day after NTP is received by the Contractor.
3.3.3.1 Project Start Date
The schedule shall start no earlier than the date on which the NTP was acknowledged. Include as the first activity in the project schedule an activity called "Start Project"(or NTP). The "Start Project" activity shall have an "ES" constraint date equal to the date that the NTP was acknowledged, and a zero day duration.
3.3.3.2 Schedule Constraints and Open Ended Logic
Constrain completion of the last activity in the schedule by the contract completion date. Schedule calculations shall result in a negative float when the calculated early finish date of the last activity is later than the contract completion date. Include as the last activity in the project schedule an activity called "End Project". The "End Project" activity shall have an "LF" constraint date equal to the contract completion date for the project, and with a zero day duration or by using the "project must finish by" date in the scheduling software. The schedule shall have no constrained dates other than those specified in the contract. The use of artificial float constraints such as "zero fee float" or "zero total float" are typically prohibited. There shall only be 2 open ended activities:
Start Project (or NTP) with no predecessor logic and End Project with no successor logic.
3.3.3.3 Early Project Completion
In the event the project schedule calculates an early completion date of the last activity prior to the contract completion date, identify those activities that it intends to accelerate and/or those activities that are scheduled in parallel to support the Contractor's "early" completion. The
SECTION 01 32 01 Page 6 last activity shall have a late finish constraint equal to the contract completion date and the schedule will calculate positive float. The Government will not approve an early completion schedule with zero float on the longest path. The Government is under no obligation to accelerate activities for which it is responsible to support a proposed early contract completion.
3.3.4 Milestones
The schedule must include milestone activities for each significant project event including but not limited to: milestone activities for dredging complete and for each ACCEPTANCE Section (if applicable).
3.4 PROJECT SCHEDULE SUBMISSIONS
Provide the submissions as described below.
3.4.1 Project Schedule Submission
Submit the initial Project Schedule, defining the Contractor's planned operations for approval within 15 calendar days after the NTP is acknowledged. The approved Project Schedule will be used for payment purposes. Cost load the Project Schedule to balance the contract award Contract line item numbers (CLINS) shown on the Price Schedule. The initial Project Schedule must include all of the required Plan and Program preparations, submissions and approvals identified in the contract (for example, Quality Control Plan, Safety Plan, and Environmental Protection Plan)
3.4.2 Periodic Schedule Updates
Submit periodic schedule updates monthly with requests for progress payment. These submissions will assist the Contracting Officer in assessing the Contractor's progress. Update the percent complete for each activity started, based on the realistic assessment of work completed. If the Contractor fails or refuses to furnish the information and project schedule data, which in the judgment of the Contracting Officer or authorized representative is necessary for verifying the Contractor's progress, the Contractor shall be deemed not to have provided an estimate upon which progress payment may be made.
3.4.3 Standard Activity Coding Dictionary
If a CPM/PDM is used for the Project Schedule, the activity coding structure defined in the Standard Data Exchange Format (SDEF) in ER 1-1-11, Appendix A is acceptable. A template SDEF compatible schedule backup file (sdef.prx) is available on the QCS website: http://rms.usace.army.mil/.
3.5 OWNERSHIP OF FLOAT
Float available in the schedule, at any time, shall not be considered for the exclusive use of either the Government or the Contractor.
