a. FAR 52.212-1, “Instructions to Offerors–Commercial Items (Jan 2017)”

c. 52.212-2, “Evaluation—Commercial Items (Oct 2017)”

i. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

ii. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

VIII. BASIS OF AWARD & EVALUATION

Basis of Award:

Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-price factors. Proposals will be evaluated for acceptability, but not ranked using the non-price factors. Tradeoffs will not be used. The Lowest Price Technically Acceptable (LPTA) process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

Definitions:

ACCEPTABLE: Proposal clearly meets the minimum requirements of the solicitation.

http://acquisition.gov/comp/far/index.html https://www.sam.gov/

W911YU-20-Q-0004

UNACCEPTABLE: Proposal does not clearly meet the minimum requirements of the solicitation.

The following evaluation factors shall be used to evaluate the technical and price proposals.

Please include as much detail as possible for technical evaluation consideration. Since the LPTA methodology prohibits trade-offs, all evaluation factors are equally important. Proposals will be evaluated for acceptability but not ranked using the non-cost and/or price factors.

Factor 1: Price

· Submittal Requirement: Contractor shall provide quotation in accordance with Attachment 2 Price Schedule to meet the requirements of the Attachment 1 Performance Work Statement. In particular, Section 5.0 Requirements outlines the different tasks for provision of Vehicle Lease Services for the 254th Air Base Group, Andersen Air Force Base, Guam.

· Basis of Evaluation: Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price: 1. Comparison of proposed prices received in response to the RFP; and/or 2. Comparison of proposed prices to the Independent Government Estimate

(IGE).)

Factor 2: Technical Approach

· Submittal Requirement: Offeror shall submit vehicle specifications for meeting the tasks of the PWS. In particular, contractor shall review Section 5.0 for the specific technical requirements, however, this does not preclude the requirement to propose in accordance with the entirety of the PWS. Vehicle specifications may be incorporated with the price

· Basis of Evaluation: This factor evaluates the Offeror’s technical capability and methodology.

Offeror’s will be evaluated upon their proposed realistic and executable solutions that demonstrate an understanding of RFP requirements. The Government will evaluate the effectiveness of the technical approach that will give the Government a high level of confidence the work will be performed in accordance with the technical requirements.

Factor 3: Past Performance

· Submittal Requirement: The government will assess past performance based on review of government database systems and availability of historical information for federal contract awards. The contractor is encouraged, though not required, to provide information pertaining to past performance which is similar to the requirement herein in terms of scope, size and complexity.

· Basis of Evaluation: Basis of Evaluation: This evaluation focuses on how well the Offeror performed on similar contracts. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources outside of the Government.

Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), VEHICLE LEASE SERVICES, 254TH AIR BASE GROUP, ANDERSEN AFB, GU

Electronic Subcontract Reporting System (ESRS), and any other known sources not provided by the Offeror. The Government will consider the currency and relevance of the information, the sources of the information, context of the data, and general trends in the KTR’s performance.

This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP. Offerors lacking past performance information will not be evaluated favorably or unfavorably in past performance and will received a rating of unknown Confidence.
