The Contract Administrator (CA) shall be sent a monthly surveillance report.
5.4 The Quality Assurance (QA) Representative ensures that the contractor is providing all services as prescribed in the contract. The Quality Assurance (QA) Representative shall conduct inspections of the work areas and shall be included in the monthly Contractor/Government meetings. The Quality Assurance (QA) representative shall also serve the Quality Assurance Program Coordinator (QAPC) and shall ensure that the quality assurance procedures as described in Army Regulation no. 1180-1-2, PERFORMANCE BASED SERVICE CONTRACTING are adhered to.
5.5 The Area Engineer (AE) is in charge of the Duluth Area Office and shall be notified of any changes or proposed changes to the Contract and shall be included in the monthly Contractor/Government meetings.
5.6 The Security Officer is in charge of all security procedures and regulations at the Duluth Area Office.
The security officer shall supply all background check applications forms and fingerprint cards as required by the Contractor.
5.7 The Safety Officer shall ensure that all work performed by the Contractor is in accordance with the EM- 385-1-1, U.S. Army Corps of Engineers Safety and Health Requirements Manual.
6. SURVELLANCE PROCEDURES
The primary method for evaluating the Contractor’s performance will be via receipt of customer’s complaints and Quality Assurance Inspections.
The designated Quality Assurance Representative (or other representative as authorized by the COR) may perform daily inspections at the Visitor Center at 1000 to verify that the Contractor has completed work before Visitor Center operation hours. Additional inspections at each contracted location may be completed during business hours by the quality assurance representative to ensure work items are being completed at the contracted frequencies.
During the month, the Contracting Officers Representative (COR) may receive complaints about the quality of the service being provided by the Contractor. The COR or designated representative shall validate the complaints against the contract and may request the Contractor to correct the unacceptable performance. Validated customer complaints shall be maintained as part of contract administration documents. Additional customer complaints may be drafted for the same defect if it remains uncorrected within its forecasted period, or within one month from the date of complaint.
The COR or a designed representative shall periodically inspect the Contractor’s Quality Control Plan and all services being performed as part of this contract.
At month’s end the field Quality Assurance (QA) staff reviews Contractors performance including customer complaints and Quality Assurance (QA) inspection remarks. Conduct mandatory monthly meeting with the contractor. Prepare Contract Discrepancy Reports (CDR’s) if necessary. Issue Monthly report to the Contract Administrator.
6.1 UNACCEPTABLE PERFORMANCE
The term “DEFECT” is used in reference to a service output that does not meet the standard of performance specified.
When a customer complaint is received, it shall be validated by the Contracting Officers Representative (COR) to ensure the complaint relates to the actual requirement of the Contract.
When unacceptable performance is documented, the contracting officers Representative (COR) shall take the following actions:
- If Government action or inaction caused the unacceptable performance, the Government will take necessary steps to prevent defect recurrence. Customer complaints or defects shall not be validated if found to be caused primarily by government action, or inaction.
- If action is non-government caused, the Contractor’s on-site representative will be informed of the unacceptable performance as described on the complaint form, and the Contractor’s on-site representative will be requested to initial and date the complaint form. By signing and dating the complaint form, the Contractor’s on site representative is acknowledging that they have been informed of the unacceptable performance.
- Request performance or re-performance of the service failed to conform to the contract requirements. Any service requiring re-performance shall be documented by the Contracting Officers Representative to correct all detected defects.
- Require the Contractor to correct all detected defects.
- Inspect the re-performance of the service and document the adequacy, date and time of the re-inspection when re-performance has been deemed unacceptable, the Contracting Officers Representative (COR) will inform the Contractor’s on site representative that performance is still unacceptable, and again shall document the file accordingly, and request their initials and date on the Complaint Form. If the Contractor wants to dispute the results of the surveillance, the COR must refer them to the Contracting Officer (CO) for resolution of the matter.
