BRAND NAME DETERMINATION

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

The requiring office shall provide the following information:

Date:03JAN2017 Purchase Request Number: W81ET463415540 Estimated Amount: :

Brief description of supplies or services to be acquired and the intended use:

Qty of 1 – FARO Focus S 350 (Part No. LS-8-S-350) plus battery, charger, accessories, etc.

The above listed will be used for surveying, mapping, engineering, design, construction, real estate, and operational projects supporting the Engineering & Construction Division (and other Divisions when requested and funded). Specifically, the equipment will be used for O&M fabrication QA surveys, vertical control surveys and 2022 datum update projects, and A-E Contract QA/verification.

Clearly and concisely state the facts supporting the award of a sole brand name action. Include a statement that the proposed brand name item (s) is the only brand that can satisfy the Government’s requirement and describe the actions taken to determine this (i.e. market research, market survey, internet search, CCR search, etc.):

We are expanding our operational capacity by purchasing a LiDAR scanner as we saw the return on investment would be worth acquisition in the long-term, rather than continuing to resource funding to another District to perform similar work with their equipment. LRP survey personnel were funded to travel and train alongside LRH survey personnel on four projects this past calendar year. It has been determined to be most advantageous to procure a FARO Focus S 350 terrestrial LiDAR scanner as the equipment that LRH survey personnel provided on this year’s projects was a FARO Focus X 330. If other brands such as Leica, TopCon, or Riegl are purchased we would need to learn new workflows as we were not trained on anything other than a FARO Focus scanner. Along with the familiarity of the FARO brand, the subject FARO LiDAR products (X 330 and S 350) are directly compatible with Trimble and Bentley software, of which LRP retains two licenses to Trimble surveying processing software and many licenses to Bentley LiDAR, CAD, and BIM software. If a FARO brand LiDAR scanner is not purchased, then there would be confusion on field survey methodology and capability, data transfer, data formats, data collections, data processing, data organization, and we would be forced to develop conversion routines that are not necessary if FARO equipment is acquired.

Provide the basis for determining the anticipated price to be fair and reasonable (e.g., describe techniques to be used to determine fair and reasonable price, such as price analysis, catalog pricing, independent Government estimate, etc.).

A search of the GSA Advantage site was conducted on the FARO Focus X 330 which matched the same prices to the one vendor (DiCarlo Precision Instrument Inc., a certified SBE) who is authorized for FARO product sales in this geographic area (PA, MD, DE, VA, WV and DC).

These matching price quotes lead the District’s Geospatial Section to believe that DiCarlo’s price for the X 330 is fair and reasonable. The S 350 that we desire to purchase is a newly-released unit thus there is not yet a GSA Schedule price, but the increased price of the S 350 as

compared to the price of the X 330 (~14k, or ~25%) seems fair and reasonable as the S 350 has an accuracy rating twice (2x) that of the X 330 (+/- 1mm for S 350 and +/- 2mm for X 330).

Include a statement of action that will be taken by the customer to preclude the necessity for future sole brand name acquisition of the same supplies/services or why this would be impossible:

The LRP Engineering & Construction Division currently owns and utilizes two licenses to Trimble Business Center and uses that software for all in-house survey processing and Contract data QA. The USACE has an agency-wide ELA for many licenses to Bentley MicroStation and uses that software for almost all CAD and BIM projects. The District will not be excessing any of this equipment or software in the near future, and will have a continuing need to interface directly from FARO brand hardware to Trimble and Bentley branded hardware and software.

No action can be taken by the District to preclude the necessity for future sole source acquisition of FARO brand equipment.
