JE-CLaSS II Draft RFP Questions and Answers #2

1 Section H, OCI Revision 1 H.1.4
System-related advisory and assistance services to the Government (as defined in FAR 2.101) shall not be eligible to receive award of or execute performance under a Domain 1 TO that relates to that system. This shall apply to any TOR issued for 60 months after completion of the advisory and assistance services effort.
Under the current JE-OPETs and JE-CLaSS contract vehicles the government has accepted OCI mitigation plans as a way to allow contractors to provide advisory and assistance as well as performance on systems as described under Domain 1 of JE-CLaSS II.
To advance full and open competition that provides opportunities for the most qualified service providors, will the government consider language that allows contractors to submit an OCI mitigaiton plan that allows contractors to provide system-related advisory and assistance services and allows them to bid on a Domain 1 TO that relates to that system?
Pursuant to Sections H and L of the RFP, all offerors are required to submit and maintain an OCI Mitigation Plan.
The Government does not anticipate that a contractor that has provided Advisory and Assistance services related a system would be able to satisfactorily mitigate a potential / actual OCI within the context of JE-CLaSS II.

Advisory and assistance services (as defined in FAR 2.101) in support of a JPEO-CBRND Directorate or Joint Project Manager (JPM) office (or a similarly situated non-JPEO entity) shall not be eligible to receive award of or execute performance under a Domain 1 TO requirement generated by that office. This shall apply to any TOR issued for 36 months after completion of the advisory and assistance services effort.
Under the current JE-OPETs and JE-CLaSS contract vehicles the government has accepted OCI mitigation plans as a way to allow contractors to provide advisory and assistance as well as performance on systems as described under Domain 1 of JE-CLaSS II.

Additional background: Over the past three years the governemt has reorganized, causing advisory and assistance positions that were under JPM Guardian, for example, to now fall under JPM Sensors.
In the case where a contractor provides advisory and assitance to a JPEO Directorate or JPM office, but no direct support to systems on a Domain 1 TO, will the government consider language that allows contractors to submit an OCI mitigaiton plan that allows contractors to provide advisory and assistance services to the requiring office and allows them to bid on a Domain 1 TO that is generated from that office?
The Government will consider, on a case-by-case basis, situations where a contractor has provided advisory and assistance services to a JPM / similar entity that has since been reorganized (similar to JPM Guardian / CBRN Sensors).
