52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
II. Addendum to FAR Clause 52.212-2 Evaluation – Commercial Items
Evaluation Factors for Award
a. Basis for Contract Award. This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 13, Simplified Acquisition Procedures, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The test program authorized under FAR Subpart
13.5 is applicable to this acquisition. Award will be made to a single quoter who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose quote is technically acceptable, conforms to the solicitation requirements, and whose quote, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the lowest price.
b. Award for All of the Work. The Government intends to award one Firm Fixed Price Contract as a result of this solicitation. Quotes received for less than the stated number of items listed in the Price Schedule will be considered ineligible for award. As set forth in FAR 52.212-1 (g), The Government intends to evaluate quotes and award a contract without discussions with quoters.
Therefore, the quoter’s initial quote should contain the quoter’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
c. Evaluation Criteria. Product samples. One (1) raincoat is required at or prior to the time specified for receipt of offers (see 52.212-1 Addendum). The sample shall be submitted at no expense to the Government. Samples will be evaluated in accordance with the evaluation criteria listed below. Evaluation criteria consist of factors. The quotes will be evaluated under two (2) evaluation factors: Technical and Past Performance.
Factor 1 – Technical Factor. The Technical Factor will receive one of the ratings defined below.

Acceptable Sample clearly meets the minimum requirements of the solicitation.
Unacceptable Sample does not clearly meet the minimum requirements of the solicitation.
In order to receive an acceptable rating, the sample submissions must not contain any major defects as stated in the evaluation critera listed below.
Factor 2 – Past Performance Factor. The Past Performance Factor will receive one of the ratings defined below.

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance under the contract is unknown.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
In order to receive an acceptable rating, the Past Performance record must show evidence of successfully performing satisfactorily.
d. Notice of Award. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Samples will be evaluated in accordance with the evaluation criteria stated below: Purpose: To establish the criteria that the Raincoat sample(s) will be evaluated against to determine the acceptability of the sample to the Government.
NOTE: One (1) Major constitutes a failure, and Three (3) Minor defects equals one (1) Major which constitutes a failure.
