4. Authority: Action using Simplified Acquisition Procedures
FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.
urgency, exclusive licensing agreements, brand name, or industrial mobilization).
5. Reason for Authority Cited: The Madigan Army Medical Center (MAMC) Graduate Continuing Education program utilizes many different kinds of medical journals from various journal publishers to support the professional development objectives of its diverse workforce.
Wiley Journals contain the specialized research and patient care best practices literature that MAMC requires in order to achieve its educational goals. These copyrighted journals fulfill an information niche not available from other on-line journal publishers.
6. Actions to Increase Competition: The specific items requested are BRAND NAME specific since they are copyright-protected journals published exclusively by Wiley. No alternative journals from other publishers are known to satisfy MAMC’s unique educational material requirements. A sources sought synopsis (W911S8-18-Q-2450) was posted to the Federal Business Opportunities (FEDBIZOPS) website at www.fbo.gov from 10-20 August 2018 to identify potential vendors with the ability to fulfill this requirement. Multiple small businesses expressed their capability and potential to provide the required access to the Wiley medical journals. After a thorough review, the Contracting Officer determined that soliciting this requirement as a total small business set-aside via FEDBIZOPS is the best way to obtain adequate competition. Solicitation #: W911S8-18-R-0029 on www.fbo.gov. is being used as the medium to obtain quotes from potential vendors.
7. Market Research: Each Journal Periodical Publisher publishes unique titles and those titles are available only from those publishers or their authorized sellers. Journal Publishers routinely sell Backfiles and Pay-Per-View PDF Journal Access directly to institutions and individuals. MAMC is requesting access to specific journal literature that describe unique medical research and patient care best practices. Medical practitioners regularly use this information to enhance quality patient care. These journal periodicals (to include back files) are copyright-protected intellectual property owned and published exclusively by Wiley. Wiley is the sole source for Wiley-owned titles, but do allow outside vendors to sell access to their journals. A sources sought synopsis (W911S8- 18-Q-2450) was posted to the Federal Business Opportunities (FEDBIZOPS) website at www.fbo.gov from 10-20 August 2018 to identify potential vendors with the ability to fulfill this requirement. Multiple small businesses expressed their capability and potential to provide the required access to the Wiley medical journals. After a thorough review, the Contracting Officer determined that soliciting this requirement as a total small business set-aside via FEDBIZOPS was the best way to obtain adequate competition. The requirement was posted for solicitation on 30 August 2018 with a closing date of 14 September 2018 at 11:30 AM PST with no offers received from any vendor. The Contracting Officer will now solicit this requirement as unrestricted via FEDBIZOPS in order to obtain adequate competition.

11. Fair and Reasonable Price Determination: As Contracting Officer, I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
Basis for the determination: The sources sought showed that adequate competition among authorized re-sellers exists. This requirement is well defined and non-complex in nature, thus interested parties are not expected to unreasonably inflate pricing in response to a perceived high risk. This procurement is expected to be a low risk venture for both the U.S. Government and the successful contractor.
