Section C - Descriptions and Specifications

ENVIRONMENTAL SUPPORT SERVICES

C-1

GENERAL

C-1.1

SCOPE OF WORK

C-1.1.1 The Contractor shall operate at U.S. Army Dugway Proving Ground (DPG) a Central Hazardous Waste Storage Facility (CHWSF), provide related CHWSF and additional hazardous / non-regulated waste management functions, and provide regulatory compliance support for the DPG Directorate of Environmental Programs (DEP). These services are required to enable DPG to operate a State of Utah permitted hazardous waste storage facility in compliance with the currently established State of Utah permit (current permit, UT 3750211259, was issued on March 15, 1994), and comply with all applicable Federal, State and Army requirements. The prime contractor is ultimately responsible for compliance with the above whether the services are performed by themselves or by a subcontractor.

C-1.1.2 The Contractor shall perform the following general functions:

C-1.1.2.1 Manage a permitted storage facility for hazardous and non-regulated wastes.

C-1.1.2.2 Pick-up and transport waste and materials on U.S. Army Dugway Proving Ground.

C-1.1.2.3 Sampling and analysis of wastes and materials.

C-1.1.2.4 Polychlorinated Biphenyls (PCB) waste management.

C-1.1.2.5 Container management.

C-1.1.2.6 Perform inspections on the following and condition reporting on the following:

C-1.1.2.6.1 Solid Waste Management Units (SWMU’s).

C-1.1.2.6.2 90-Day Storage Sites.

C-1.1.2.6.3 Universal Waste Management

C-1.1.2.6.4 CHWSF and related equipment.

C-1.1.2.6.5 Range and Test Grid current condition reporting and assessment.

C-1.1.2.7 Manifest review, generation, tracking and management.

C-1.1.2.8 Transportation and disposal of wastes/materials off-site.

C-1.1.2.9 Training (formal and informal) of generators.

C-1.1.2.10 Management of used oils.

C-1.1.2.11 Oversight of 90-day sites.

C-1.1.2.12 Interim measures.

C-1.1.2.13 Resource Conservation & Recovery Act (RCRA), Clean Air Act (CAA) and Natural Resource compliance support.

C-1.2

BACKGROUND

C-1.2.1 U.S. Army Dugway Proving Ground is a remote site located approximately 90 miles southwest of Salt Lake City, Utah. The installation covers in excess of 800,000 acres, which sometimes requires the Contractor to function outdoors in isolated, high desert environments.

C-1.2.2 U.S. Army Dugway Proving Ground is part of the Installation Management Command (IMCOM), which was formed in October, 2006. As the nation’s designated chemical and biological Major Range and Test Facility Base, DPG provides testing and support for chemical and biological defense and related programs.

C-1.3

PERSONNEL

C-1.3.1 Management Plan: Refer to Technical Exhibit 1 - Deliverables, Section A.1 Management Plan.

C-1.3.2 The Contractor shall provide all the necessary qualified/certified/trained personnel, and provide management and direction to accomplish the objectives of the contract. Qualifications, certifications, and licenses for the Contractor’s employees shall be maintained during the life of the contract. The Contractor shall ensure employees have current and valid professional certifications as required by the individual performance work statements prior to starting work under this contract.

C-1.3.3 The Contractor shall maintain management and operational control, and shall have full responsibility for performance requirements. The Government will not direct or supervise the Contractor’s employees performing services under this contract.

C-1.3.4 The Contractor shall maintain a current listing of employees and provide on a monthly basis to the Contracting Officer’s Representative (COR). The monthly listing shall state which employees have been authorized housing are residing on the post. The listing shall state continuing employees and new employees.

C-1.3.5 On-Site Management: The Contractor shall provide an on-site manager who is responsible for the performance of the work. The on-site manager shall be on site during the phase-in period and throughout the term of the contract.

C-1.3.5.1 The on-site manager or their alternate shall have full authority to act for the Contractor on all contractual matters relating to the daily operation of this contract to include signature authority.

C-1.3.5.2 The on-site manager or their alternate shall be available during normal duty hours within 30 minutes to meet on the installation with Government personnel to discuss problem areas. After normal duty hours, the on-site manager or their alternate shall be available within two (2) hours unless otherwise specified.

C-1.3.5.3 The Contractor shall furnish to the KO the names and phone numbers of the on-site manager and all management and supervisory personnel no later than (NLT) the post-award conference. When the Contractor intends to replace any of the key personnel specified in the Statement of Work (SOW) and/or accepted proposal, the Contractor shall make available to the Government at least 30 calendar days prior to replacement the resume of the individual to fill the specified position for review and approval.

C-1.3.5.4 The on-site manager, alternate(s), and personnel interacting with and providing services to the Government and/or other contractors must be able to read, write, speak, and understand the English language.

C-1.3.6 Contractor Employees:

C-1.3.6.1 Prior to replacing any of the personnel requiring specific qualifications or certifications, the Contractor shall provide the KO the resume and certifications of the individual to fill the specified position. The Government reserves the right to request a copy of the resume and certifications at any time.

C-1.3.6.3 A monthly listing of employees shall be submitted to the KO and one copy to the COR. The listing must state continuing employees and new employees.

C-1.3.6.4 The Contractor shall not employ persons if such employee is identified as a potential threat to the health, safety, security, or operational mission of the installation. The KO may require that the Contractor remove employees who endanger persons or property or whose continued employment under this contract is inconsistent with the interests of military security.

C-1.3.6.5 The Contractor shall perform substance abuse testing on their employees using a certified medical toxicological testing facility. The Contractor’s drug program shall be in accordance with (IAW) Defense Federal Acquisition Regulation Supplement (DFARS) 252.223-7004 Drug-Free Work Force.

C-1.3.6.6 All employees assigned by the Contractor to the performance of work under this contract shall be physically able to perform their assigned work and shall be free of any communicable disease. Each employee shall have a physical examination from an American Medical Association licensed medical doctor, at no cost to the Federal Government.

C-1.3.6.7 The Contractor and his/her employees shall conduct themselves in a proper and efficient manner such as to reflect a respectable image upon the contractor and the Federal Government, and shall, at all times, cause the least possible annoyance or disturbance to occupants of the Federal Government buildings or the operations therein.

C-1.3.6.8 The Contractor shall not hire a U.S. Government employee (civilian or military) without approval from the Installation’s Judge Advocate and Contracting Officer..

C-1.3.6.9 The abrupt absence of Military Reservists and National Guard could adversely affect the Contractor’s ability to perform. Their absence at any time shall not constitute an excuse for non-performance under this contract.

C-1.3.7 Contractor Access to DPG: Access to DPG requires that Contractor employees voluntarily submit personal data (e.g., name, social security number) when applying for a DPG Identification Card or temporary access pass. This information is routinely used by DPG Law Enforcement and Security personnel to conduct driver’s license and criminal history/background checks. Adverse information revealed by such checks (e.g., outstanding criminal warrants, criminal history indicating a potential risk to DPG Installation security, or similar negative information indicating a potential security and/or law enforcement risk to DPG) may result in a denial of access and/or reentry to U.S. Army Dugway Proving Ground. Delays caused by any adverse employee information do not constitute a basis for claim by the Contractor. It is the Contractor’s responsibility to assure all personnel scheduled to work on the installation have acceptable backgrounds.

C-1.3.8 Identification of Contractor Employees: The Contractor’s personnel shall present a neat appearance and be easily recognized as Contractor employees. All Contractor employees shall be easily identified as a Contractor while performing work for the Government under the scope of this contract. The Contractor’s identification shall include the Contractor’s company name and the employee’s name and be easily visible at all times. Requirements for identification are at the Contractor’s expense.

C-1.3.8.1 Contractor workspace (e.g., office, laboratory, and desk) shall be clearly identified.

C-1.3.8.2 Contractor employees shall initially identify themselves by name and company affiliation when answering the telephone, presenting briefings, conducting or attending meetings/seminars.

C-1.3.8.3 All Contractor correspondence (written, facsimile, and email display) shall include their company name.

C-1.3.9 Foreign Visitors / Employees:

C-1.3.9.1 In accordance with DPG Regulation 380-11, the Contractor will be allowed to hire non U.S. citizens to work or visit Dugway Proving Ground during the duration of the contract under the following condition:

· A list of foreign national employees must be provided to the COR at least five (5) working days prior to arrival on post.

· The list will contain the visitor’s name, passport number or Alien Registration Number, Social Security Number (if any), date and place of birth, country of citizenship, purpose of visit, and level of US Information involved.

· The Contractor will also list the date(s) foreign nationals will be on post.

C-1.3.9.2 If a sensitive test or visit is scheduled during the dates provided, the COR will inform the Contractor whether the work/visit may take place. The COR will forward the list to the DPG Foreign Disclosure Officer within the Counterintelligence Office for verification. Employees will not be allowed on Post until verification process is complete. Once verification has been received, the COR is responsible to provide the Protocol Office the following information for badge preparation:

· Name;

· Company; and

· POC.

C-1.3.9.3 The COR is also responsible to pick-up the badges and holders, issue them to the visitor and return them at the end of the visit.

C-1.4

CLEARANCE FORMS

C-1.4.1 The Contractor shall ensure that all employees or subcontractor employees, who have worked on the installation during the contract performance period, be given a clearance form for completion prior to the employee’s final departure from DPG. The clearance form identifies the various entities, organizations, and services available at DPG where an authorized individual’s signature may be required. It is the Contractor’s responsibility to clearly identify the appropriate designated areas that each employee must clear. Clearance requirements will vary for residents of DPG and non-residents. The Contractor’s standard clearance form shall be reviewed and approved by the KO prior to use. The clearance form shall be reviewed and approved by the KO or the COR prior to the departing employee obtaining required authorized signatures. The completed copy shall be delivered to the COR for final review, approval, and filing.

C-1.5

EMPLOYEE TRAINING

C-1.5.1 Training Plan: Refer to TE 1 Deliverables, Section A.2 Training Plan. The Contractor shall maintain a complete training plan for all employees. These records will be available to the Government upon request.

C-1.5.2 The Contractor shall not deviate from the accepted plan without the written consent of the KO.

C-1.5.3 The Contractor shall ensure that all their personnel attend Government provided fire extinguisher training annually.

C-1.5.4 The Government will provide installation specific training to the Contractor’s designated trainer during the phase-in period. After transfer of accountability, the Contractor shall be responsible for all training. The Government will provide course materials for such training.

C-1.5.5 The Government will provide technical training, as determined by the COR and KO, for new requirements or technologies not addressed in this Performance Work Statement (PWS). This training will be provided only to an initial cadre of the Contractor’s personnel requiring specialized formal training, not to exceed 25 percent of the target population

C-1.5.6 The Government will not provide any training or certification for the Contractor’s employees except as otherwise listed in this contract.

C-1.5.7 The Government typically has an annual safety stand down training day. The Contractor may elect to participate in the safety training provided by the Government to meet their requirements. Participation in this training will not alleviate the Contractor’s responsibility in the performance of their duties.

C-1.6

SECURITY

C-1.6.1 Security Plan: Refer to TE 1 Deliverables, Section A.3 Security Plan.

C.1.7.2 Some of the work required by this contract may require access to restricted areas. Occasional delays in obtaining authorization for access to these areas or escort to a work site may be anticipated.

C-1.6.3 Security Badge Requirements: The Contractor is responsible for security badges and/or protective masks issued to his employees and/or employees of his subcontractor(s). A designated representative (being an officer or supervisor of the Contractor) shall co-sign for each individual when obtaining the required item(s). Additionally, the Contractor will provide to the KO a list of employees needing masks/badges under the awarded contract prior to initiation of work. The Contractor will be required to submit, to the KO with his monthly billing, a “certificate of return” for all masks/badges from the cognizant office(s) before approval for payment will be considered. The replacement cost for masks/badges are as follows (NOTE: Prices are subject to change.):

C-1.6.3.1 Protective mask: $398.50 each

C-1.6.3.2 DPG Security Badge: $11.50 each

C-1.6.3.3 The above indicated replacement cost for lost items will be deducted from the Contractor’s monthly billing for item(s) not returned or lost, or the Contractor will be billed in cases where the replacement cost of lost items exceeds the amount due the Contractor.

C-1.6.4 The Government will be responsible for the issuance of security badges; the visitor control services; the investigation of security incidents; the investigation, identification and documentation of DPG traffic regulations; the issuance and the use of security forms; and conducting inspections required by Department of Defense (DoD) 5220.22-R, Industrial Security Regulation.

C-1.6.5 Personnel Security: The Contractor’s personnel requiring unescorted entry to restricted or other sensitive areas designated by the Installation Commander, shall comply with AR 25-2 Information Assurance and AR 380-67 The Department of the Army Personnel Security Program.

C-1.6.6 Operations Security (OPSEC) Program: The Contractor shall comply with OPSEC requirements and perform in such a manner to insure the protection of classified and unclassified sensitive information. OPSEC defines requirements in the handling of unclassified sensitive information, and provides clarification on the definition of unclassified sensitive information and provides definitive inter-working relationship in the execution of information security. The Contractor will be provided a listing of the critical information during the post-award conference.

C-1.6.7 Additional Security Requirements: In accordance with DoD 5200.1- R Industrial Security Program Regulation, the Contractor shall comply with Army Systems Security Instruction (ASI) requirements such as Communications Security (COMSEC); COMPUSEC for Operational Systems; Security Awareness, Training, and Education (SATE) Program; and Emanations Security (TEMPEST) IAW AR 530-1.

C-1.6.7.1 The Contractor shall comply with the Automatic Data Processing (ADP) Systems Security Plan designated by the DPG ADP Systems Security Office (ADPSSO) for any ADP terminals reserved for the contractors use IAW AR 25-2 Information Assurance and associated supplements.

C-1.6.7.2 The Contractor shall be required to operate Government Owned automatic data processing equipment. Any of the Contractor’s employees assigned to an ADP Sensitive Position must be cleared under the provision of AR 380-19 Information Systems Security.

C-1.6.8 Freedom of Information Act Program (FOIA): Any request for information shall be directed to the COR. When necessary, the COR will forward the information to the FOIA Officer for processing. No release of Government information shall be authorized without following these procedures.

C-1.6.9 Reporting Requirements: The Contractor shall immediately report any known or suspected breaks or violations of security to the proper authorities and remain at the scene until authorities arrive. Additional or other conditions or situations are reportable under DoD 5220.22-M National Industrial Security Program. The Contractor shall comply with AR 381-12 Subversion and Espionage Directed Against the U.S. Army (SAEDA). The Contractor’s personnel shall report to an appropriate authority any information or circumstances that they are aware that may pose a threat to the security of DOD personnel, Contractor personnel, resources, and classified or unclassified defense information. Their immediate supervisor upon initial on-installation assignment shall brief the employee of reporting requirements.

C-1.6.10 Vehicle Registration

C-1.6.10.1 Pass and Identification Items: The Contractor shall ensure the below-identified pass and identification items required for contract performance are obtained for employees, subcontractor(s) and non-government owned vehicles prior to commencement of work.

C-1.6.10.2 All vehicles entering DPG are required to be registered at the Pass & ID Office. The temporary or permanent vehicle pass, as appropriate, shall be prominently displayed on the vehicle.

C-1.6.10.3 Drivers must be appropriately licensed by the State of Utah or other appropriate jurisdiction to operate vehicles used in the performance of this contract on federal, State of Utah, and local highway systems.

C-1.6.10.4 Violations of law off post may result in the employee being barred from driving on the installation or barred from the installation. These incidents will not excuse the Contractor from peforming the functions in this contract.

C-1.7

SAFETY AND HEALTH

C-1.7.1 Standards of Sanitation and Cleanliness: Facilities provide by the Government or the Contractor for the Contractor’s use shall be maintained in a clean, orderly and safe manner.

C-1.7.2 When Contractor employees are performing work in buildings, care shall be taken to assure that areas of work and pathways within the buildings are left neat, clean and free of debris upon completion of required work.

C-1.7.3 The Contractor shall agree to indemnify and hold the Government harmless, whether in tort or in contract, for any loss or liability due to injury or death of the Contractor’s personnel.

C-1.7.4 Smoking Policy: The Contractor and the Contractor’s employees shall comply with the Army smoking policy as described in AR 600-63, Army Health Promotion.

C-1.7.5 Industrial Hygiene:

C-1.7.5.1 The Contractor shall be responsible for establishing an industrial hygiene program consistent with Occupational Safety & Health Administration (OSHA) requirements as specified in 29 CFR. No industrial hygiene support will be provided for the Contractor's operations. The Government’s annual evaluations can be used to augment the Contractor’s program. The Contractor shall provide, maintain, and replace as required all safety equipment to include Personal Protective Equipment (PPE) (e.g., hearing protection, respirators, steel toe footwear, safety glasses and other safety equipment), except for masks identified in Section C-1.7.7 and unique military protective clothing and equipment required to enter chemical and biological surety areas identified in Section C-2.3.1, for all personnel in the performance of this contract. The Contractor shall ensure employees have adequate safety, occupational and radiological health education and training. Occupational health support will not be provided except for Chemical Personnel Reliability Program (CPRP) related requirements, such as CPRP physicals, Cholinesterase (ChE) tests, and medical emergencies. The Government will provide specialized surety equipment for both the chemical and biological surety areas.

C-1.7.5.2 The Contractor shall perform the requirements of this PWS using the safety and health guidelines of OSHA, Army Occupational Safety and Health (AOSH), Department of the Army Pamphlet (DA Pam) 40-8 Occupational Health Guidelines for the Evaluation and Control of Occupational Exposure to Nerve Agents GA, GB, GD, and VX, DA Pam 40-173 Occupational Health Guidelines for the Evaluation and Control of Occupational Exposure to Mustard Agents H, HD, AND HT, Technical Bulletin (TB) Med 502 Respiratory Protection Program, TB Med 506 Occupational Vision, TB Med 507 Heat Stress Control and Heat Casualty Management. If AOSH standards are more comprehensive than OSHA standards, the Contractor shall augment the OSHA standards with the appropriate AOSH standards. If AOSH standards conflict with OSHA standards, then the OSHA standards shall be followed.

C-1.7.5.3 The Contractor shall provide the DPG Health Clinic and Government Industrial Hygienist with a list of Contractor personnel, to include name, location and type of work assignment, work hazards and exposures, and supervisory points of contact. In addition, the Contractor’s safety manager shall provide the DPG Health Clinic and Government Industrial Hygienist with all sampling results from industrial hygiene evaluations and surveys of the contractor’s personnel and operations. This information will be utilized by the Government to provide emergency services and/or occupational medicine services.

C-1.7.6 Accident or Incident Reporting and Investigation:

C-1.7.6.1 The Contractor shall implement a system, which will identify and report safety hazards and mishaps involving Army facilities or equipment to the Command Safety Office and COR. The Safety Office will assist the KO in investigation and reporting of such mishaps. Mishap investigation and reporting of accidents involving only the Contractor’s employees shall be the Contractor’s responsibility. The Contractor shall immediately notify the Safety Office and COR of serious injury or work-related death of the Contractor’s employees. The Safety Office will conduct work site visits of the Contractor’s operations to ensure Army facilities and equipment are used and maintained IAW AR 385-10 Army Safety Program. The Contractor shall take action when notified by the KO to correct unsafe conditions or hazards. Any violations of established safety and accident prevention rules and regulations, unless promptly corrected, will be grounds for termination of this contract pursuant to Federal Acquisition Regulation (FAR) clause 52.212-4(m) – Termination for Cause.

C-1.7.6.2 If the Government elects to conduct an investigation of the accident, the Contractor shall cooperate fully.

C-1.7.6.3 It shall be incumbent upon the Contractor and his / her employees, during performance under this contract, to report to the COR any fire or safety hazards noted, and within the scope of this contract, to implement corrective action required. Any hazard noted, which is not within the scope of this contract, shall be reported to the COR, or the Fire Department at 2515, or the Safety Office at 5317.

C-1.7.7 Protective Masks: The Government will issue protective masks to the Contractor as the prime contractor. The Safety Office will determine when protective masks are required and inform the KO of this requirement.

C-1.7.7.1 The Contractor’s personnel accessing the areas that require masks shall be clean-shaven to facilitate proper fitting and sealing of the masks.

C-1.7.8 Blood Cholinesterase Testing: Employees and subcontractor(s) who will be on post and have access to specific areas may be subject to Blood ChE testing.

C-1.7.8.1 The Government’s Surety Office will determine when Blood ChE testing is required and inform the KO of this requirement. The KO will notify the Contractor of this requirement during the post-award conference. The KO will notify the Contractor of any changes to this requirement.

C-1.7.8.2 The Contractor shall provide the COR, a list of employees needing testing prior to their initiation of work. The Contractor shall update this list as new employees are hired who will need testing. The Contractor shall provide the COR, a list of employees that require exit testing due to termination of employment or reassignment actions within 7 workdays prior to the action.

C-1.7.8.3 The Contractor shall ensure that identified employees and subcontractor(s) establish a blood ChE testing baseline upon employment and assignment to DPG. The Government will provide the ChE testing at the DPG Health Clinic at the going cost per sample to the Contractor. The Contractor is responsible for the cost of the samples. The current rate is $30.00 per sample, but is subject to change without notice. The Contractor shall ensure that employees or subcontractor(s) have two (2) samples drawn at the Health Clinic no later than 28 calendar days after employment and assignment to DPG. The Government’s Surety Office will determine the assignment, and document the category that the employees and subcontractor(s) fall within

C-1.7.8.4 The Contractor shall ensure that employees and subcontractor(s) obtain an exit sample ChE upon termination at DPG. The Government will take the ChE testing exit sample at the DPG Health Clinic.

C-1.7.8.5 The Contractor shall ensure that employees and subcontractor(s) in the categories identified below undergo interim blood ChE testing upon employment and assignment to DPG. The Government will provide the ChE testing at the DPG Health Clinic.

C-1.7.8.6 Baseline ChE required and re-established every 3 years unless there is a potential exposure. Exit ChE required.

C-1.7.8.7 Due to close proximity or the length of time Contractor personnel may be in specific areas, these personnel may be required to have blood drawn to establish ChE at the clinic even if they do not fall into any category. The Health Clinic will make that determination and will notify the COR of the requirement.

C-1.7.8.8 Contractors or visitors, who will be on post for less than 2 weeks, may be required to have a ChE blood draw regardless if they will have repeated access to a chemical limited/exclusion area. Any personnel having a ChE blood draw established at DPG will have an exit ChE draw upon termination of employment or access requirements change.

C-1.7.8.9 Contractors and visitors, who will be on post in excess of two weeks, may require a reference sample at commencement and an exit sample at termination, depending on area being accessed. Those personnel having repeated access to a chemical exclusion area will require a blood CHE testing baseline to be established at commencement, and an exit sample at termination.

C-1.7.8.10 All personnel who will be on-post in excess of two weeks are required to process through the Health Clinic. The Registration Office will not issue either a temporary or permanent vehicle pass until this processing has been completed. Blood draws will be taken, when necessary from personnel having access to specific areas. Occasional delays in obtaining authorization for access to these areas or escort to a work site may be anticipated.

C-1.7.9 Fire Protection / Inspection:

C-1.7.9.1 The Contractor shall adhere to DPG Regulation (DPG-R) 420-8.

C-1.7.9.2 The Government will provide fire protection to the Contractor's property to the extent required to preclude damage to property of the Government.

C-1.7.9.3 The Contractor's facility is subject to frequent fire safety inspections by the Fire and Emergency Services (FES). All deficiencies noted shall be promptly corrected within 48 clock-hours or time determined by FES.

C-1.7.9.4 The Contractor shall be liable for all damages and injuries resulting from his/her negligence (refer to FAR clause 52.237-2 Protection of Government Buildings, Equipment, and Vegetation).

C-1.7.10 Safety & Health Plan: The Contractor shall formulate and submit a written Safety and Health Plan, NLT the end of the phase-in period, for review and acceptance by the KO (refer to TE 1 Deliverables, Section A.4 Safety & Health Plan). The Contractor shall have a central point of contact for safety and health related issues.

C-1.8

PHASE-IN / PHASE-OUT

C-1.8.1 The Contractor shall submit a copy of the accepted Phase-In / Phase-Out Plan to the KO and the COR within 15 calendar days after notification of award (refer to TE 1 Deliverables Section A.5 Phase-In/Phase-Out Plan).

C-1.9

QUALITY CONTROL

C.1.9.1 The Contractor shall provide and maintain an effective quality control system to substantiate that all services and supplies comply with the specifications and requirements of this contract, State and Federal laws and Army policies and regulations. This system shall be documented and shall be available for review by the Federal Government throughout the life of this contract.

C-1.9.2 In compliance with the FAR clause 52.212-4(a) – Inspection / Acceptance, the Contractor shall provide a site specific Quality Control Plan to the KO for acceptance no later than the end of the phase-in period (refer to TE 1 Deliverables, Section A.6. Quality Control Plan). The Federal Government reserves the right to inspect, at the source, supplies or services manufactured or performed within the contractor’s purview on or off site. Federal Government inspections shall not constitute acceptance, or otherwise relieve the contractor of responsibilities to furnish an acceptable end product.

C-1.9.3 The records of inspections shall be kept and made available to the Government throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.

C-1.10

QUALITY ASSURANCE

C-1.10.1 According to FAR clause 52.212-4(a) – Inspection / Acceptance, the Government will evaluate the Contractor’s performance under this contract. For those tasks listed on the Performance Requirements Summary (refer to TE 4 Performance Requirements Summary), the COR will follow the methods of surveillance specified in that Performance Requirements Summary (PRS). The Government’s personnel will record all surveillance observations. When an observation indicates potentially defective performance, the COR will require the site manager or representative to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgment that the Contractor officially has been made aware of the potentially defective performance. Government surveillance of tasks not listed in the PRS or by methods other than those listed in the PRS (such as provided for by the Inspection of Services clause) may occur during the performance period of this contract.

C.1.10.2 The PRS may be unilaterally revised by the Government and reissued to the Contractor at any time during the period of performance of the contract. The Contractor will be notified of changes in the PRS at least 15 days prior to implementation by the Government.

C-1.10.3 Performance Evaluation Meetings: The KO may require the on-site manager to meet with the KO, Contract Administrator, COR, and other Government personnel as deemed necessary. The Contractor may request a meeting with the KO when the Contractor believes such a meeting is necessary. Written minutes of any such meetings shall be recorded by the Contractor and signed by the on-site manager and the KO or Contract Administrator. If the KO does not concur with any portion of the minutes, such non-concurrence shall be provided in writing to the Contractor within 10 calendar days following receipt of the minutes.

C-1.11

HOURS OF OPERATION

C-1.11.1 Normal Hours of Operation: The U.S. Army Dugway Proving Ground operates on a four (4) day work week, Monday through Thursday, from 6:50 A.M. to 5:40 P.M. (local time), except for recognized Federal Holidays. Deliveries of supplies, materials, and equipment will be accepted on regular scheduled work days between 7:00 A.M. and 4:30 P.M. (local time). Unless otherwise specified herein, the Contractor’s operations shall coincide with the Governments operations to ensure continuity of operations.

C-1.11-2 Any exceptions to the normal duty hours must be pre-approved by the KO.

C-1.11.3 Holidays: Except for work categorized as emergency, the Contractor is not required to provide services on the following federal holidays listed below. Any of the holidays falling on a Sunday shall be observed on the following Monday. Any of the holidays falling on a Friday or Saturday shall be observed on the proceeding Thursday. The Federal Government will designate all holiday dates.

C-1.11.3.1 January 1st

C-1.11.4 Other Requirements: On occasion, services may be required for support outside the normal duty hours described above. On-call Contractor personnel shall be provided for after-hours support on the weekends and holidays. Stand-by personnel on holidays and after duty hours shall respond within 2 hours of notification.

C-1.11.5 Weekend/Holiday Support: Upon notification by the KO, the Contractor shall provide services to support weekend/holiday training schedule.

C-1.12

DELIVERABLES

C-1.12.1 The Contractor shall be required to prepare all deliverables IAW the instructions defined in TE 1 Deliverables.

C-1.13

OZONE DEPLETING SUBSTANCES (ODS) REQUIREMENTS

C-1.13.1 The following required Class I ODS have been identified and approved for use under performance of any resultant contract purchase order: None.

C-1.13.2 If during performance of the contract, an unapproved Class I ODS is discovered the Contractor shall notify the Contracting Officer immediately.

C-1.13.3 The ODS restrictions apply to subcontractors as well.

C-1.13.4 Class I ODS: Per Section 326 of Public Law 102-484, effective 1 June 93, specifications and standards cannot require the use of Class I ODS without approval. There are some cases where a specification or standard allows the use of an ODS, but does not require substitution under the law.

C-1.13.5 If this requirement allows, but does not require, the use of a Class I ODS, although it is not mandatory for the Contractor to use a non-ODS substance, the Contractor is encouraged to give preference to using the non-ODS choice.

C-1.14

EXCAVATION PERMIT

C-1.14.1 The Contractor shall be required to submit a request for excavation to the Director of Public Works if excavation is required. The request shall include the Contractor's proposed starting date with annotated drawings indicating all areas of required excavation. It is estimated approximately 30 calendar days may be required to obtain excavation permit approval. The COR shall complete all coordination dealings with the contractor’s request for excavation. The Contractor is required to initiate all excavation permit requests as soon after award as possible so that performance will not be delayed pending receipt of an excavation permit. Formal notice to proceed shall not be issued until the contractor has received an excavation permit for the project.

C-2 GOVERNMENT FURNISHED PROPERTY (GFP): The Government will furnish or make available to the Contractor certain facilities. GFP may only be used for the performance of work under this contract. The Government reserves the right to furnish materials, supplies or equipment necessary for contract performance upon so notifying the contractor prior to any commitment by the contractor.

C-2.1

FACILITIES

C-2.1.1 The Contractor shall have use of the facilities listed in TE 6 Government Furnished Facilities.

C-2.1.2 Key Control: The Contractor shall establish and implement methods of making sure all keys that the Government issues to the Contractor are not lost or misplaced and are not used by unauthorized persons IAW AR 190-51 Security of Unclassified Army Property (Sensitive and Nonsensitive), Appendix D and Dugway Physical Security Standard Operating Procedure, Key and Lock Control.

C-2.1.2.1 SOP: Refer to TE 1 Deliverables, Section C Standard Operating Procedures.

C-2.1.2.2 The Contractor shall immediately report to the COR or KO any occurrences of lost or duplicated keys. In the event keys are lost or duplicated, the Contractor may be required to re-key or replace the affected lock or locks when notified by the COR.

C-2.1.2.3 The Contractor shall prohibit the use of Government issued keys by other than Contractor employees, unless approved by the COR. The Contractor shall only accept service orders for new, duplicate, or replacement keys or locks from the Physical Security Office. Anyone requesting keys and/or locks shall be referred to that office.

C-2.1.3 Lock Combinations: The Contractor shall control access to all Government provided lock combinations to preclude unauthorized entry, and shall establish procedures in local operating instructions (OI) to ensure lock combinations are not revealed to unauthorized persons. The Contractor is not authorized to record lock combinations without written approval from the COR and the combination shall be written on Standard Form (SF) 700 Security Container Information.

C-2.1.4 Building Responsible Officer (BRO): For each Government-Furnished Facility provided to the Contractor, the Contractor shall designate in writing a primary and alternate BRO, a building energy monitor, and a building fire marshal to comply with the requirements of applicable directives.

C-2.1.5 Access: The Contractor shall maintain and post an STEDP-CON Form 15 Responsible Property Officer Card on the main entrance/exit door of each provided facility.

C-2.1.5.1 SOP: Refer to TE 1 Deliverables Section C Standard Operating Procedures.

C-2.1.6 Entry Procedures to Controlled/Restricted Areas: The Contractor shall implement local DPG procedures for entry to Army controlled/restricted areas for their personnel. The Contractor’s personnel requiring unescorted entry to restricted or other sensitive areas designated by the installation Commander shall comply with AR 380-67, The Department of the Army Personnel Security Program, and AR 380-19, Information Systems Security.

C-2.3

SUPPLIES & MATERIALS

C-2.3.1 Government Provided Clothing: The Government will provide all unique military protective clothing and equipment required to enter chemical and biological surety areas. The Contractor shall be required to sign for the protective clothing and equipment and shall be responsible for the return of the equipment after the operation is completed. The Contractor is responsible for all other PPE required in the performance of work.

C-2.4

GOVERNMENT-FURNISHED SERVICES

C-2.4.1 Utilities: The Government will furnish utilities as currently installed in provided facilities to include electricity, telephone, and fuel. The Contractor shall not change or alter any service, or component, without the Government’s prior review and approval. The Contractor shall not connect any contractor-furnished equipment/system without the Government’s prior review and written approval. The Contractor shall ensure all employees operate in a manner to preclude waste of utilities.

C-2.4.2 Fuel: The Government will furnish operating fuels for all vehicles and equipment required in the performance of this contract. The Government will not provide fuel used to transport the Contractor’s employees between their domicile and their duty station. The Contractor shall coordinate with the Government for gasoline, natural gas fuel and diesel requirements. The Contractor shall establish a system to track fuel usage if company vehicles are used for purposes other than those required for the performance of this contract.

C-2.4.3 Telephone Service: The Government will provide telephone instruments and lines currently located in the Government provided facilities. Government furnished telephones and telephone lines are to be used for transaction of official business of the Army, as defined in AR 25-1 Army Knowledge Management and Information Technology, Chapter 6. The Contractor shall make every effort to conserve Government funds by limiting commercial long distance calls to the absolute minimum necessary for transaction of official business. Available classes of service are:

C-2.4.3.1 Class C: Provides access to on-post extensions (Last four digit dialing).

C-2.4.3.2 Class A: Provides accesses to on-post extensions, defense Switching Network (DSN), and commercial dialing. The number of class A type phone lines shall be coordinated with the COR at the time of award of contract.

C-2.4.3.3 The Contractor’s employees shall not relocate Government furnished telephone equipment or in any way tamper with the telephone distribution system. The Contractor shall request any moves, additions, or changes to the telephone equipment through the Information Technology (IT) service desk at extension 831-2065 or on the Dugway User Resource Center web site. The Contractor shall appoint a Telephone Control Officer (TCO) to enter IT requests as mentioned in previous sentence and monitor telephone usage/abuse. Telephone troubles/outages shall be reported to 831-2065.

C-2.4.3.4 Radio Frequency: The Government will provide radio frequency assignments and authorizations for any RF radiating device and must be approved by the Director of Installation Management (DOIM) prior to activation.

C-2.4.4 Postal or Installation Mail Distribution: The Government will be responsible for the daily delivery of mail to a mailbox located in the Contractor’s onsite main office. The Contractor shall be responsible for delivery of mail to the Contractor’s internal activities.

C-2.4.5 Information Management Systems: The Government will provide Desktop Computing Services, Network Support, and Applications Programming Services. These services do not include the actual central processing units (CPU) and peripherals (refer to Paragraph C-3.4), which are to be provided by the Contractor.

C-2.4.5.1 Desktop Computing Services consists of Account Management, access to the DPG electronic mail system, and support for Government furnished software applications, as defined in the memorandum dated 8 April 1998 or latest guidance (subject: DOIM Approvals/IMCOM Certification for Personal Computers (PCs), Printers and Commercial Off-the-Shelf Software (COTS)). A copy of this memorandum is located in the Technical Library. Contractor owned, developed or operated Information Systems and Networks processing Army information must be accredited IAW with AR 25-2 prior to connection to DPG’s Campus Area Network. All computer users shall complete the Information Assurance (IA) Awareness training before operating any computer system and complete annual refresher training.

C-2.4.5.2 Network Support is defined as providing access to the DPG Campus Area Network. Initiation of a National Agency Check with Local Agency Check and Credit Check (NACLC) background investigation is needed prior to receiving access to networks and AIS. Unfavorable background investigations are grounds for removal from systems. Contractor purchased IT equipment, software, and services must be approved by DOIM prior to the purchase.

C-2.4.5.3 Applications Programming Services consists of developing, maintaining, and supporting computer programs for the financial, environmental, personnel, and logistics systems that are resident on the DPG-operated computer systems.

C-2.4.5.4 Any additional services, support for non-standard equipment or software, and/or assistance will require the Government’s prior review and approval.

C-2.4.5.5 All requests for service and assistance for Government furnished software applications shall be made by…
