Offeror’s Question: Reference Technical Exhibit 36 - There is an apparent error in the Price Breakdown spreadsheet. Annual direct labor and other direct costs from the main worksheet are being further multiplied by 12 on Schedule B.

Government’s Response: TE 36 Price Breakdown Spreadsheet has been eliminated in its entirety. There is no requirement for the Offerors to complete the Price Breakdown Spreadsheet.

Offeror’s Question: Reference Paragraph C-5.2 - There are some apparent editing problems in this section. All functions should probably include title, objective, principal duties, skills and qualifications, education requirements and experience. “Function 4” and “Function 5” headings are missing although the objective, duties and qualifications are included.

Government’s Response: The headings are correct as stated in the RFP. Functions 1 (C-5.2.1.1), 2 (C-5.2.1.2) and 3 (C-5.2.1.3) are part of the objective listed in paragraph C-5.2.1. The balance of the duties are associated with other objectives listed in C-5.2.2, and C-5.2.3.

Offeror’s Question: Reference Paragraph C-5.2 - What is the historical and anticipated level of effort for the positions listed in this section? (Functions 1-5) What are the associated job titles? Are any of these jobs that would be subject to Department of Labor (DOL) classification?

Government’s Response: Some historical level of effort has been presented in the pre-proposal conference slides; however, it is the Offeror’s responsibility to ascertain the number positions and labor categories (job titles) required to undertake the requirements with the performance work statement (Section C). The historical level of effort from the presentation slides is as follows:

Offeror’s Question: Reference Paragraph C-5.2 - What is the historical and anticipated level of effort (hours on site, hours off site, qualifications, etc.) for the following personnel tasks? These positions are not listed as key personnel but are presumably important to successful contract implementation. Note: It is particularly difficult to determine the scope of the natural resources support tasks. Based on the general information provided in C-5.1.7, C-5.8.6, C-5.18, one could argue for a single person or several experts conducting field investigations, performing biodiversity studies, developing processes, designing bird and mammal surveys, developing databases, etc.

Government’s Response: Refer to the response provided to Question 3.

Offeror’s Question: Reference Paragraph C-5.4.1 - Are there any special handling, transportation, sampling, analytical or PPE requirements associated with chemical agent samples described in this section?

Government’s Response: The contractor should be familiar with collecting high hazardous and high profile samples including agent related waste and protecting their personnel accordingly. Contractor is expected to provide SOPs for specific task and areas (C-5.1.9.1 and C-5.13.3).

Offeror’s Question: Reference Paragraph C-5.4.1 - How are chemical agent-related samples tested to ensure complete decontamination? Is the contractor required to sample chemical agent-related waste? If so, are there any associated training or experience requirements? Is the contractor responsible for any costs associated with sampling or analysis of these wastes? What is the frequency of chemical agent sampling and testing?

Government’s Response: 1) Onsite Chemical Laboratory performs analysis verifying they are below Dugway’s Part B Permit Action levels. 2) Yes. 3) Yes, Certified Chemical Agent Handler Level 1A. 4) Contractor will be responsible for all sampling, supplies and data validation of the analysis. 5) See Technical Exhibit 7 Historical LOE.

Offeror’s Question: Reference Paragraphs C-5.5.2 and C-5.5.6 - These sections describe sample collection, transportation and data review but not sample analysis. Is the government responsible for analytical costs? If not, how are analytical costs to be estimated? Who selects the analyses to be performed? Since sample analysis is very expensive and highly variable, the government should provide specific expectations for all environmental samples (hazardous waste (HW), soil, groundwater, etc.) to be analyzed by the contractor including data quality requirements (data validation, QC deliverables, etc.)

Government’s Response: 1) Contractor is responsible for all analytical cost. 2) See Technical Exhibit 7 Historical LOE.

Offeror’s Question: Reference Paragraph C-5.5.7 - What are the data validation level and frequency requirements?

Government’s Response: 100% level 3, 10% level 4

9.

Offeror’s Question: Reference Paragraph C-5.5.8 - Is the contractor required to perform audits of analytical laboratories? At what frequency? Where are the laboratories located?

Government’s Response: 1) Yes, See Function 1. 2) Contractor must ensure data quality in accordance with C-5.5.7 and C-5.5.8. 3) The onsite laboratory and commercial laboratories must meet all project data quality objective.

Offeror’s Question: Reference Paragraph C-5.7 - How are HW container costs to be estimated? The government should provide specific expectations for container usage during the contract in addition to historical usage.

Government’s Response: Historical container usage is provided in Technical Exhibit 7. It is the responsibility of the contractor to estimate the usage for the proposed price. The assumptions should be detailed in volume I, Appendix A.

Offeror’s Question: Reference Paragraph C-5.8.3 - Although listed under “Perform Inspections,” this section describes universal waste compliance requirements. Should probably be moved to C-5.19.

Government’s Response: Universal Waste is compliance and waste management driven and should be considered accordingly.

12.

Offeror’s Question: Reference Paragraph C-5.8.4 - What is the purpose for the self-contained breathing apparatus (SCBA) equipment mentioned in this section? Is the contractor expected to perform hazardous operations requiring SCBA? Is the contractor required to purchase SCBA equipment?

Government’s Response: 1) Contractor is required to manage and sample all waste generated on Dugway, except explosives in nature. The contractor should have the capabilities to manage high hazardous waste up to OSHA level B. 2) Yes. 3) Contractor is required to be capable of performing up to OSHA level B.

Offeror’s Question: Reference Paragraph C-5.8.6 - Although listed under “Perform Inspections,” this section describes natural resources compliance requirements. Should probably be moved to C-5.18.

Government’s Response: Natural Resources is compliance driven and should be considered accordingly.

14.

Offeror’s Question: Reference Paragraph C-5.10 - How are HW transportation and disposal costs to be estimated? Historical usage is not included in TE-7 and would not be predictive of future needs. Since HW disposal is very expensive and highly variable, the government should provide specific expectations and detailed descriptions (waste streams, constituents, number of containers, volume, weight, etc.) of all HW to be managed by the contractor. As at other military facilities, is Defense Reutilization & Marketing Organization (DRMO) available to dispose of all waste streams at no cost to the contractor? Are there Dugway waste streams that DRMO cannot manage?

Government’s Response: 1) See revised Technical Exhibit 7 Historical LOE. 2) DRMO is available for non-agent related waste streams under a separate government contract at no cost to the contractor. The contractor is responsible for 1348 documentation and supporting waste information including cost tracking. 3) State listed waste revised in Technical Exhibit 7 is the responsibility of the contractor and assumptions should be detailed in volume I, Appendix A.

15.

Offeror’s Question: Reference Paragraph C-5.10 - What, if any, travel is anticipated as part of this contract? What are the frequency, destination and duration of required travel?

Government’s Response: Historically, contractor personnel have had to travel to Deer Park, Texas 2-4 times per year to witness disposal of P999 filters.

16.

Offeror’s Question: Reference Paragraph C-5.10 - Are hazardous waste disposal costs (containers, analytical testing, HW transportation, disposal, other) tracked for eventual billing to individual customers and projects? What is the level of effort associated with this?

Government’s Response: 1) The successful contractor shall be responsible for tracking the disposal costs and should provide this information through the COR to Resource Management. The cost associated for this reporting requirement should be included in the offeror's firm-fixed price.. 2) Historically this has been 0.5 FTE.

17.

Offeror’s Question: Reference Paragraph C-5.11 - The frequency of required training should be further specified. Who determines which individuals require specific training? How many individuals require each listed course? Historical effort listed in TE-7 does not include Resource Conservation and Recovery Act (RCRA) training listed in C-5.11.2.

Government’s Response: The following is a list of courses historically provided by the contractor; however, the type and quantity of courses to be provided is required by Federal, State, and local regulations (Part B permit).

a) 40 Hour HAZWOPER (for 25-30 individuals, 2-4X annually, classroom)

b) 8 Hour HAZWOPER Refresher (for 100-110 individuals, 4-6X annually, classroom)

c) 8 Hour HAZWOPER Supervisor (for 10-15 individuals, 1-2X annually, classroom)

d) DOT (for 15-20 individuals, 1-2X annually, classroom)

e) RCRA CHWSF and Contingency Plan (15-20 individuals, 1-2X annually, classroom and online)

f) RCRA Igloo G and Contingency Plan (45-50 individuals, 1-2X annually, classroom and online)

g) RCRA DTTF and Contingency Plan (15-20 individuals, 1-2X annually, classroom and online)

18.

Offeror’s Question: Reference Paragraph C-5.13.3 - What is the historical and anticipated level of effort (LOE) to support the waste management areas listed in this section (CCTF, BMTF, LSTF, SAPs, universal waste, etc.)? What are the volume, type and frequency of wastes managed at each area?

Government’s Response: Historically, contractor personnel have been available at the CCTF for four hours per day, collect waste directly from SAPs, etc. Contractor personnel will be required to transport waste from the new chem lab to the 90-Day area in the adjacent building. Information regarding quantity and some of the locations is provided within Technical Exhibit 7.

L-3.1 Proposal Submittal and Inquiries:

L-3.1.1.3.1 If an Offeror intends to hand deliver their proposal, the Offeror shall notify the Dugway Contracting Office no later than 5:00 PM [local prevailing time at U.S. Army Dugway Proving Ground, Utah] on Wednesday, July 29, 2009 for security clearance purposes. Offerors shall submit their request for hand delivery electronically to Ms. Jane Lemmon, Contracting Officer at jane.lemmon@us.army.mil. The request shall include the following information:

· Telephone number; and

· Nationality.

L-3.1.2 Electronic submissions via email or fax will not be accepted. Offers shall be mailed through a commercial/Government carrier or hand carried.

L-3.1.3 All proposals delivered in response to this solicitation shall reflect the following on the address label:

L-3.1.4 Do not submit a transmittal letter with your proposal. Such a letter is unnecessary and statements therein frequently create conflicts or ambiguities, raising the possibility that your proposal takes exception to the terms and conditions of the solicitation.

L-3.1.5 The Contracting Officer (KO) is the sole point of contact for this acquisition. Address all questions or concerns you may have to the KO. All questions regarding this solicitation shall be submitted in writing via email (email is the preferred method) or FAX to: Ms. Jane Lemmon via email [jane.lemmon@us.army.mil] or facsimile [(435) 831-2085]. Offerors shall submit their question in writing by no later than seven (7) calendar days prior to the closing date of the solicitation. Questions received after that time may not receive a response.

L-3.1.6 Pre-Proposal Conference and Site Visit:

L-3.1.6.1 A pre-proposal conference, including a site visit, will be held at the U.S. Army Dugway Proving Ground installation beginning at 8:00 AM [local prevailing time at U.S. Army Dugway Proving Ground, Utah] on Tuesday, July 14, 2009. The purpose of the pre-proposal conference and site visit is to provide offerors an opportunity to observe the facilities at Dugway Proving Ground as well as to have a discussion of the proposed effort. Personnel should arrive at the Auditorium located in the Dugway Proving Ground Headquarters Building (Building 5450) by no later than 7:45 AM [local prevailing time at U.S. Army Dugway Proving Ground, Utah]. (Note: Driving time from Salt Lake City is approximately two (2) hours). Allow an additional 30 to 45 minutes for individual and vehicle pass process at the Main Gate.

L-3.1.6.2 Attendance at the conference is urged and expected for participation in this request for proposal. Due to space limitations, not more than three (3) representatives from any firm should attend the conference. Due to security clearance purposes, attendance at the pre-proposal conference must be confirmed in writing and received no later than 5:00 PM [local prevailing time at U.S. Army Dugway Proving Ground, Utah] on Thursday, July 9, 2009. Offerors shall submit their confirmation to Mr. Eric S. Vokt, Contract Specialist at eric.s.vokt@us.army.mil. The request shall include the following information:

L-3.1.6.2.1 Name of the individuals delivering the proposal;

L-3.1.6.2.2 Name of the company representing;

L-3.1.6.2.3 Telephone number; and

L-3.1.6.2.4 Nationality.

L-3.1.6.3 Any procurement, technical and pricing questions concerning the request for proposal arising before the pre-proposal conference and site visit shall be submitted in writing per Section L.3.1.5. Questions submitted prior to the conference/site visit, or raised at the conference/site visit, will be answered at the conference/site visit to the extent that time and information at hand will permit. Remarks and explanations at this conference shall not qualify the terms of the solicitation and specifications which shall remain unchanged. All written questions will be answered in an SF 30 amendment provided electronically at the Federal Business Opportunities (www.fbo.gov) website. Offerors are responsible for periodically accessing the website for amendments and information.

L-3.1.6.4 Attendance is at the expense of the offerors.

L-3.1.6.5 There are no hotel/motel accommodations at the U.S. Army Dugway Proving Ground (DPG) installation; however, motel accommodations are available in Salt Lake City, Utah which is located approximately 85 miles northeast of DPG. In Tooele, which is approximately half way between Salt Lake City, Utah and the DPG installation, there are six motels as follows: Best Western Inn – Tooele; Comfort Inn; Hampton Inn; Valley View Motel; Villa Motel; and Holiday Inn Express. NOTE: No recommendation is made either on the availability or quality of these hotels/motels.

L-3.2 General Instructions:

L-3.2.1 The selection of a source for award purposes will be conducted utilizing source selection procedures as delineated in FAR Part 15.3. Offers will be evaluated using the criteria under Section M, “Factors to be Evaluated.” Noncompliance with the RFP requirements will raise serious questions regarding an offeror’s technical ability to perform the services and may be grounds to eliminate the proposal from further consideration for contract award.

L-3.2.2 The submission of the documentation specified below will constitute the offeror's acceptance of the terms and conditions of the RFP, concurrence with the Performance Work Statement, and the proposed contract type.

L-3.2.3 IAW FAR 52.212-1(g), it is the Government’s intention to award without discussions. Offerors are encouraged to present their best mission capability proposal and prices in their initial proposal submission. However, in accordance with (IAW) FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).

L-3.2.4 These instructions prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.

L-3.2.5 In accordance with FAR Subpart 4.8 “Government Contract Files”, the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

L-3.2.6 If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the KO in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

L-3.2.7 All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fbo.gov. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.

L-3.2.8 The KO will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. The KO will notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR 15.506. Upon such notification, unsuccessful offerors may request and receive a debriefing. Offerors desiring debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.

L-3.3 Proposal Preparation Instructions:

L-3.3.1 The offerer’s proposal shall consist of four (4) separate volumes:

L-3.3.1.1 Mission Capability;

L-3.3.1.2 Past Performance;

L-3.3.1.3 Small Business Participation; and

L-3.3.1.4 Contract / Price.

L-3.3.2 Proposal Format:

L-3.3.2.1 Offerors shall submit an original and the number of copies listed in Section L.3.3.2.2 below of their proposal.

L-3.3.2.2 Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors (Sections A through M). Failure to meet a requirement may result in an offer being ineligible for award. If the offeror finds it necessary to take exception to any of the requirements specified in this solicitation, clearly indicate in the applicable Volume each such exception with a complete explanation of why the exception was taken, what benefit accrues to the Government (if any), and its impact, if any, on the performance, schedule, price, and specific requirements of the solicitation. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. This information shall be provided in the format below.

L-3.3.2.3 The proposals shall be organized into four (4) volumes. Each volume of the proposal should be separately bound in a three-ring loose leaf binder which shall permit the volume to lie flat when open. A cover sheet should be bound in each book, clearly marked as to volume number, title, copy number, solicitation identification and the offeror's name. The same identifying data should be placed on the spine of each binder. All text shall be single spaced and printed black on white paper (black and white requirement does not apply to graphics, photos, etc., company stationary and logo’s are acceptable). Printing shall be easily readable (12-pitch type or 10 point proportional spacing.) Cross-references should be utilized to preclude unnecessary duplication of data between sections. Documents shall be stamped For Official Use Only and Source Selection Sensitive. In addition to submitting hard copies of the proposals, digital copies shall be provided on CD-ROM disk in Microsoft Word, PowerPoint and/or Excel. File names to be “Company Name – Initial” for the first submission. File name of later submissions (if necessary), shall be “Company Name – Revision X’ with X indicating the number of the revision. * Volumes I, II and III shall be VOID of any proposal price information.

** Offerors will only need to submit the original version of the proposals. The digital copies of the proposal will be used by the Government for evaluation purposes.

L-3.3.2.4 The proposal shall not exceed the limits stated above. If the page limits are exceeded, the pages in excess of the limit shall be removed and returned, unread, to the offeror. The Government will not accept any changes to the offeror’s proposal after the closing date of the solicitation (See FAR 15.208 for further information regarding late proposals). If discussions become necessary, page limitations may be placed on responses to Items For Negotiations (IFNs). The specified page limits for IFN responses will be identified in the letters forwarding the IFNs to the offerors.

L-3.3.2.5 The page limit includes all appendices, charts, graphs, diagrams, tables, photographs, drawings, etc.

L-3.3.2.6 The page limit does not include covers for volumes, tables of contents, glossary of abbreviations and acronyms, indices, title pages, cross reference indices, and section dividers/tables if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. They will be counted if they contain any other information, i.e., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” will not be counted.

L-3.3.2.7 A page shall be an 8 ½ X 11” sheet of paper (minimum of ½” margins). When both sides of a sheet display printed material, it shall be counted as two pages. Letter size and spacing requirements for illustrations and tables can be at the discretion of the offeror but must be easily readable. Fold-outs will be counted as the appropriate number of pages based on an 8 ½ X 11” sheet of paper. Use at least 1 inch margins on the top and bottom and 3/4 inch side margins. The Contractor shall number each page in order to eliminate any confusion. In the event contractor creates an ambiguity in their numbering of pages, the Government may exercise its own discretion in counting pages.

L-3.3.2.8 Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify sections.

L-3.3.2.9 Each volume shall contain a glossary of all abbreviations and acronyms used, with an explanation for each.

L-3.3.3 Proposal Content:

L-3.3.3.1 Volume I - Mission Capability Volume

L-3.3.3.1.1 The Mission Capability Volume shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Legibility, clarity and coherence are very important. Your responses will be evaluated against the Mission Capability elements defined in Section M, Evaluation Factors for Award. The proposal should not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements. Statements that the offeror understands, can, or will comply with the PWS (including referenced publications, technical data, etc.); statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will be considered unacceptable. Offerors shall assume that the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the offeror's proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.

L-3.3.3.1.2 The Mission Capability Volume shall, at a minimum, be prepared in a form consistent with the Performance Work Statement (PWS) and the evaluation criteria for award set forth in Section M of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the offeror’s technical competence and ability to comply with the contract task requirements specified in the PWS. The offeror shall address as specifically as possible the actual methodology you would use for accomplishing the PWS tasks. The Mission Capability volume shall be organized according to the following general outline:

· List of Tables and Drawings

· Cross Reference Matrix

· Mission Capability

· TAB 1: Organization

· TAB 2: Key Personnel

· TAB 3: Capabilities and Experience

· TAB 4: Quality Control

L-3.3.3.1.3 The Mission Capability elements are as follows:

· TAB 1 - Organization: This element shall include, but not be limited to, the following:

· The offeror shall discuss how they will organize their operations to perform the work within the peformance work statement (Section C), including levels of supervision.

· The offeror shall discuss the work each organizational element (i.e., Division/Branch/Team) is responsible for managing and accomplishing; and where the decision making authority lies.

· The offeror shall discuss how their proposed organization at the DPG installation fits into their overall company; and what corporate support the offeror will receive.

· The offeror shall provide a complete description of the areas within the peformance work statement (Section C) to be subcontracted; and how the subcontractors will be managed and integrated into the offeror’s organization.

· TAB 2 - Key Personnel: This element shall include, but not be limited to, the following:

· Documentation on the education and experience of the proposed key personnel to demonstrate the probability of successful contract performance. Information for key personnel shall include as a minimum the following: employee’s name, education, fields of training, certificatinos, and experience. Key personnel proposed by offerors must either be current employees or individuals who have agreed in writing since the issuance of the solicitation to work on this particular contract. The offeror shall also describe their approach to recruiting, hiring, training, and retaining the work force necessary to perform the work defined in the Statement of Work (SOW).

· TAB 3 - Capabilities and Experience: This element shall include, but not be limited to, the following:

· The offeror shall identify and summarize three specific projects performed by the offeror shall be listed and summarized (in a single paragraph description) for each area listed below to demonstrate experience:

· Resource Conservation and Recovery Act of 1976

· Clean Air Act

· Natural Resource Conservation

· Management of a Treatment Storage and Disposal Facility

· Sample Analysis Data Validation

· State of Utah Regulatory Compliance

· Environmental Training

· Pollution Prevention

· The offeror shall provide three (3) examples of existing “final” written products (e.g., a brochure, an Environmental Assessment, a Spill Contingency Plan, an Analytical Method Development Report, an environmental training presentation, or a groundwater monitoring report). These are examples only and are not all-inclusive of possible products. Each product should reflect the offeror’s capability to produce professional quality written products. Each sample shall not be more than 20 pages in length.

· TAB 4 - Quality Control: This element shall include, but not be limited to, the following:

· The offeror’s submit a Quality Control Plan that demonstrates the ability to understand and establish an effective and appropriate quality control program. The Plan must demonstrate evidence of a quality control program that ensures acceptable performance, identifies problem areas and provides mechanisms for corrective action.

· TAB 5 - Phase-In/Phase Out: This element shall include, but not be limited to, the following:

· The offeror shall identify specific steps to be accomplished, upon award of contract, in preparation for smooth transition to full contract operation without disruption to existing services. Both Phase-In and Phase-Out shall be no longer than 30 calendar days. Any necessary phase-out effort shall occur during the performance period of this contract and should be included in the price of this contract. Services provided under this contract are vital to the Government’s overall effort and continuity must be maintained at a consistently high level without interruption upon expiration of this contract (refer to FAR 52.237-3 Continuity of Services). Offerors shall describe anticipated processes for transfer of services to either the Government or a successor.

L-3.3.3.2 Volume II – Past Performance Volume

L-3.3.3.2.1 Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform more than $100,000.00 in total value per contract year. The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.

L-3.3.3.2.2 In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance Volume and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Command (DCMC) and commercial sources.

L-3.3.3.2.3 The offeror shall include documentation regarding their relevant past performance as it directly relates to the work being procured under this solicitation. The offeror SHALL NOT go back any farther than 60 months for the submitted data. The past performance data shall document a successful history of past contract performance. To illustrate the offeror’s past performance, the following documentation shall be submitted:

· The offeror shall provide documentation outlining the offeror’s past performance with contracts, as a prime or major subcontractor, which is the same or similar in nature, size, and complexity to the services being procured under this Solicitation. The submittal shall include rationale on how it was determined that the work performed previously was the same or similar in nature, size, and complexity to the work specified by this solicitation. Non-Government contracts may be used if Government contracts are not available. The documentation shall be submitted in the following format:

· Contract Number and, in the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Task Order Numbers also.

· Contract Type (specific type such as Fixed Price (FP), Cost Reimbursement (CR), Time & Materials (T&M), etc.) In the case of Indefinite Delivery contracts, indicate specific type (Requirements, Definite Quantity, and Indefinite Quantity) and secondary contract type (FP, CR, T&M, etc)).

· Contractor/Subcontractor place of performance, CAGE Code and DUNS Number. If the work was performed as a subcontractor, also provide the name of the prime contractor and Point of Contact (POC) within the prime contractor organization (name, and current address, email address, and telephone and fax numbers).

· Original, awarded, and final Price/Cost (or projected final, if contract is current).

· Original and final delivery schedule, including dates of start and completion of work.

· Government contracting activity, and current address, Procuring Contracting Officer's name, email address, telephone and fax numbers.

· Government contract administration activity and the Administrative Contracting Officer's name, and current email address, telephone and fax numbers.

· Government’s technical representative/COR, and current email address, telephone and fax numbers.

· Identify in specific detail for each contract listed, why or how you consider that effort relevant or similar to the effort required by this solicitation. In determining relevancy, consideration should be given but not limited to such things as product/service similarity, product/service, size and complexity, contract type, contract environment, division of company proposing, and subcontractor interaction.

· A narrative explanation on each contract listed describing the objectives achieved and the following data: any cost growth or schedule delays encountered. For any Government contracts which did not/do not meet original requirements with regard to either cost, schedule, or technical performance, a brief explanation of the reason(s) for such shortcomings and any demonstrated corrective actions taken to avoid recurrence.

· A copy of any cure notices or show cause letters received on each contract listed and a description of any corrective action by the offeror or proposed subcontractor.

· The offeror shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary.

· For each contract identified in L-3.3.3.2.3 (bullet 1), a Performance Risk Assessment Questionnaire must be completed and submitted. The offeror shall complete Part I of the Performance Risk Assessment Questionnaire and email the questionnaire to both the Government contracting activity and technical representative responsible for the past/current contract. The point-of-contacts (POC) shall be instructed to electronically complete Part II of the questionnaire and email the entire questionnaire to the KO, Ms. Jane Lemmon at jane.lemmon@us.army.mil, prior to the RFP closing. The Offeror shall also email to the KO a list of all the POCs who were sent a questionnaire. The Government must receive this list within 10 calendar days after release of the RFP. The POC List shall be submitted in Word for Windows Table Format to include the following fields:

· Solicitation Number;

· Company Name;

· Contract Number;

· Government Agency;

· POC Last Name, First Name;

· POC Title;

· POC Telephone Number;

· POC Email Address; and

· Date Emailed to POC (month/day).

Any questionnaires not returned directly to the KO will not be reviewed and evaluated. The information contained in the questionnaires will be used to evaluate the offeror’s past performance. If any negative past performance information is received, the offeror will be given an opportunity to provide rebuttal. A minimum of three (3) Questionnaires must be received by KO prior to the date and time established for the RFP closing. The offeror is responsible for ensuring that the KO has received a minimum of three (3) questionnaires prior to that date/time. Failure to receive the minimum number of questionnaires will be reflected in the Past Performance rating. New entities that have no past customers shall notify the KO, prior to the date and time established for the RFP closing, that they have had no previous clients and that the minimum number of questionnaires cannot be provided. Offerors without past performance history will be rated as “Neutral”.

L-3.3.3.2.4 Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this section remains with the offerors. Proposals that do not contain the information requested by this section risk rejection or a less than acceptable performance rating by the Government. In the case of an offeror without any relevant past performance history, past performance will be evaluated as “neutral.”

L-3.3.3.2.5 All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. Offerors with no past performance may provide the equivalent information on company officials and/or personnel proposed for this action. If the offeror has no relevant past performance, they will be rated as “neutral.”

L-3.3.3.3 Volume III – Small Business Participation Volume

L-3.3.3.3.1 The Offeror is required to submit Small Business Participation Plan information in accordance with DFARS 215.304 that shall include the following:

· Type of Business of Prime Contractor [check all applicable boxes]. NOTE: Small and HUBZone Small Business have already been checked for the Offerors since this acquisition is set-aside for competition amongst certified HUBZone Small Business concerns.

L-3.3.3.4 Volume IV – Contract / Price Volume

L-3.3.3.4.1 Offerors are required to submit a completed SF 1449 (including acknowledgment of Amendments), Section B, and Section K. All final monetary extensions shall be in whole dollars only. Failure to follow the below Contract / Price Proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government. The Contract / Price Volume shall be organized as follows and contain the following information:

· TAB 1 - Exceptions/Assumptions (if required): Identification and explanation of any exceptions or deviations. Additionally, any assumptions used in the proposal preparation must be identified.

· TAB 2 - SF 1449: The SF 1449 shall be submitted fully completed. The offeror is cautioned that the SF 1449 must contain an original signature in block 17 of the form. The offeror shall acknowledge any amendments to the RFP in accordance with the instructions in FAR 52.212-1 Instruction to Offerors—Commercial Items. The offeror shall provide the name, title and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

· TAB 3 - Section B (Supplies or Services and Prices): Section B shall be submitted fully completed and error free. It shall contain the offeror’s prices for the established Contract Line Items (CLINS).

· TAB 4 - Section K (Representation, Certifications, and Other Statements of Offerors): The offeror shall ensure that Section K is submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely.
