Justification and Approval Interface Assembly Test Station Repair
{$150,001 to $700,000}
DEPARTMENT OF THE ARMY
Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Army Contracting Command – Warren (ACC-WRN) (RRAD), Texarkana, TX 75507-5000 is the procuring activity for this action.
2. Description of Action: This procurement action is for a new contract. Estimated cost is
3. Description of Supplies/Services: Procurement is for repair of 1 each interface assembly (IA) test station. Test station is currently inoperable and unable to meet mission requirements. Test station shall be repaired and rebuilt.
4. Authority Cited: 10 United States Code 2304(c) (1) as implemented in Federal Acquisition Regulation 6.302-2 (“Unusual and Compelling Urgency”).
5. Reason for Authority Cited: Non-competitive procurement of the supplies and services required are necessary due to the critical nature of the subject equipment as well as the time constraints involved. Mustang Advanced Engineering (MAE) is the proposed source of acquisition of services. Current IA test station is the only test station available to support production of Interface Assemblies and is not mission capable. This item is used to support critical production requirements. Due to the test station being inoperable, RRAD is unable to complete testing of interface assemblies. MAE has previous engineering experience and expertise with the IA test station, including hardware and software. MAE is currently prepared to provide an estimated 8-10 week turnaround of the IA station repair. Any effort to obtain repair services from other sources will result in unacceptable delays due to lack of experience with this item and the engineering process involved with repair and rebuild.
6. Efforts to Obtain Competition: Effort to obtain competition is not recommended in this situation due to the critical and urgent nature of services required.
7. Actions to Increase Competition: Actions to increase competition for potential future acquisition of new Interface Assembly test stations consist of procurement of complete technical documentation of the repaired test station from MAE. Alternate sources could be potentially used in the future when less time critical acquisition requirements exist.
8. Market Research: MAE has demonstrated competency in the area of interest. Market research was conducted to identify other potential sources of necessary equipment and services.
It was determined that other sources do not possess the previous IA test station engineering experience necessary to facilitate the expeditious repair of the IA test station.
9. Interested Sources: No other sources currently possess the required expertise and previous experience necessary to facilitate repair/upgrade of test station within the time constraints of the current situation.
10. Other Facts: Attempting to obtain repair/upgrade services from other sources would result in unacceptable delays that will negatively impact critical production programs for both organic RRAD line overhaul programs, as well as supply support programs.
a. Additional Cost: RRAD is currently incurring an additional cost of per HMPT transmission due to the inoperable status of the IA test station. This is due to the need to purchase a new interface assembly for each transmission due to the lack of test capability caused by the inoperable IA test station. There are currently HMPT transmissions on schedule to support Supply, for a total additional cost of
b. Lost Revenue: RRAD is currently unable to meet the production requirements of current and scheduled IA supply programs due to the lack of IA test capability. There are currently IAs on schedule. This is resulting in a revenue loss of for scheduled programs.
c. The increased cost and lack of capability to meet production requirements could result in a reduction or cut in future workload.

13. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. RRAD will use price analysis and independent Government estimate to determine that the price is fair and reasonable. Certified cost and/or price data will not be required.
