Solicitation Q&As for W911QX16T0021

1. The requirement to provide all the components parts of the offeror’s proposed loaded hourly rates, i.e., base rate, overhead, G&A and profit/fee noted on RFP page 49 under HOURLY LABOR RATES was unexpected for a FFP‐LOE procurement, although it is normal for CPFF contracting.

We feel that this was likely an oversite and unintended, but left in place during RFP drafting.

a. The clause will be removed from the solicitation and an amendment with the correction will be issued.

2. The solicitation synopsis/ executive summary (Item C) addresses at some length the intent of the Government to impose an equitable price adjustment for failure to provide the required labor hours by qualified and Government‐approved FTEs. It is our assumption that this clause is not intended to apply to this procurement action.

a. Correct. This does not apply to this procurement action.

3. The Labor Category, Senior Ammunition Engineer, appear to be calling for 2 people that will work 800+ and 1200+ hours. Is the requirement suggesting that HUBZone small businesses should have access to resources with this skill set on a part time basis?

a. The contractor shall provide two (2) Ammunition Engineers In accordance with section C.3.1. of the Performance Work Statement.

4. The junior Labor Categories call for 20+ years of experience, with low level requirements for education. Wouldn’t these type of resources be considered “personal services” or “personnel services?”

a. The FAR defines Personal services as follows:

A personal services contract is characterized by the employer‐employee relationship it creates between the Government and the contractor’s personnel.

The Government is normally required to obtain its employees by direct hire under competitive appointment or other procedures required by the civil service laws. Obtaining personal services by contract, rather than by direct hire, circumvents those laws unless Congress has specifically authorized acquisition of the services by contract

The Government’s requirement for a Junior Analyst/Engineer with 20+ years of experience does not establish personal services. It is the relationship between the service recipient and the service provider that determines whether or not services are personal services, not the Government’s minimum experience and educational requirement.
