Control Number 10-33

Justification and Approval For Other than Full and Open Competition

1a. Contracting Agency:

U. S. Army Research, Development and Engineering Command (RDECOM) Contracting Center, Adelphi Contracting Division, CCRD-AD-CO, 2800 Powder Mill Road, Adelphi MD 20783.

1b. Requiring Agency:

U. S. Army Research Laboratory, Sensors and Electronic Devices Directorate, 2800 Powder Mill Road, Adelphi MD 20783.

2. Description of Action:

Approval is requested to solicit for a new Cost-Plus-Fixed-Fee (CPFF) type contract, with a period of performance of three (3) years, on the basis of other than full and open competition in support of the Army Research Laboratory’s (ARL) Sensor and Electron Devices Directorate (SEDD). Fiscal Year (FY) 10, FY11, FY12 Operation and Maintenance Army (OMA) funds will be utilized for this effort.

3. Description of Supplies/Services:

This acquisition is to operationalize the innovative ideas/concepts developed under the competitive Research and Development contract W911QX-08-D-0006 awarded to Booz Allen and Hamilton (BAH). The total estimated cost for this effort is $4,497,190.60.

4. Authority Cited:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1, “Only One Responsible Source”.

5. Reason for Authority Cited:

Booz Allen Hamilton (BAH) initially developed the ISR concepts and innovative ideas and currently is the only Contractor with the required expertise to implement and operationalize these concepts.

During the developmental stages of the ISR, BAH analysts reviewed data from an assimilation of inputs gained by applying them into warfare interest areas/operational problems that US forces are encountering. Current expertise encompassed by BAH will eliminate the learning curve and avoid any lapse of progression to allow for continued development based upon their in depth familiarity of the concepts that the Army want to operationalize. To date, no other source possess this internally based advantage except BAH.

6. Efforts to Obtain Competition:

Effective competition is not anticipated for this procurement. BAH has been the sole incumbent in the research and development of the ISR concepts which the Government utilizes in threat detection environments. The risk associated with exposure of these concepts to outside sources would jeopardize the current level of surveillance by choosing to pursue full and open competition at this time. The government would also be subject to increased program and scheduling risks associated with seeking another firm that would have the capability to accurately execute BAH’s concepts to be fully successful at meeting the Government’s requirements. Thus continued pursuit of R&D analysis with a firm that Government knows they can fully implement and operationalize the ISR concepts will allow for current pace continuation development without risking broadening warfare awareness in an environment that allows for no downtime and is in the best interest of the Government to pursue continuity at the vast increased pace of development that is current with the Army’s mission standards.

7. Actions to Increase Competition:

ARL is actively seeking future competition and anticipates further development identifying ISR techniques for operational application. ARL has an open Broad Agency Announcement (BAA) which continuously attempts to explore new concepts and is willing to invest in sources with creditable ISR techniques. Any companies other then BAH who supply proposals to operationalize concepts similar to those which BAH developed will be fairly given consideration under this BAA.

8. Market Research:

The Government initiated a competitive BAA, number W911NF-07-R-0001-04, advertising for the development of innovative ISR concepts to provide users full operational awareness. BAH was the only firm to submit a white paper in response to the BAA back in 2008. Contract W911QX-08-D-0006 was awarded to execute an effort which monitored progress in the field of ISR and to identify potential vendors of ISR systems, tools, and sensors through internet research, conferences, and briefings from vendors in the area of ISR. There is no other source that can implement these concepts and meet the requirements currently met by BAH.

9. Interested Sources:

As required per FAR 5.201, this proposed contract action was transmitted to the Government Point of Entry (GPE) (FedBizOpps.Gov) on 18 May 2010. Two (2) inquiries from interested sources were received between 19-20 May 2010, one (1) verbal inquiry from CSCI, Inc. and one (1) email inquiry from Syracuse Research Corporation (SRC), Inc. However, neither company continued to provide formal responses to the presolicitation synopsis by the submission deadline.

10. Other Facts:

a. Procurement history:

The ISR concepts that are being made operational in this effort were originally developed under contract W911QX-08-D-0006.

(1) Contract numbers and dates of the last several awards.

W911QX-08-D-0006 awarded 30 April 2008

(2) Competitive status of these actions.

W911QX-08-D-0006 was competitively awarded under ARL’s BAA W911NF-07-R-0001-04

(3) Authority previously used for less than full and open competition.

N/A

(4) If a justification was prepared to support the procurement made before this one, a summary of the contents of paragraph 7 of the justification for that procurement and an explanation of the results.

N/A

(5) If any prior award was accomplished by full and open competition, a detailed explanation of the changed circumstances.

BAH was awarded contract W911QX-08-D-0006 for their research and development of ISR concepts. Now, their research has reached a point where it can be operationalized and only BAH has the capability to integrate their developed concepts.

(6) An explanation of any unusual patterns which may be revealed by the history; e.g., several consecutive, urgent buys.

No unusual patterns are evident in the procurement history.

(7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the buy and whether there have been any significant changes.

N/A

b. Acquisition Data Availability:

Once acquisition data has been approved for release by BAH; their specifications for ISR integration can be provided/included in future requirements seeking full and open competition.

c. Unusual and Compelling Urgency:

N/A

d. Subcontracting Competition:

BAH has an approved purchasing system and a subcontract plan will be required by the Government.

e. Follow-on Contracts:

This effort is a new contract utilizing the ISR concepts developed under contract W911QX-08-D-0006. The intent is to operationalize these ISR concepts.
