SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been added by full text:

13.

13. Exclusion from Participation in Federal Health Care Programs (October 2015)

13.1. The Contractor shall not employ or contract with any individual or entity (hereinafter collectively referred to as “person”) to provide items or services that will be included in invoices submitted to the Government under this contract if such person is listed on the Department of Health and Human Services (HHS) Office of the Inspector General (OIG) List of Excluded Individuals and Entities (LEIE) or the TRICARE Sanctioned Provider List. The Government is legally prohibited from paying for provision of items or services by such persons. The prohibition extends to services beyond direct patient care, such as services of persons in executive or leadership roles and administrative and management services, whether or not such services are billed separately. The LEIE may be found at http://oig.hhs.gov/fraud/exclusions.asp, and the TRICARE Sanctioned Provider list at http://www.health.mil/Military-Health-Topics/Access-Cost-Quality-and-Safety/Quality-And-Safety-of- Healthcare/Program-Integrity/Sanctioned-Providers. The LEIE and TRICARE Sanctioned Provider List are hereinafter collectively referred to as “the Lists.”

13.2. Prior to start of contract performance, the Contractor shall (a) query the Lists to determine whether the name of any person the Contractor employs or contracts with to provide services or items for which payment may be made under this contract appears on the Lists, and (b) certify to the Contracting Officer that the Contractor has queried the Lists and no such names appear on either of the Lists.

13.3. During performance of the contract, and prior to persons other than those whose names were queried in accordance with paragraph 2, above, (hereinafter “new persons”) providing services or items under the contract, the Contractor shall (a) query the Lists as in paragraph 2, and (b) certify to the Contracting Officer that the names of such new persons do not appear on either of the Lists.

13.4. The Contractor is advised that during performance of the contract, MTF personnel will periodically recheck the names of contractor personnel working in the MTF against the Lists. The Government will notify the Contractor in the event names of any contractor personnel working in the MTF appear on either of the Lists.

13.5. Should the name of any person providing items or services under the contract appear on either of the Lists at any time during contract performance, the Contractor shall promptly remove that person from the contract.

13.6. Violation of any aspect of the above paragraphs shall be considered a material breach of the contract and may result in termination of the contract.

13.7. The Contractor is further advised that, in accordance with Civil Monetary Penalties Law [CMP] (codified at 42 USC § 1320a-7a):

a. There are steep civil monetary penalties associated with billing the Government for providing items or services by a person on either of the Lists, and with failing to return to the Government any overpayments received for provision of such items or services.

b. Billing under the contract for provision of items or services by a person on either List may also result in exclusion of the person that employs or contracts with such person.

13.8. HHS OIG has issued a Special Advisory Bulletin on the Effect of Exclusion from Participation in Federal Health Care Programs with additional information on the CMP. The Special Advisory Bulletin may be found at http://oig.hhs.gov/exclusions/files/sab-05092013.pdf.

QUESTIONS AND ANSWERS

Q.1 Can you tell me if these services are currently being performed by a contractor? If so, could you please provide the incumbent name as well as the contract number?

A.1 Currently there is no contract being performed for these services.

Q.2 Is this a new requirement and if not who is the current contractor providing the services, what is the contract and the contract value?

A.2 See A1.

Q.3 If this is not a new requirement, can you please provide a break down of the personnel between US and Local National Citizens?

A.3 See A1.

Q.4 Is this a new requirement or is there an incumbent vendor? If available, can you please send along the incumbent contract number?

A.4 See A1.

Q.5 Can you please tell me if this is a new requirement? If not, who is the incumbent, and what is the contract number?

A.5. See A1.

Q.6 Ref PWS para 1.1.1 – Will the contractors initially work at Husterhohe Kasern and then be required to transition/re-locate to Kaiserslautern Army Depot?

a. If so, when is this move anticipated?

b. When this relocation occurs, will the government consider providing a relocation allowance for those contractor personnel needing to move in order to support this transition to KAD?

A.6 Yes. a. The estimated time is no earlier than 1 April 2019, and is subject to change. b. No relocation allowance will be provided. Locations are within the commuting area.

Q.7 Ref PWS para 1.5 and 7.3.6 # 9. – Many of the contract employees we intend to hire are currently employed with other local companies or are presently located in the U. S.. German labor law requires Local Nationals (LNs) to give local employers 30 days termination notice and relocating personnel from the U.S. also typically takes 30 – 60 days. Will the Government consider providing a 30 day ‘Phase-In’ from task order award date before holding us to the fill rate requirements, especially given the limited time from offer due date (17 Sep) and subsequent contract award to period of performance expected start date of 25 September 2018?

A.7 Please refer to the Adendum 52.212-1 & 52.212-2, Subfactor 3 regarding fill rate.

Q.8 Ref PWS para 1.5 and 7.3.6 # 9. As this is non-personal services, we would hope to have the flexibility to provide the requested hours by staffing the requirements as we deem most beneficial. Are the requirements based on fulfilling the hour requirements OR the exact number of personnel specified in the CLIN? In other words, can we have for example, two part time Warehouseman who together provide the required 1674 hours of service for one Warehouseman position during the performance period?

A.8 Each CLIN states the exact number of FTE’s and hours requireed.

Q.9 As BMETs are included as one of the specialties specifically authorized SOFA status/Logistical support under Art 72 of the Supplementary Agreement of the NATO Status of Forces Agreement, will the government consider adding this authorization to the contract?

A.9 This contract doesn’t fall under DOCPER approval requirements.

Q.10 Ref 52.212-2 Evaluation Factor I – Technical Subfactor 3: Phase In - Given there will be less than a total of 8 calendar days from offer due (17 Sep) date to expected period of performance start date (25 Sep), it is not feasible or reasonable to be able to ‘commence full performance of service (assuming the requirement is to have all 13 positions filled and available) on the contract start date (25 Sep). Will the government consider allowing a 30 day ‘Phase – In’ before requiring ‘full performance’?

A.10 See A.7.

Q.11 Ref 52.212-2 Evaluation: FACTOR III – Price: (pg 75): Will the Government please provide the referenced ‘Sample format’ (Appendix A) for submission of a compensation plan?

A.11 Yes, the Sample Compensation plan will be attached on the Amendment.
