FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S. Army Contracting Command Aberdeen Proving Ground (ACC-APG) 10205 Burbeck Road, Building 362 Fort Belvoir, VA 22060-5811

2. Description of Action: Program Executive Officer, Intelligence, Electronic Warfare and Sensors (PEO IEW&S), Project Manager Terrestrial Sensors (PM TS), and Product Manager Ground Sensors (PdM GS) requests a Firm-Fixed-Price (FFP) contract with Geodetics, Inc at 2649 Ariane Dr. San Diego, CA 92117. The Government projects award for March 2018, and fiscal year 2018 Other Procurement Army funds will be used.

An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

The proposed Period of Performance supports the action for a single award one (1) year and one (1) option year.

The estimated award will have a Total Value of .

3. Description of Supplies/Services: This procurement is a new effort to provide an upgraded capability to the VOSS system. This is a definitive requirement to obtain 340 GPS devices. These devices will provide upgraded GPS functionality to all fielded VOSS systems and add specific location coordinates to targeted information identified by a VOSS. This is a commercial item and no separate service or maintenance is required for the items. The use of this system will provide a higher capability to locate and affix GPS data to items (threats, items of interest) identified by the VOSS system.

4. Authority Cited: 10 U.S.C. 2304(c)(5) as implemented by FAR 6.302-5(b)(7) -- Authorized or Required by Statute for the WOSB Program-15 U.S.C. 637(m).

5. Reason for Authority Cited:

(a) As described in FAR 6.302-5, full and open competition need not be provided for when a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source, or the agency’s need is for a brand name commercial item for authorized resale. The WOSB Program-15 U.S.C. 637(m) provides that purchases under $6.5M may be made directly to a single source for production quantities under NAICS 334511 Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing. As discussed in the Market Research section of this document, a sources sought notification was posted to FedBizOpps and two responses were received, one from a large business, and one from nicholas.c.glad Highlight nicholas.c.glad Highlight nicholas.c.glad Highlight nicholas.c.glad Highlight

a WOSB, Geodetics, Inc. Full details of the market research can be found in the market research paragraph. Geodetics has a fully compliant product meeting the Governments requirements and the capability to produce the quantities required by the Government.

The other respondent did not present an item that met all Government requirements, and indicated development work would be necessary.

In accordance with FAR 19.1506(b), the acquisition is assigned a NAICS code in which SBA has determined that WOSB concerns are substantially underrepresented in Federal Procurement. In addition, based on the market research, the Government does not have a reasonable expectation that offers would be received from two or more WOSB concerns, nor Economically Disadvantaged Woman Owned Small Business (EDWOSB) concerns. In accordance with FAR 16.1506(c) the anticipated award price of the contract, including options, will not exceed $6.5 million for the requirement, which uses a NAICS code for manufacturing. In addition, market research supports that Geodetics can provide an item meeting the Government’s requirement, is registered in the System for Award Management, is not excluded from federal procurement, and has no negative proceeding information as registered in the Federal Acquisition Procurement Integrity Information System (FAPIIS). Based on this Geodetics has been determined to be a responsible contractor with respect to performance. Finally, this item is considered commercial and adequate other than certified cost or pricing data is available. Therefore award can be made at a fair and reasonable price.

(b) The VOSS system is a commercial item sold by Lockheed Martin GyroCam Systems, however, the Government determined that the GPS receiver could be procured by an alternative source. Alternate acquisition approaches were considered. An unrestricted full and open competition was considered to allow the large business to compete.

However, it was determined that a sole source award to the known WOSB was the best approach as market research supports that Geodetics, Inc., a WOSB, is capable. In accordance with FAR 19.1506 the SBA has the right to appeal the Contracting Officer’s decision not to make a sole source award to a responsible WOSB concern capable of performing the effort and eligible under the WOSB Program. It is not possible to obtain this product using in-house personnel/expertise.

6. Efforts to Obtain Competition: The Contracting Officer will publish the notice required by FAR 5.201 and any bids or proposals received will be considered.

a. Effective Competition: Because this is a sole source action, authorized by FAR 19.1506(b), effective competition is not applicable.

b. Subcontracting Competition: The item being procured is a commercial item with established manufacturing lines. The contractor is subject to the competition in subcontracting clause at 52.244-5.

7. Actions to Increase Competition: No actions are currently planned to increase competition. If future needs for this item are required market research will be performed to determine if other WOSB, or different subsets of small business concerns including veteran owned small businesses, small disadvantaged businesses, or subcontractors available under the Small Business Administration (SBA) Section 8(a) program are available to increase competition under a competitive small business set aside.

8. Market Research: A sources sought notice was posted to Federal Business Opportunities on 13 December 2016 for 31 days. This sources sought contained seven performance characteristics and requested that all vendors with a product conforming to these characteristics provide a complete and detailed description of its items.

Two responses were received, one from Geodetics Inc (WOSB) and one from (large business). After reviewing the capability statements of the items detailed the Government found Geodetics’ item to be compliant with all requirements of the RFI without development. All Performance Characteristics and Mil-Standards were met to include use of the Government Off the Shelf (GOTS) standard GB-Gram card required to sufficiently encrypt GPS data. product was non-compliant with regards to the GB-Gram card, offering a contractor owned unique card that will not accept Type II M- Code cards when available. To become compliant requires development costs to meet the requirement. provided a roadmap to achieve the M-Code compliance for their boards, but the card would still not conform to a Type II form factor.

was compliant with all other performance characteristics and Mil standards required by the RFI. Based on this it was determined that Geodetics was the only respondent to be capable of performing the effort. In addition, Geodetics is a WOSB and therefore eligible for a sole source award for this product under the WOSB Program.

9. Interested Sources: See Paragraph 6 for the synopsis information. To date, no other sources have written to express interest in the acquisition.
