4. Contractor Name Qiagen, LLC.

5. Description of Supplies/Services AFMES Deoxyribonucleic Acid (DNA) Identification Laboratory (AFDIL) has a requirement to maintain software and network licenses; additionally maintenance and support for Qiagen, Inc. The technical support and software maintenance includes system upgrades. AFMES would like to combine all contracts supporting licenses and maintenance and support into one contract. This requirement will start with a base year and four subsequent option years. The purchase of the software and maintenance is required per Risk Management Framework (RMF) which ensures continued support of the mission of the AFDIL within AFMES.

6. Authority Cited: 41 U.S.C. 1901 OR 41 U.S.C. 1903

(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 13.501(a)(1)(i): Only one source reasonably available (including brand name); OR

(d) FAR 13.501(a)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item.

7. Reason for Authority Cited Qiagen, Inc. is the sole manufacture and distributor of the Genomics Workbench software and maintenance. AFMES implemented this software and continued the maintenance and support throughout the years. To date, the Government has invested over $465,000.00 into the Genomics Workbench software. In addition, the Government has exhausted the past six (6) years of manpower hours in utilizing this software platform. It is imperative Qiagen continues to being the vendor who maintains the Genomics Workbench platform; the software and maintenance due to the dollars and time invested. The costs in dollars spent and manpower the Government would incur to utilize a new platform would not be practical.

Qiagen is the Original Equipment Manufacturer (OEM) and is the only authorized party to provide maintenance to their Genomics Workbench Software.

8. Efforts to obtain Competition Competition cannot be achieved with this requirement based on the market research conducted by the Government. Qiagen Inc., is the only source available in the marketplace to satisfy this requirement.

Qiagen Inc. does not partner with third-party resellers for the CLC Genomic Workbench and Genomic Server products included in the enterprise Genomics Factory solution used for molecular biology research and next generation sequencing analysis.

a. Effective competition. As previously stated, market research has revealed Qiagen, Inc. is the sole manufacturer and there are no third-party authorized resellers.

b. Subcontracting competition. Not Applicable.

9. Actions to remove or overcome barriers Competition The Government will continue to survey the marketplace to determine if there are other authorized resellers of the Qiagen CLC Genomic Workbench software and maintenance. If the Qiagen CLC Genomic Workbench software and maintenance become available under the Computer Enterprise Software and Solutions (CHESS) which is the Army’s mandatory source for commercial Information Technology (IT) products, a Request for Quote will be released. In addition, the Government will continually monitor the Industry to determine if there are new sources in the open marketplace capable of providing the CLC Genomic Workbench software and maintenance support.

10. Market Survey:

Based on Market Research, Qiagen, Inc. is the only source available in the marketplace to satisfy AFMES requirement for the CLC Genomics Workbench software and maintenance. Market research included searches on the internet and previous contract history. No other company is able to provide maintenance as they have no authorized third parties to perform this service.

11. Interested Sources To date no other source has expressed an interest in the acquisition.

12. Procurement History and any other facts:
