About this file
This amendment to a solicitation modifies the terms for a surgical sterilization container system procurement. The Army Medical Command seeks pricing for a container that meets the salient characteristics. Offerors must demonstrate compliance via capability statements, literature, or other materials. Pricing must be submitted per unit and extended for the quantities specified, and be determined fair and reasonable through price analysis. Technical submissions will be rated acceptable if the container matches all requirements, or unacceptable if any are not met. The amendment incorporates representations regarding telecommunications equipment and prohibits certain types. Offerors must verify completion of the telecommunications representation in SAM or by return. Responses are due by the amended deadline of August 12, 2020 to the specified contracting officer via email.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
Award will be made to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
Paragraph (a) is hereby replaced with the following:
1. Technical Capability. The following adjectival ratings will be used in evaluating the offeror’s technical quote:
Acceptable – To receive this rating, the offerors product shall meet the salient characteristics set forth in the solicitation.
Unacceptable – An unacceptable rating will be assessed on any offeror that presents items that demonstrate any or all of the following:
a. Failure to meet each of the salient characteristics set forth in the solicitation.
b. Failure to provide sufficient detail for the Government to determine whether the itemn satisfactorily meets the requirements of this solicitation and each CLIN.
c. Failure to provide all items listed in the price list. If an offeror does not provide a price for an item, it will be construed to mean the offeror does not provide the item or an alternate, and thus, not eligible for award.
2. Price. Pricing must be determined to be fair and reasonable. Price will be evaluated using the price analysis technique and procedures in accordance with Federal Acquisition Regulation (FAR) 15.404-1(b) namely, comparing the offered price with the government's market research and Independent Government Cost Estimate.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c) Section C of Exhibit__ 52.204-26 must be completed and returned or verify 52.204-26 has been completed with online Reps and Certs to be eligible for award.
