FACTOR 1. TECHNICAL CAPABILITY (VOLUME II)
All parts of the technical capability (Volume II) shall be addressed in sufficient written detail for the Government to determine if the offeror understands each aspect of the Government’s requirement. Statements that the offeror understands, can or will comply with all specifications, or statements paraphrasing the specifications of parts thereof, or phrases such as ‘will comply with requirement”; “standard procedures will be used” or “well-known techniques will be used” will be considered unacceptable. Insufficient explanations may result in your offer receiving an UNACCEPTABLE rating.

FACTOR 2. PAST PERFORMANCE (VOLUME III)
2a. Past Performance Questionnaires are due by the solicitation closing date specified due date of Saturday 12PM CST, 28 September 2019. The Government may begin surveying references immediately after the solicitation closing date; therefore, it is crucial that offerors immediately authorize their references to release information to the Government. It is the offeror’s responsibility to ensure the reference submits the PPQ for consideration. Further, PPQs will only be considered when submitted directly by the reference, and not from or via the offeror. (An individual may choose to have their references submit a letter instead of filling out the PPQ, but the letter shall evaluate the individual on the same criteria as that identified in the PPQ.)
2b. The Government may also consider any additional information from its own files, databases such as the Contractor Performance Assessment Reporting System (CPARS), or from any other source, it deems appropriate.
The Government will not be responsible for tracking incorrect references and phone numbers, or those PPQs not submitted by the due date as reference above in paragraph 1. Offerors are reminded that, while the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete past and present performance information rests with the offeror.
FACTOR 3. PRICE (VOLUME IV)
3a. Submit total proposed pricing for each base Contract Line Item Numbers (CLIN) only for base plus all option years on the 1449 form (original solicitation). Offerors shall use the revised attached Excel spreadsheet titled “Price List” to fill quote on 1449 for base only (use quote tab only) to fill detailed information regarding price list per each garment and total amount in quote tab in addition to. Offeror shall also provide their own price list (may use their own list or the sample “W81K00-19-Q-0264 Price List” tabs. All price lists shall be submitted in Microsoft Excel format. The pricing of each garment shall be separated (custom and off-the-shelf) and shall include a description of what is included in each garment (ex: glove to wrist, elbow to wrist etc.,). For custom made garments, any additional fees such as markings, cooling pads, zippers, grippers, darts, silicone padding for step off’s, etc., shall be included as a separate price list. Otherwise, offerors shall include a statement that the pricing is inclusive of all items for both (interim garments (off-shelf and custom fit) such as fitting fee, and all other additional fees items as described herein.
The attached Excel spreadsheet "Price List" is provided to assist offerors with proposals. Offerors shall use this price list (or vendor’s own) to calculate the total pricing for tab “Quote” and use the amounts to fill out all CLINs the base CLIN on solicitation form 1449. Offerors are required to provide a price for either all off-the-shelf items listed or all the custom made garments (or both) on the “Quote” tab of the Excel spreadsheet that is uploaded with this amendment. The items on the remaining tabs are only intended to give an idea of what the Government is looking for, but shall not be construed to mean an all-inclusive list. The “Price List” has four tabs (quote, workload data sample, price list, other options & accesories) and all tabs (except for “workload data sample) shall be filled out on the spreadsheet. The total amount shall then be placed on the 1449 under the corresponding CLIN. Unit price shall be rounded to the nearest decimal point. Questions on this process will be referred to the cognizant Contracting Officer identified in the solicitation.
(m) The non‐FAR Part 12 discretionary FAR and DFARS provisions included herein are incorporated into this solicitation either by reference or in full text. If incorporated by reference, see provision 52.252‐1 herein for locations where full text can be found. .
(End of addendum)
ADDENDUM TO 52.212-2
ADDENDUM TO 52.212-2 – EVALUATION OF OFFERS
Award will be made to the responsible offeror(s) on the basis of a fair and reasonable price while also providing a quote that is technically acceptable for non-cost factors. Award maybe made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
Paragraph (a) is hereby replaced with the following:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote, conforming to the solicitation, is Lowest Price Technical Acceptable (LPTA). Award will be made on an all or none basis. The Government will award at least one, and potentially multiple, Blanket Purchase Agreements (BPAs) resulting from this solicitation to the responsible offeror(s) whose quote(s), conforming to the solicitation, is both technically acceptable and presenting a price that is determined fair and reasonable by the Contracting Officer.
BPAs may be awarded for off-the-shelf or custom garments or both.
The following evaluation criteria will be used to evaluate offers:
Factor 1. Technical Capability:
Subfactor 1a. Statement of Objectives Compliance
Subfactor 1b. Garment Samples (pinch test, snug, tight, no wrinkles test on a glove to wrist, medium size, female, tan color).
Factor 2. Past Performance.
Factor 3. Price
Note: A rating of Acceptable must be received on each of Factors 1 and 2 in order to be considered for award.
Except for communications conducted for the purpose of minor clarification, the Government intends to evaluate the proposal and award a contract without discussions. Therefore, the proposal should contain the offeror’s best terms from a technical capability, past performance, and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary.
Factor 1. Technical Capability.
Technical capability ratings reflect the Government’s confidence in each quoter’s product, as demonstrated in its submission, to meet the Statement of Objective (SOO) set forth in the solicitation. The Government will make an independent judgment of the acceptability. To receive consideration for award, a rating of no less than Acceptable must be achieved on each Subfactor in the technical acceptability.
The following adjectival ratings will be used in evaluating each offeror's technical capability quote:
a. Acceptable – An Acceptable rating will be assessed on any offeror whose quote clearly meets the requirements listed in each technical factor/subfactors “1a” and “1b”
b. Unacceptable – An Unacceptable rating will be assessed on any offeror whose quote DOES NOT meet the requirements listed for each factor/subfactor “1a” and “1b”.
NOTE: In order to receive an overall "Acceptable" rating for Factor 1, Technical Capability, subfactors "1a." and “1b” must each receive an "Acceptable" rating. An "Unacceptable” rating in either subfactor will render the entire Factor 1, Technical Capability "Unacceptable" and thus ineligible for award.
Factor 2. Past Performance.
The following adjectival ratings will be used to determine degree of performance risk associated with the proposal:
a. Acceptable – Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
b. Unacceptable – Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note 1: In case the offeror does not have a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Note 2: The government may also consider any additional past performance information available, to include the
Past Performance Information Retrieval System (PPIRS).
Factor 3. Price.
The Government will evaluate quotes once it has received an “Acceptable” rating on Technical capability and Past Performance. In order to be considered for award, the quote must be determined to be fair and reasonable. A quote unrealistically low in price may be grounds for eliminating it and will be determined by the Government to be indicative of failure to be consistent with the offeror’s written technical capability approach or failure to comprehend the complexity and risks of the proposed contractual requirement.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). Blanket purchase agreements (BPAs) are now contemplated by this solicitation, with a five-year ordering period. The price list(s) submitted with the offer must be valid for at least 12 months. If awarded a BPA, a BPA-holder may request to submit a revised price list (either with new items, new pricing, or both) for Contracting Officer consideration. Such a price list may be submitted no more frequently than an annual basis.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
End of Addendum to FAR 52.212-2
(End of Provision).
QUESTIONS AND ANSWERS
QUESTIONS AND ANSWERS
CUSTOM GARMENTS AND OFF SHELF GARMENTS
SOLICITATION AMENDMENT 0003
1. Please let me know if there is more paperwork to complete for this solicitation.
A. Please refer to the updated solicitation instructions “Addendum to 52.212-1 Instructions to Offerors” starting on page 3 of this document.
2. How long is the contract for?
A. As per Delivery information on solicitation, a five-year ordering period is contemplated.
3. When will the contract be awarded?
A. Estimated date of award is within 30 days of the solicitation closing.
4. Female Tan Capri and Male Tan Capri (S, M, L , XL) We manufacture Capri styles but they are unisex with closed and open pubis options? For this purpose, should we price open pubis for the female and closed for the male line items?
A. Offerors should provide their own price list, identifying all items that would be used to construct all off-the-shelf and custom-fit burn garments (e.g., a sleeve, accessories such as zipper, velcro), etc. The price list should be provided in Microsoft Excel format. The intent is for the offeror’s price list to contain all possible items that could be used on any garment that would be worn by a burn patient, so that items can be “mixed or matched” as appropriate to patient need.
5. Silicone-bonded Textile sleeve 11 inch. Are these for arms or fingers?
A. Fingers – Digital sleeves; however, if vendor has another name for similar product please describe it.
6. Custom Upper trunk to waist. Is this a sleeveless vest or a torso band?
A. An upper torso garment, this is a front zipped upper garment with capped sleeves. However, if vendor has a different name for similar product please describe it.
7. Do you have any addition information on the sleeve w/fabric R to L? We have sleeves that are fabric but we need to understand the R to L component in your description.
A. This is referring to a sleeve that compresses the deltoid and axilla region and wraps around the torso without utilizing a vest. This garment can either to L to R or R to L.
8. Custom Lower trunk panty. Is this a panty girdle style or brief style? We have both of those styles available at different pricing.
A. The item listed is brief style; however, offerors may include both styles – as well as any other styles – on their price list. This includes off-shelf and custom garments.
9. It says that this solicitation is for a DME but we are a SDVOSB manufacturer.
A. This item has now been deleted from the Statement of Objectives (SOO).
10. We do supply personnel in other facilities that work clinic days and do the measuring and fitting, or we can train personnel to do so.
A. We require a burn garment fitter to arrive on the unit within 90 minutes during business hours
(Monday – Friday, 9:00am – 5:00pm, excluding holidays). Government employees will not be responsible for measuring or fitting the garments.
11. We could also subcontract it with one of our customers that does not have a SAM # but would be willing to provide the fitter and trainer.
A. It is acceptable to subcontract; however, the prime contractor bears all responsibility for executing the requirements of the contract.
12. On the spread sheets that are provided under Custom Garments pg#2, bottom of the page you are asking for a Item # for Custom Sleeve w/ fabric R to L. I need more information on that item. I don’t know if you are asking for a sleeve with expansion panels or what. There is no item number for a combined product because an expansion panel is an assessor item.
A. This is referring to a sleeve that compresses the deltoid and axilla region and wraps around the torso without utilizing a vest. This garment can either to L to R or R to L. However, offeror can submit their own product line price list with garment description that is being sold commercially. This includes off-shelf and custom garments.
13. Under Statement of Objectives Line Item H. You have asked for a Certification through the BOC & ABC, I cannot find any certifications with those organizations. I called and talked to both agencies and was told by them that there is no certification from them pertaining to compression burn garments. Could you please provide the information where you found this requirement for certification. We have not been able to locate such a certification. The only thing that is listed under Orthotics is the Medical billing codes. Please provide where that requirement is found.
A. This item has now been deleted from the SOO. We will accept certification through any burn garment manufacturer to that demonstrates the proposed garment fitter(s) are well trained on how to do correct measurements on burn patients.
14. I have a question on how we do the contract pricing. When pricing the contract I can price the contract for the first term (12 months) with no issue. For the rest of the extensions if awarded to us, will we be able to adjust pricing at that time for each extensions? If not then the current pricing for the first time frame will have to include pricing adjustments for the full 60 months. Can you please address this issue as soon as possible. The average price adjustment for each year from the manufactures is 6%-7%.
A. Blanket purchase agreements (BPAs) are now contemplated by this solicitation. The price list(s) submitted with the offer must be valid for at least 12 months. If awarded a BPA, a BPA-holder may request to submit a revised price list (either with new items, new pricing, or both) for Contracting Officer consideration. Such a price list may be submitted no more frequently than an annual basis.
15. Would you consider awarding to two or more vendors to get Off-the-shelf garments from one company and custom garments from another company? I can’t provide the garment fitter, but I can provide you with Off-the shelf garments and custom garment pricing without garment fitter.
A. Custom garments need to have a garment fitter that can arrive within 90 minutes. However, if offeror is not able to provide the garment fitter within the 90 minutes required, then offeror can still provide off-the-shelf garment pricing which will be considered for an award of a Blanket Purchase Agreement.
