4. Authority Cited: The authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii)(a), entitled “Only One Responsible Source, and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Reasons for Authority Cited:
The proposed acquisition requires the use of the cited statutory authority for the following reasons:
a. The proposed acquisition is limited to Rockwell Collins Simulation and Training Solutions LLC, 600 Komas Drive, Salt Lake City, Utah 84108, CAGE Code 00WX8.
b. Unique qualifications: This procurement is for the engineering development and logistics sustainment support services for the Longbow Crew TDS and conversion of the Geospecific databases. The conversion tools and data necessary for this effort were not procured with the development of the GDS and data are the intellectual property of Rockwell Collins.
c. There is an immediate need for the development and integration of EP8000 Image Generator compliant database suites and to support the upgrade and conversion of previously developed EPX5000 compliant databases to the EP 8000 IG configuration with the aircraft software V13.1 and Manned-Unmanned Teaming capability within the LCT fielding in calendar year 12. Rockwell Collins has teamed with and provides the IG hardware and IG real-time software for the LCT Modernized Target Designation System (MTADS) and Modernized Pilot Night Vision System (MPNVS) solution unique and specific to the LCT.
Rockwell Collins is the only source provider for the EP8000 Image Generator (IG) hardware, the IG real-time software, and the database software development tools to generate virtual databases that are EP8000 compliant. Integration support and tuning of this product requires intimate knowledge of the proprietary design of the files and component properties that have been generated by Rockwell Collins. Tuning the components of the product requires knowledge of the integration requirements of the Longbow Crew and the proprietary RealTime software as exclusively developed by Rockwell Collins for the Longbow Crew Trainers with MTADS software upgrades. They have the experience and technical expertise with the design and manufacture of the system. Rockwell Collins provided the initial ESIG 5530 IG to the Multiple Year II (MY II) LCT fleet and was selected at LCT 24 and subsequent as the EPX 5000 IG source provider during completive demonstration. Currently, 17 Government LCTs are fielded with EPX 5000 IG. Rockwell Collins is providing 19 EP 8000 IG for the remainder of the fielded LCT and five new build LCTs. The EP 8000 IG was selected as the ESIG 5530 replacement to address performance and obsolescence. The EP 8000 uses the current LCT Host to IG hardware and software interface and provides additional capability required to meet the unique IG hardware and software for the LCT virtual environment and MTADS/MPNVS solution. No other company would be able to provide the expertise gained during the LCT development process in a timely manner to maintain continuity and affordability. The Government is anticipating host to IG integration refinements to convert and integrate these Geospecific databases; therefore, the Government will require immediate delivery of these Geospecific databases in order to mitigate any delays in fielding or its ability to train the Warfighter on these improved capabilities. Delay in action or selection of other than Rockwell Collins for this effort shall provoke additional integration and delivery risk to the field of V13.1 capable LCT to the Warfighter and limit the tactical readiness and combat effectiveness of the aircrews.
d. All the technical data necessary to perform this effort are not available nor are in a suitable format to allow competition at this time. Rockwell Collins owns the intellectual property and will not consider selling it to the Government. The Government does not possess all the required data and does not plan on acquiring the technical data. However, a review was conducted as to the approximate cost and time line required to qualify an alternate source, if the technical data was released, and it was concluded that the approximate total cost would be with a time line of 68 months. This requirement is immediate and the testing and evaluation required to qualify any other sources could not be accomplished within the customer’s required delivery time frame. Development of EP 8000 compliant databases and conversion of previously developed EPX 5000 databases into the EP 8000 database for the LCT requires the knowledge of how the aircraft sight systems are simulated and how the weapons and navigation system are used operationally. Rockwell Collins possesses this experience and technical expertise.
6. Efforts to Obtain Competition: Pursuant to FAR 5.201, a synopsis will be published in the Army Single Face to Industry/FedBizOpps on 19 December 2012 stating that the ACC-RSA intends to procure the services consisting of engineering development and logistics sustainment efforts from Rockwell Collins. Based on the factors stated above, no additional competition is expected as a result of this synopsis. The opportunity for competition is not expected. The Government will encourage Rockwell Collins to seek and utilize small business and small disadvantage business concerns whenever possible.
7. Actions to Increase Competition: The Apache Attack Helicopter Project Manager’s Office (PMO) has found no other contractor that possesses the detailed technical information required to perform the LCT effort for the AH-64D helicopter. The PMO maintains continuous surveillance of domestic suppliers, foreign suppliers, and cost effective opportunities for joint developments with other United States military or foreign military services. There are no domestic, foreign commercial, or Government sponsored programs which have, or are in the process of developing, technologies that approach the capability of the existing CORE Database Conversion. No viable competitive alternative exists for this requirement, as Rockwell Collins is the only source possessing the required technical data, corporate, and conversion tools and knowledge required to perform this effort. Future acquisition will be reviewed to ascertain feasibility of competition; however, other offers are not anticipated.
8. Market Research:
a. A Market Research Report, as defined in FAR, Part 10 was conducted. This requirement was published in the Competition Advocate’s Shopping List on 22 August 2012 and revised 19 December 2012. The conclusion of the report indicates that due to the uniqueness and complexity of the AH-64D aircraft there are no other source currently available to perform the required tasks to meet the requirement. Since Rockwell Collins is the sole developer and has the proprietary data for the CORE Database, the engineering expertise does not currently exist elsewhere. As a result, it is determined that no other sources are available to meet the UGS requirement and no commercial sources are equivalent. Therefore, FAR 12 procedures will not be utilized for this acquisition.
b. Multiple techniques were used to conduct this market research. The personnel in the Apache PM Office who were responsible for procuring the previous database conversions services contract were consulted for their personal knowledge in procuring this type of service.
Industry personnel who performed this specific type of service were consulted and several discussions were held on this type of procurement effort through July 2012. Market research was performed by LCT Operator Development Lead, Training and Training Devices Branch, Logistics Division, February – July 2012; Procurement Analyst, Apache Acquisition Branch Office, June 2012; Senior Analyst DCS, Apache Training and Training Devices Branch, March – July 2012. Also, the research consisted of contacting knowledgeable persons in industry:

Review of recent market research for similar or identical supplies/services was conducted to include EBII Longbow Extended Block II LBA Remanufacture V.13.2, September 2011, Contract .
c. Market research is continuously conducted at AMCOM through the source approval process that is published on the internet at the Competition Advocate’s homepage. New sources are encouraged to submit a Source Approval Request for consideration.
9. Interested Sources: To date, no other potential sources have written to express interest in the proposed acquisition. Rockwell Collins is the only known contractor who can satisfy the Government’s requirement. However, as a result of the published synopsis notice required by FAR 5.201, the Government will monitor sources expressing an interest in this requirement.
Any Contractor who expresses written interest in this requirement will receive full consideration, as required by law and regulation.
10. Other Factors: Other factors supporting the use of other than full and open competition are as follows:
a. Procurement History. Prior to the action below, all database simulation requirements were met by Program Executive Office for Simulation, Training, and Instrumentation. This office has executed the contract listed below and was sole source to Rockwell Collins. The authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii), entitled “Only Responsible Source, and No Other Supplies or Services will satisfy agency requirements.”

b. Subcontracting Opportunities: Pursuant to FAR 52.219-9, Small Business Subcontracting Plan, FAR 52.244-5, Competition in subcontracting, and DFAR 525.219-704, Small Business Sub-Contracting Test Program, Rockwell Collins will be required to develop and submit an individual subcontracting plan to the ACC-RSA for review, approval, and incorporation into the contract. Per FAR 52.204-10, Rockwell Collins will be required to perform small business subcontracting reporting via the Government-wide Electronic Subcontracting Reporting System for compliance in accordance with their approved plan.
Rockwell Collins is required to subcontract with small business and small disadvantaged business concerns, as well as labor surplus concerns, and to encourage subcontracting competition to small disadvantaged businesses wherever possible. The applicable FAR and DFARS clauses will be included in the Request for Proposal and the resultant contract.
c. Acquisition Data Availability. A Technical Data Package (TDP) suitable for full and open competition is not available. The TDP information is proprietary to Rockwell Collins and is used by Rockwell Collins to support multiple multi-service aircraft programs. The Government does not possess a competitive quality TDP or unlimited rights to for a full and open competition. The conversion tools and data necessary for this effort were not procured with the development of the GeoSpecific Database Suites. The acquisition strategy never contemplated procuring a complete TDP due to the prohibitive cost.
