FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S Army Contracting Command-Aberdeen Proving Ground (ACC-APG), CCAP-CCC, 6565 Surveillance Loop, Aberdeen Proving Ground, MD 21005.

2. Description of Action: Project Management Office Aircraft Survivability Equipment (PMO ASE) requests a Cost-Plus-Fixed-Fee (CPFF) and Cost (no-fee) contract with KBR Wyle, formerly Wyle Laboratories, Inc, 7800 Hwy 20 W Huntsville, AL 35806, Cage Code 2B360. The Undefinitized Contract Action (UCA) was awarded on 28 February 2018 and the Government projects definitization award no later than 15 May 2018 using Fiscal Year (FY) 2018 Operation and Maintenance, Army (OMA), FY 2017 and 2018 Research Development Test & Evaluation (RDT&E), FY 2017 and 2018 Army Procurement Appropriation (APA), and Foreign Military Sales (FMS) funds. A Determination and Findings (D&F) for the UCA was approved by the Principle Assistant of Contracting (PARC) on 22 February 2018. Verbal approval of this J&A was granted by the Competition Advocate on 14 April 2018. This action is anticipated to be awarded no later than 15 May 2018.

3. Description of Supplies/Services: This contract action is for a CPFF and Cost (no-fee) contract for the period of performance of five (5) months in amount $6,759,114.38 for continuation of PM ASE Programmatic and Logistic Support services in support of PMO ASE. This effort provides execution of mission-critical services required to deliver centralized management for all Army aircraft survivability equipment programs that protect aircraft from threat systems. The portfolio of programs spans the full spectrum of the acquisition process from systems development to production, fielding, sustainment, and eventual retirement from the force. This effort also provides critical support services needed to assist and advise PMO ASE decisions affecting operational effectiveness and readiness of its current and future aircraft protection systems. PMO ASE applies a system-of-systems acquisition approach to meet warfighters’ current needs and obtain the desired future capabilities of the Army. Additionally, this effort includes specific services for continued support such as fielding, testing, readiness sustainment, Training Aids Devices Simulations and Simulators (TADSS) development, mission equipment packages, and Foreign Military Sales (FMS) applications.

This contract period of performance includes a five (5) month period to enable continued and uninterrupted PM ASE support services. The General Services Administration (GSA) awarded a competitive contract on 16 January 2018 for PMO ASE Programmatic and Logistic Support services to However, two interested parties filed protests with Government Accountability Office (GAO)

A five (5) month period of performance extension allows the government time to address the protestor’s allegations, which will require at least 100 days, as well as successfully transition the competitively awarded contract. The competitively awarded contract was solicited with a 60 day transition requirement, therefore, if the Government does not provide with at least 60 transition days, could request an equitable adjustment to meet the government accelerated transition schedule.

how they would recruit incumbent employees. They also did not describe how they would manage any subcontracts. Their transition plan assumed a large majority of contractor personnel would transition to from the incumbent.

The RFI stated the requirement for uninterrupted continuation of services for PMO ASE.

would be challenged to award and transition within the required timeframe to avoid a lapse or interruption of service. Therefore, the government believes pursuing a contract with would be extremely high risk which could impact CONUS and OCONUS operations supported by PMO ASE. Furthermore, KBR Wyle provided a Rough Order of Magnitude (ROM) addressing the requirements in advance to ensure intent of interest and expedite the review process.
