About this file
This document is a justification for a sole-source award of contract W56HZV-23-C-0059 to an unknown vendor for an unknown amount on June 15, 2023. The contract is for warehouse services, program management, and inventory management to support the Team Armor Partnership (TAP) program in Poland. The Department of the Army Materiel Command TACOM Life Cycle Management Command issued the award. The justification cites the need for specialized depot-level repair capabilities for M1 and M2 components in Poland to avoid delays in parts and repairs waiting to be sent back to the continental United States. Only the incumbent contractor General Dynamics Land Systems, which has experience operating TAP programs in Korea and Iraq, can perform the work within the required timeframe.

TAP-Forward location in Poland results in decreased readiness as vehicles wait for parts and repairs. The TAP forward repair activity will have specialized technicians and DSESTS trained maintenance personnel that will provide depot level repair capabilities for some M1 and M2 components and repair parts.
An award to a source other than GDLS would result in an inability to meet this urgent Army requirement in a timely enough manner. The current TAP contractor, GDLS, has performed this function OCONUS in Korea and during the Iraq war, therefore they are the most experienced and timely solution to timely execute this urgent requirement. The positioning of a TAP Forward in Poland greatly enhances the combatant commander’s effectiveness. Repair capabilities in Poland reduces vehicle down time which in turn increases the unit’s operational readiness. Maintaining readiness optimizes the probability of operational success while lowering the chances for loss of equipment and Soldiers’ lives. Without this program there would be risk to the mission, equipment and furthermore potentially lives. Due to the ongoing conflict, it is essential to have a forward deployed repair site to support any current and future contingency operations. Poland TAP will decrease this delay significantly due to assets not needing to be sent back
CONUS.
6. Efforts to Obtain Competition:
a. Effective competition: There is no plan to obtain competition for this contractual action because of the urgency of this requirement. Only GDLS, with its unique experience and capabilities can provide performance of TAP FRA requirements in the timeframe required by the Government.
b. Subcontracting Competition: GDLS, as a large business was required to submit a subcontracting plan for Contract Officer approval prior to the award of the contract. The subcontracting plan was received from GDLS on 26 May 2023. The contract includes clauses under FAR 52.244-5, “Competition in Subcontracting” and FAR 52.219-8, “Utilization of Small Business Concerns”.
7. Actions to Increase Competition: ACC-DTA will continue to publish market surveys on SAM.gov to identify additional capable sources interested in competition of the TAP program for the future. In accordance with FAR 5.202(a)(2), a non-synopsis form was signed by the Contracting Officer on 5 May 2023.
8. Market Research: ACC-DTA posted a Sources Sought; market survey for the TAP program requirements to SAM.gov on 12 august 2022 with a suspense date of 26 August 2022. The market survey aimed to obtain information on industry capability and interest in performing the TAP program. Only GDLS submitted a response to the market survey. Based on similarly demonstrated capabilities, and interest in prior TAP efforts, BAE Systems Inc., was individually contacted throughout the posting period of the latest market survey posted in August 2022. Despite the direct effort made to contact BAE, this contractor declined to submit a response to the survey or express further interest in the program. Only GDLS, with its unique experience and capabilities can provide performance of TAP FRA requirements in the timeframe required by the Government.
9. Interested Sources: To date, no other sources have express55ed an interest in this complex effort, nor did they express interest when this effort was competed in 2020.
10. Other Facts:
a. Procurement History:
Listed below is a history of TAP contracts awarded to GDLS since the program’s inception.
The below history includes the TAP CONUS contracts, which perform similar work to the awarded FRA contract.
i. Listed below is a history of TAP contracts awarded to GDLS since the program’s inception.
In 2020, this effort was competed and only one offer received, GDLS. The award was made to GDLS.

a. Other Facts:
The previous competitive effort, where only GDLS submitted a bid, and current market research indicate there is no outside interest in this effort. The USG will continue to monitor industry capabilities throughout the performance of this contract. ACC-DTA will continue to publish sources sought market surveys on SAM in an effort to identify additional capable sources interested in competition of the TAP program.
There have been no significant changes in the supporting rationale or circumstances justifying the previous J&A and sole source procurement awarded in December 2015. Furthermore, the previous competitive action, awarded in 2020, only received one bid from GDLS and that strengthens the USG position that competing this action would not be in the best interest of the USG. The recent market research did not yield any new interested or capable sources.
