Question from Air Rover, Inc. for W56HZV-19-R-0219

1. Does “brand name or equal” apply to the F100-60 (NSN 4120-01-617-1273) which is an HDT Brand Name Product?

Answer: The Government’s requirement is for NSN 4120-01-617-1282 and NSN 4120-01-617-1273. The ECU’s are to be provided in accordance with the Technical Data Package (TDP). There is a compatibility requirement with the Force Provider Module that these NSN’s are known to meet. The TDP for these NSN’s is currently owned by HDT Expeditionary Systems and the Government does not possess data that can provide potential vendors the ability to manufacture a fully compatible unit.

2. Which specific authority is used to justify the “other than full and open competition” required in FAR Part 6?

Answer: 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

3. Paragraph C.1. states that the contractor must acquire the exact Manufacturer Part # shown in the description (refer to question 1). Please clarify.

Answer: See Answer to question “1.”.

4. There are references to both ‘best value’ and ‘lowest price’ so please clarify the evaluation criteria. Is this LPTA?

Answer: Please see paragraph M.2. METHOD OF PRICE EVALUATION. The Government does not outline any other methods for Best Value Trade Offs. Hence, the “award will be made to the responsible offeror whose offer represents the lowest evaluated price”.

5. If this is LPTA, please identify the salient physical, functional, or performance characteristics that “equal” products must meet. Due to the fact that Air Rover and HDT do not produce the same product, we need to know what features and specs are most important to satisfy the end users’ requirements.

Answer: The Government requirement is for NSN’s 4120-01-617-1282 and NSN 4120-01-617-1273. The TDP and all technical data for these units is owned by HDT Expeditionary Systems. There are no salient characteristics available.

6. There are references to FOB Origin, but there are FOB Destination clauses in the RFP. Which applies to this contract?

Answer: Only the Inspection and Acceptance points are “Origin”. The FOB is “Destination”.
