Department of the Army Justification and Approval

1. Contracting Activity: The United States Army Contracting Command-Warren

(ACC-WRN) is the procuring activity for this action.

2. Description of Action: United States Tank Automotive Research Development and

Engineering Center (TARDEC) currently has a requirement for a new contract to provide annual software subscription for Real Time Innovations (RTI) commercially available software licenses. The type of funds is FY18 2020 OMA.

3. Description of the Supply: RTI develops modeling and simulation software for live, virtual, and constructive simulation. This is developed from their commercial off the shelf software subscription. This software delivers simulation and networking technology as a flexible platform to meet experimentation requirements. This commercial software product has been used in conjunction with, and integrated into, GUI Controller for Multi - Operator Control Unit (MOCU) project software in use at TARDEC.

Recommended Supplier:

Real Time Innovations - RTI 232 E. Java Drive, Sunnyvale, CA 94089

The following table lists the total estimated costs for the license software updates and maintenance of RTI products:

4. Authority Cited: The authority permitting the restriction of this procurement to items peculiar to one manufacturer or one brand name is 41 U.S.C. 1901 as implemented in FAR 13.501(a)(1) “Sole source (including brand name) acquisitions.”

5. Reason for Authority Cited: This requirement will be restricted to the Brand Name

“Real Time Innovations - RTI” because all of the already owned and existing licenses are of this specific brand. RTI is the only vendor that can provide this proprietary software. TARDEC will employ RTI software products to develop modeling and simulation software for live, virtual, and constructive simulation. This software is available to engineers who use the software to improve the durability of the Army’s ground vehicle systems and support systems. Failure to acquire this specific configuration of RTI software will limit the government’s ability to create complex models and simulations of future Army ground systems which will increase programmatic risk for critical research and design initatives. Consideration will be restricted to contractors that possess current licensing and certification from RTI Support Service.

6. Efforts to Obtain Competition:

a) Effective Competition: This action is for the software licenses and annual subscription for RTI Connext, which is owned by Real Time Innovations. RTI is the developer and proprietor of this software and does not have any authorized resellers to sell to the Federal Government. If other contractors with similar product capabilities to RTI Connext express interest and are able to meet the requirements outlined in this contract, TARDEC is open to their qualification.

b) Subcontracting competition: In an effort to ensure subcontracting competition, the contract will include the following provisions: FAR 52.244-6 Subcontracts for Commercial Items and FAR 52.219-8 Utilization of Small Business Concerns.

7. Actions to Increase Competition: TARDEC would be open to consider other brands in the future where they can effectively meet mission requirements, and are economically viable. However, if the Government determines that RTI licensings are no longer required, then the Government will seek competition for the required functionality.

8. Market Research: On 18 March 2018, Ray Samul, IT specialist for CIO/G6, did web searches for the applicable licenses. Market research has also indicated that other companies with similar products cannot meet the agency’s needs because of the uniqueness of the licenses. Only contractors who possess current licensing and certification from Real Time Innovations are authorized to provide these licenses. In addition, a letter was obtained from RTI stating that Connext DDS is a sole source product sold and exclusively distributed by RTI.

To date, no other sources have written to express an interest in this opportunity. The combined synopsis and solicitation notice will be posted at the Government Point of Entry (FBO.GOV)

10. Other Facts:

a) Procurement History: The previous requirement was awarded on 27 June 2017 under contract number W56HZV-17-P-L555. In addition, another contract action for RTI software was awarded on a sole source basis to Real Time Innovations

Inc. on 31 May 2018 under contract number W56HZV-18-P-L231. The authority cited on these actions was FAR 13.501(a)(1).
