4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
Or
FAR 8.405-6(a)(1)(i)(B) and 8.405-6(b)(1)Brand Name FAR 8.405-6(a)(1)(i)(A) Urgency FAR 8.405-6(a)(1)(i)(B) Only One Source is Capable FAR 8.405-6(a)(1)(i)(C) Logical Follow-on
Or

5. Reasons for Authority Cited:
The current contract anticipates a reasonable military presence to conduct DFAC operations along with the augmentation by contractor personnel.
The incumbent contractor, Ecolog Logistics Gmbh is experienced in the cook services requirement and has Lead Cooks already in place that will be used to oversee the additional 8 cooks per day. It would be more expensive to bring in a new contractor with additional costs for supervision, program management and inexperience for the 47 day surge in requirement. In addition, Ecolog Logistics Gmbh has contractor employees in a nearby location that are available and already meet contract requirements to work for this short term surge.
No other Contractor has or can be made to have the essential qualifications to meet the government’s requirements or specified delivery date of 24 May 2018 since this would require a RFP issued in a short timeline and the contractor would be required to provide experienced employees with all of the health certificates and base access requirements met.
Approximately 1,200 meals a day are required to be served to support the current personnel on Katterbach Kaserne. If the additional contracted cooks are not provided to the DFAC, personnel on Katterbach Kaserne may not be able to handle the current meal count.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at 5.202(a)(12).
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)

Action is a brand name restriction over $25K but will not be posted due to exception:
FAR 6.305(f) FAR 8.405-6(b)(3)(iii)(A) FAR 8.405-6(b)(3)(iii)(B) FAR 8.405-6(b)(3)(iii)(C) FAR 16.505(a)(4)(iii(C)
7. Market Research: Market research was not completed due to the immediate nature of the requirement. The current contractor already has staff working for this contract at this location and at other locations that the contractor can use too, immediately, increase the staff at the Katterbach location without the potential of long lead time of getting staff on-board.
8. Other Facts: The contract W564KV-14-D-0003 was initially awarded with a base year of 1 June 2014 to 31 May 2015 and two twelve month option periods. FAR Clause 52.217-8 option for the period of 1 June 2017 to 30 Nov 2018 was exercised and Task Order 0046 was awarded as part of the FAR Clause 52.217-8 option period. Task Order 0046 was awarded on 11 September 2017 for a 12 month period beginning 30 September 2017.
