About this file

This is an amendment to a solicitation for a one-year lease of two large bulldozers by the Department of the Army Materiel Command Joint Munitions Command. The amendment replaces the salient characteristics to specify a minimum power rating of 354 horsepower, blade capacity of at least 13.4 cubic yards, and an operating weight over 82,800 pounds for Caterpillar or equal bulldozers manufactured no earlier than 2010 with less than 6,000 hours. The amendment also incorporates standard vehicle lease clauses and provides questions and responses clarifying maintenance requirements. The bulldozers will be used 40 hours per week to support operations at the TEAD South Range and will be serviced by the contractor for breakdowns within ten days of notification.

2. Incorporate Federal Acquisition Regulation (FAR) Part 8 Contract clauses 52.208-4, 52.208-5, 52.208-6 and

52.208-7 in Solicitation W52P1J-21-Q-3004 (full text below).

52.208-4- VEHICLE LEASE PAYMENTS

52.208-5- CONDITION OF LEASED VEHICLES

52.208-6- MARKING OF LEASED VEHICLES

52.208-7- TAGGING OF LEASED VEHICLES

3. Provide questions submitted with regard to the solicitation requirements, and responses thereto, dated 5 January 2021 (see below).

4. All other terms and conditions remain the same.

Questions & Responses

1. Do you know how often the belly pans need to be cleared?

Response: The customer has been washing the machines every other week to keep the buildup of dirt down. This is just spraying them down with a hose. To protect the machines from damage, the belly pans require dropping at least once per month.

2. On the PM service, some require 250 hours PM and some are 500 hours. Do we just do the manufacturer-suggested PM?

Response: The Salient Characteristics specify PM Service at 400 hour service intervals – or as required by the provider for less. If the manufacturer-suggested PM service intervals differ from the 400-hour interval specified in the Salient Characteristics, use of the manufacturer-suggested PM interval is recommended.

3. Do you know how many hours a week these will be used so we can anticipate how often the maintenance will need to be performed?

Response from Customer: The machines will run 40 hours a week per machine.

52.208-4 VEHICLE LEASE PAYMENTS (APR 1984)

(a) Upon the submission of proper invoices or vouchers, the Government shall pay rent for each vehicle at the rate(s) specified in this contract.

(b) Rent shall accrue from the beginning of this contract, or from the date each vehicle is delivered to the Government, whichever is later, and shall continue until the expiration of the contract term or the termination of this contract. However, rent shall accrue only for the period that each vehicle is in the possession of the Government.

(c) Rent shall not accrue for any vehicle that the Contracting Officer determines does not comply with the Condition of Leased Vehicles clause of this contract or otherwise does not comply with the requirements of this contract, until the vehicle is replaced or the defects are corrected.

(d) Rent shall not accrue for any vehicle during any period when the vehicle is unavailable or unusable as a result of the Contractor's failure to render services for the operation and maintenance of the vehicle as prescribed by this contract.

(e) Rent stated in monthly terms shall be prorated on the basis of 1/30th of the monthly rate for each day the vehicle is in the Government's possession. If this contract contains a mileage provision, the Government shall pay rent as provided in the Schedule.

The Government shall accept or reject the vehicles promptly after receipt. If the Contracting Officer determines that any vehicle furnished is not in compliance with this contract, the Contracting Officer shall promptly inform the Contractor in writing. If the Contractor fails to replace the vehicle or correct the defects as required by the Contracting Officer, the Government may –

(a) By contract or otherwise, correct the defect or arrange for the lease of a similar vehicle and shall charge or set off against the Contractor any excess costs occasioned thereby, or

(b) Terminate the contract under the Default clause of this contract.

(End of clause)

52.208-6 MARKING OF LEASED VEHICLES (APR 1984)

(a) The Government may place nonpermanent markings or decals, identifying the using agency, on each side, and on the front and rear bumpers, of any motor vehicle leased under this contract. The Government shall use markings or decals that are removable without damage to the vehicle.

(End of clause)

52.208-7 TAGGING OF LEASED VEHICLES (MAY 1986)

While it is the intent that vehicles leased under this contract will operate on Federal tags, the Government reserves the right to utilize State tags if necessary to accomplish its mission.
