Department of Army Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: U.S. Army Contracting Command - Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000 .
2. Description of Action: This procurement is for copolymer Fluorel FC 2175 in support of MJU Decoy Flare programs at Crane Army Ammunition Activity (CAAA). A firm fixed price contract with Mach 1 Inc., is contemplated for 3rct quarter FY2016 (June) with an estimated dollar value of $163,845 funded by FY16 AWCF . An option provision will not be included. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: 5500 pounds, Fluorel FC 2175, in support of MJU Decoy Flares, which are produced by CAAA for the U. S. Navy.
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements
5. Reason for Authority Cited: The decoy flares are being produced by CAAA for the Navy. Typically, CAAA requires low quantities of this copolymer, not exceeding 5500 pounds in a given year, when needed. Since petroleum product is used in the manufacturing of the copolymer, distributors are unwilling to price beyond 12 months, therefore single buys have been determined to be the best strategy to meet CAAA's production needs.
Drawing 3306AS128 Rev E states Dupont and 3M Company as approved sources, however, only Fluorel FC 2175 has been tested and qualified to be used in CAAA's MJU Flare program. Per the Program Manager, CAAA is currently in production of the flares using the Fluorel product, and switching to a different binder at this point would require expensive and timely first article testing. The test would require CAAA to produce 140 decoy units for testing at $145 each, or $20,300 to produce test items. Then, the testing would involve examination for workmanship, X-ray, the environmental series, vibration, function test at Camp Atterbury, and Flight test (FA18 jet) at China Lake. The first article test would take approximately 8 weeks to complete at a total cost of $105,300, or more if any material must be scrapped during proving out process.
Additionally, per the Program Manager, there is no room for error with the flares being produced. The copolymer (Fluorel FC 1275 or Viton A) is the binder that holds the fuel (magnesium) and oxidizer (Teflon) together. If the binder doesn't do its job, the flare grain could rupture or cause a burn through on the flare housing, which could possibly change course during function and shoot into the aircraft engine, bringing down the jet.
The cost of failure is very high, which is why the Navy requires extensive testing if suppliers on components are changed. Therefore CAAA has indicated only Fluorel FC 2175 is acceptable for this procurement.
6. Efforts to Obtain Competition: A competitive drawing exists as stated in Paragraph 5, however, CAAA does not want this procurement competed due to the costs of end item testing and the time and effort required of doing the end item testing where annual requirements are typically low. ACC-RI shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: Drawing 3306AS128 Rev E indicate this copolymer could be competed between Dupont and 3M Company, however CAAA indicates prior end item testing did not include Dupont's product, and current production lines are using 3M's product. ACC-RI has in the past attempted to locate other distributors of the 3M product, however 3M chooses to use only one distributor for this noncommercial product.
8. Market Research: Responses to queries sent to Dupont, 3M, and Mach 1 in 2015 indicate this copolymer (as stated on drawing 3306AS128 Rev E) is only produced for the Department of Defense (DoD), or contractors making flares for DoD. As required by FAR, a pre-solicitation synopsis was released on 6/3/16, however it is not expected to result in identification of other distributors, or producers.
9. Interested Sources: As required by FAR, a pre-solicitation synopsis was released on 6/3/16, however it is not expected to result in identification of other distributors, or producers. To date, no other sources have expressed a written interest in this requirement.
10. Other Facts: Procurement History: W52P1J-15-P-3111 with Mach 1 was awarded on 8/21/2015 for a quantity of 3500 pounds @$29.79 per pound (total $103,669.20).
