About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the procurement of crane assemblies for the Forward Repair Systems (FRS) program.
The J&A states that the U.S. Army Contracting Command - Rock Island (ACC-RI) plans to award a sole-source, firm-fixed-price contract to Grove U.S. L.L.C./Manitowoc Cranes to provide a base quantity of cranes and an option for additional cranes to support the FRS program. The FRS is a mobile, self-contained repair shop used by the Army and Marine Corps, which requires cranes with specific capabilities that have been extensively tested and integrated with the FRS. The J&A cites 41 U.S.C. 1901 as the authority for the sole-source award, as the Grove crane is the only source that can meet the FRS requirements. The J&A also includes details on the procurement history, market research, testing requirements, and the fair and reasonable cost determination.

Full and Open Competition
1. Contracting Activity: U.S. Army Contracting Command - Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: The Rock Island Arsenal-Joint Manufacturing Technology Center (RIA-JMTC) requests a Firm Fixed Price Contract with Grove U.S.
L.L.C./Manitowoc Cranes. ACC-RI projects award for February 2023 and will obligate Army Working Capital Funds for this project. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).
The Government did not compete the requirement prior to this action, under the authority of Federal Acquisition Regulation (FAR) 13.501 (a)(1 )(ii), as supported by justification and approval (J&A) 19-064. That justification's paragraph 7, Actions to Increase Competition, stated:
"The Government does not intend to take any action to increase competition for these cranes in the future. The Army and the Marine Corp. have over 1,900 of the cranes in the field right now. It is not in the Government's best interest to open this requirement up to competition.
However, it will continue to conduct market research for future requirements to determine whether there are changes in the marketplace."
The Government completed those actions by conducting market research for new requirements to consider any changes in the marketplace. The current market research is addressed in paragraph 8 of this justification, which indicates that no other sources are available to fulfill this requirement.
3. Description of Supplies/Services: RIA-JMTC has a requirement for a base quantity of■cranes and an option for■additional cranes to be manufactured by Grove U.S.
L.L.C./Manitowoc Cranes, to support the FRS program. The FRS is a mobile, self contained repair shop designed to perform field-level repair and maintenance on major combat systems. It is comprised of several subcomponents including a Palletized Load System (PLS) flatrack, onboard crane, air compressor, generator, welder and hand tools.
RIA-JMTC will use the crane to lift heavy equipment into and out of the FRS. The crane configuration is required to comply with all system requirements to include a minimum of 10,000 pounds lift capability, a 14-foot minimum lift radius, no less than 300 degrees of

rotation, self-storing outriggers for stabilization, the capability of being powered by external slave hoses when connected to a PLS. Additionally, the Government must have successfully tested the crane for use in the FRS systems.
RIA-JMTC estimates a dollar value of cranes that comprise the base and option quantity, based on the Independent Government Estimate. The delivery of the total base quantity o
4. Authority Cited: 41. U.S.C. 1901, as implemented by FAR 13.501 (a)(1 )(ii), Special documentation requirements.
5. Reason for Authority Cited: As described at FAR 13.501 (a)(1 )(i), the contracting officer may conduct sole source acquisitions only if the need to do so is justified in writing and approved at the levels specified in FAR 13.501 (a)(2).
The Army has been using the FRS with the Grove crane for more than twenty years. The FRS went through product verification testing at Aberdeen Test Center as well as operational testing at Ft. Hood from July 1999 to February 2000. Armament Research and Development Command completed a full product verification test and operational test to test every aspect of the system to include safety, functionality, transportability, survivability, sustainment of the system as a whole, and sustainment of the Grove crane individually. The Grove crane's capability met the performance requirements of the FRS and it was easily integrated to fit within the FRS build envelope as well as met the Gabarit International De Chargement (an international rail standard) clearance for stowed height.
Market research indicates other manufacturers have comparable capabilities and attributes of the Grove crane. The Grove crane went through extensive testing, including safety factors, and Soldiers have been trained to use this equipment for many years■

The FRS technical manuals for operation and maintenance were developed with vendor and military support at a cost of approximate!~. An additional cost of for safety release data was also incurred. These criteria would include size, noise, stability performance testing, transportability testing (including railcar hump testing), system survivability requirements (nuclear, biological, chemical, and electromagnetic pulse), human factors, environmental condition testing, and timed reliability testing over an obstacle course totaling approximately three thousand miles.
The Government is required to test two FRS units to demonstrate repeatability. RIA JMTC estimated the testing costs in 2019, which have been escalated due to the COVID-19 pandemic altering the supply environment and inflation.
Expected testing costs for the FRS units are as follows:

Grove U.S. L.L.C./Manitowoc Cranes is the only source for the required cranes. Grove U.S. L.L.C./Manitowoc Cranes manufactures the Grove crane and sells it directly to the Government. They have no resellers or distributors among whom to compete the requirement.
6. Efforts to Obtain Competition: ACC-RI shall publish the notices required by FAR
5.201. Any bids or proposals received shall be considered. Because this is a sole source action, effective competition is not applicable. The contract will contain FAR clause 52.244-5, Competition in Subcontracting, which states that the contractor shall select subcontractors on a competitive basis to the maximum practicable extent.
7. Actions to Increase Competition: The Government will continue to conduct market research for future requirements to determine whether there are changes in the marketplace and if there are any other cranes that fit the needs for the FRS. However, the Government does not intend to take any action to increase competition for these cranes in the near term. The Army and the Marine Corp. have over 1,900 of the cranes in the field right now.

8. Market Research:
On 22 April 2022 , performed market research using the internet on common manufacturers of heavy-duty industrial truck mounted cranes to include Grove U.S. L.L.C./Manitowoc Cranes, Southwest Products, HYVA, HIAB, Palfinger, and Altec. Of the manufacturers researched, Grove U.S.
L.L.C./Manitowoc Cranes was the only manufacturer that could provide a hydraulic crane with a 10,000 pounds lift capacity, a 14-foot lift radius, and 300 degrees rotation while also fitting within the required footprint and weight to meet the FRS requirements.
In accordance with DFARS 205.205-71, DFARS 206.302-1 (d), and DFARS Procedures, Guidance and Information 206.302-1 (d), ACC-RI posted a sources sought to SAM.gov on 3 October 2022 for ten days. The sources sought included a drawing providing the required specifications for the crane. The sources sought resulted in zero responses or interested parties. An email was sent to Grove U.S. LLC/Manitowoc Cranes to confirm interest in the procurement and confirmed interest in building the■ cranes.
9. Interested Sources: To date, no other sources have expressed a written interest in this requirement.
