Replace HVAC Rooftop Units – B16 DFAC & B25 Civil Engineering
I. CONTRACTOR RESPONSIBILITIES:
Work consists of furnishing all labor, equipment, and materials necessary to perform all work listed in this Scope of Work (SOW). The Contractor shall submit to the Base Civil Engineer (BCE), for approval, all catalog cuts, drawings, or brochures of any materials to be used on this project. These submittals must be submitted within ten days of the Notice to Proceed. It is the contractor’s responsibility to ensure compliance with requirements briefed at the Pre-Construction meeting (i.e. Environmental, Safety, Fire Department, Security, etc.).
II. PROJECT DESCRIPTION:
Project consists of the removal, disposal and replacement of two R-410A roof top units as described below.
One 40 ton unit is required for the Building 16 Dining Facility and one 12.5 ton unit is required for Building 25 Civil Engineering.
Building 16 Dining Facility:
Contractor will install one new rooftop unit (RTU). Unit shall be a York model number RZ4N852ABE, or equal, with 4 stages, a total 40 ton cooling capacity and 800,000 BTU input heating capacity. Energy Efficiency Ratio (EER) shall be a minimum of 10.7. Unit will be 208 voltage 3 phase.
Building 25 Civil Engineering Squadron:
Contractor will install one new RTU. Unit shall be a Bryant model number 580JP14D224A, or equal, with 2 stages, a total of 12.5 ton cooling capacity and 150,000 BTU input heating capacity. EER shall be a minimum of 10.8. Unit will be 208 voltage 3 phase. Previous unit in this location was a cooling unit only.
New unit is both cooling and heating. Installation will require connection to a nearby gas line, approximately 10 feet away.
For both building locations, the existing disconnects are to remain and be reused. New units are to utilize R- 410A refrigerant. Base direct digital control (DDC) systems are to be interfaced into new unit. Stratton ANGB utilizes Johnson Controls Metasys System. There is an existing system that can be utilized to tie in the new units. The existing units have R-410A refrigerant which will be recovered and removed. Contractor is to abide by any and all EPA and New York State regulations. Contractor is to provide EPA refrigerant licenses prior to commencement of work. Refrigerant weights recovered will be annotated in the Base Refrigerant Management plan. Government will provide forms for recording necessary information. All existing units are to removed and disposed of properly in accordance to regulations. Any and all penetrations are to be sealed. Proposed models must be of equal capacity and greater efficiency than the existing models.
Modifications or replacement of roof and support structures will be done as necessary. Curb adaptors may be necessary for both installations. Any alterations to existing support structures must be certified by a NYS Professional Licensed Engineer and approved by the BCE. Contractor will tie new units into base DDC System.
Contractor is to supply a crane, or other lifting mechanism, as necessary to remove existing units and to position new units on both buildings.
Contractor to supply and extended 5 year warranty on all compressors.
A. SPECIFIC CRITERIA:
Contractor responsible for:
1. New air conditioning and heating units must have an interface for connection to existing building
DDCs and have an economizer package.
2. Install new roof curb or roof curb adapter as needed. All curbing must be made weather tight to include sealing and caulking.
3. Must match existing ductwork to new supply and return opening by either modify existing or provide new ductwork as required.
4. Heating controls to be included in the DDC System.
5. Controlling system to be used will be Johnson Metasys which is existing.
6. HVAC equipment and controls will follow specifications provided by government.
7. Provide base with three copies of Operation and Maintenance Manuals.
8. Installation of the system will conform to most current version of the National Fuel Gas Code, National Standard Plumbing Code, National Electric Code and National Fire Protection Association
(NFPA).
B. PERFORMANCE REQUIREMENTS:
Contractor will remove and dispose of two existing roof top units, provide and install two new rooftop units as described below:
Building 16 Dining Facility - One new 208 voltage 3 phase rooftop with 4 stages and 40 tons cooling capacity with a 800,000 BTU input heating capacity unit with DDC tie in that includes all wiring, electrical, and mechanical work to make system completely functional. Contractor will also be responsible for start-up and testing as needed.
Building 25 Civil Engineering - One new 208 voltage 3 phase rooftop with 2 stages and 12.5 tons cooling capacity with a 150,000 BTU input heating capacity unit with DDC tie in that includes all wiring, electrical, and mechanical work to make system completely functional. Contractor will also be responsible for start-up and testing as needed.
C. APPLICABLE CODES AND STANDARDS: Applicable Codes and Standards shall include, but not be limited to, all pertinent requirements of the following organizations most current standards:

D. TRASH DISPOSAL: It is the Contractor’s responsibility to dispose of all trash and debris incurred during project construction, off base at an authorized disposal site in accordance with local, state and federal requirements.
E. WORK WEEK AND HOURS OF OPERATION: Contractor work week is Monday through
Friday, 0700 to 1530. The Contractor must make arrangements in advance to work outside of normal duty hours.
F. RESTRICTED AREAS: There are numerous areas that are restricted and access to these areas must be coordinated through the BCE Office. The Contractor shall coordinate, three days in advance, for arrangements required to work in these areas. Contactors working in restricted areas shall be required to provide the BCE with a list of names and social security numbers for all personnel expected to work in these areas.
G. MEASUREMENT VERIFICATION: It shall be the Contractors responsibility to verify all measurements, sketches, and other descriptions of work for the project.
H. PROJECT DURATION: Duration of this project is 30 calendar days after Contractor's receipt of the Notice to Proceed. The completion time includes inspections and final clean up of the premises.
I. ENVIROMENTAL IMPACT: Under NO CIRCUMSTANCES shall any waste materials, cleaning fluids, solvents, paints, etc. be poured into the base storm drains, sewer/septic systems, or discharged onto the ground. Contractor shall adhere to all Federal, State and Local Regulations. All materials on the job will be accompanied by a MSDS (Material Safety Data Sheet). All containers shall be marked clearly and legibly as to the contents inside. All containers shall have lids firmly affixed. All collections of waste will be disposed of properly following IAW State and Federal Regulations to include proper manifesting. Provide the Base Engineer with quantities of recyclable materials discarded such as metals, concrete, etc.
J. SAFETY REQUIREMENTS: The Contractor shall abide by all State, Local, and OSHA safety requirements relevant to the items described in this SOW. If the Contractor is found to be in violation of any applicable safety regulations on the job site, the Government representative shall stop all work until the unsafe practice has been ceased and corrected.
K. FINAL ACCEPTANCE / COMPLETION OF PROJECT: When the job is completed, the
Contractor must notify the contracting officer representative (COR) and make arrangements for a final inspection.
The project WILL NOT be accepted by the Government until:
i. 3 copies of all Operations and Maintenance manuals have been received by and reviewed by the government.
ii. The government has received and reviewed all manufacturer’s warranty paperwork.
iii. The site is returned to original or better condition according to applicable codes and standards.
iv. HVAC units are functioning to requirements
L. The Contractor will fill out and sign a form DD1354 for each project location (building) to signify the acceptance of the project by ANG and authorize the capitalization of the asset. Project will not be approved past 95% payment without the DD1354s completed and ready for signature.
M. The Contractor will coordinate on a daily basis with affected shops on base.
N. The Contractor will notify CE of any crane operation 30 days in advance and will have the appropriate flags on the crane.
O. The Contractor will turn over metal to be recycled to ANG as economically feasible. Record weights of all construction debris will be turned over the 109th Environmental, recycle to the maximum amount possible.
P. The Contractor is responsible for accuracy of all measurements and the implementation of appropriate building codes. The Contractor must get approval from Civil Engineering Production Control (344- 2441) and/or Engineering (344-2445) before starting work and before any utility shutdowns.
Q. The Contractor is responsible for site cleanliness.
R. The Contractor shall provide product submittals for materials prior to beginning work. The 109th Civil
Engineering Squadron will review product submittals and return them to the Contractor. Only materials approved by the 109th Civil Engineering Squadron will be used for this project.
S. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
T. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
U. The use and possession of controlled substances to include marijuana (medical or recreational use) on the installation is in violation of Title 10 US Code 912a. Art 112a. Contractors are notified this policy is strictly enforced and violators will be denied entry. Personnel caught on the installation can be prosecuted.
V. In accordance with AFI 10-701, Operations Security, OPSEC PMs/SMO/SMNCOs/Coordinators will provide OPSEC training or training materials to contract employees within 90 days of employees' initial assignment to the contract and annually thereafter. General organizational orientations may need to be supplemented by duty-related orientations in the work center targeted toward specific critical information and vulnerabilities associated with the work. Initial OPSEC training is locally generated and will be provided during badge issue.
W. All contractor employees, to include subcontractor employees, requiring access to Government
Installations, Facilities and Controlled Access areas shall complete locally generated AT training equivalent to AT Level I awareness training within 10 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable.
III. PROPOSED PROJECT SCHEDULE
The project will begin 14 days following the Notice to Proceed. The project shall be completed within 30 calendar days following the start date.
IV. CONTRACTOR MANPOWER REPORTING
The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address: https://contractormanpower.army.pentagon.mil. The required information includes: (1) Contracting Office, Contracting Officer, Contracting Officer’s Technical Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including subcontractors); (6) Estimated direct labor dollars paid this reporting period (including subcontractors); (7) Total payments (including subcontractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each subcontractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (11) Locations where contractor and subcontractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of contractor and subcontractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor’s system to the secure website without the need for separate data entries for each required data element at the website. The specific formats for the XML direct transfer may be downloaded from the website.

52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR
STATEMENTS (JAN 2017)
(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.
Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.
Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.
(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.
(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. L. 113-235), and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions) use of funds appropriated (or otherwise made available) is prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.
(f) The Contractor shall include the substance of this clause, including this paragraph (f), in subcontracts under such contracts.

The Contractor's representations and certifications, including those completed electronically via the System for Award Management (SAM), are incorporated by reference into the contract.
52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2019)
(a) Definitions. As used in this clause--
Covered foreign country means The People's Republic of China.
Covered telecommunications equipment or services means--
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means--
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.
(c) Exceptions. This clause does not prohibit contractors from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:
(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 calendar days. The time stated for completion shall include final cleanup of the premises.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--
(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination.
The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.
(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
52.219-14 LIMITATIONS ON SUBCONTRACTING (JAN 2017)
(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) Applicability. This clause applies only to--
(1) Contracts that have been set aside or reserved for small business concerns or 8(a) participants;
(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) participants; and
(3) Orders set aside for small business or 8(a) participants under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(c) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for--
(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.
(2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.
(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.
(4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of…
