Program: AMMOTECH Support Services

Authority: 10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1(a)(2) -- Only One

Responsible Source and No Other Supplies or Services Will Satisfy Agency

Requirements

Amount:

Technical and Requirements Representative:

Typed name: DSN:

Title: Contracting Officer’s Representative DATE: 12 December 2012

1. Contracting Activity:

Agency: U.S. Army National Ground Intelligence Center (NGIC)

Contracting Activity: U.S. Army Intelligence and Security Command (INSCOM) Acquisition

Center/NGIC

2. Description of Action:

a. A firm fixed Price (FFP) bridge contract is required to the current incumbent, Sterling International

Group, LLC, for two months, with two two-month option periods in order to conduct a new re-compete for a replacement effort.

b. This bridge contract is a new procurement that will result in the award of a sole source contract to the incumbent and provides the time necessary to competitively re-solicit the new requirement.

c. This bridge contract will sustain the current level of service provided to the AMMOTECH Support

Services requirement, until the new contract is awarded.

d. The Option to Extend Services clause, FAR 52.217-8, in the current contract was previously exercised extending the period of performance completion date from 06 July 2012 to 05 January 2013. Therefore, the only option available at this time is to initiate a new sole-source contract to prevent a break in service while a competitive re-compete for the new procurement action is completed.

3. Description of Supplies or Services:

a. This request is to initiate a new bridge contract for AMMOTECH Support Services in support of

National Ground Intelligence Center (NGIC).

b. The contractor is responsible for handling, processing, storing, packing, transporting, and shipping all foreign ammunition and explosives under the NGIC Army Foreign Materiel Program at Aberdeen

Proving Ground, Maryland.

4. Authority Cited:

The bridge contract will be issued under 10 U.S.C.2304(c) (1) as implemented by FAR 6.302-1(a) (2)

(iii)(B) -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency

Requirements.

5. Reason for Authority Cited:

Background:

The demobilization of US Army Reserve soldiers supporting the NGIC Army Foreign Materiel Program at Aberdeen Proving Ground, Maryland has severely and negatively impacted the division’s ability to safely handle, store, and transport foreign munitions used in exploitation. The loss of the special functions provided by the Reserve soldiers and the steady influx of munitions and material from ongoing operations in Afghanistan and recent operations in Iraq have increased the scope of the current contract beyond its original intent. A new contract is required that will include the manpower and functions previously provided by the Reserve soldiers. This bridge contract will provide time to prepare a new re-compete for the follow-on effort.

The most recent policy and funding decisions regarding the NGIC Army Foreign Materiel Program support at Aberdeen Proving Ground, Maryland were made in late-November and early-December 2012 and required a adjustment of contract requirements.

Alternatives: There are no other reasonable alternatives to ensure uninterrupted critical services. The contract services are specialized, and critical to warfighters.

a. Schedule. One theoretical alternative would be to conduct a competitive procurement to cover the expected six-month gap in service (06 January to 05 June). However, there is insufficient time to conduct such a competitive procurement without a break in services, since the current period of performance ends

05 January 2013.

b. Cost. Even if time was available to complete a competitive procurement, the additional cost would be prohibitive. The costs to the Government and interested vendors of conducting and participating in two competitive procurements less than six months apart for this requirement are not sensible.

The overriding objective of this action is to ensure uninterrupted AMMOTECH support until a competitive acquisition process can be completed. The new sole source bridge contract allows for the continuation of these services while avoiding the unnecessary costs and risks associated with competing a bridge contract.

Justification: Approval of this J&A will ensure uninterrupted AMMOTECH support services until 05

June 2013. Failure to approve this J&A for a sole source bridge contract would leave insufficient manpower to carry on timely support to the mission. The division’s ability to safely handle, store, and transport foreign munitions would be severely and negatively affected. Safety would be impacted, since a skeleton workforce would have to perform processing duties on the same number of items. Certain activities are required prior to issuing a new solicitation; the solicitation itself must be posted for at least

30 days, and the evaluation and award process has many procedures to be followed. It is impossible to complete these activities and make award by 05 January 2013.

6. Efforts to Obtain Competition:

A bridge contract is necessary to ensure uninterrupted AMMOTECH support to NGIC Army Foreign

Materiel Program during the re-compete of the new contract. The re-compete will be awarded as a single award, CPFF small business set aside.

7. Actions to Increase Competition:

The previous contract was a small business set aside. The re-compete solicitation will be open to all small businesses, increasing the potential for more competition.

8. Market Research:

Market research indicates that there is a reasonable expectation that offers would be received from two or more responsible small business concerns and an award could be made at fair market prices

9. Other Factors:

Contract Classification: This is an unclassified contract; however, personnel require Secret level facility clearances. All work will be conducted by the incumbent who currently holds the necessary facility clearance and has the capability to provide cleared personnel.

10. Technical Certification:

I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Cost Determination:

I hereby determine that awarding a sole source contract at the cost of $148,440 to the Government, for this contract action will be fair and reasonable. Prices are the same as those proposed and awarded on the original competitive contract for these services.

Name: Date: __12 December 2012____________

APPROVAL

Based on the foregoing justification, I hereby approve the procurement of AMMOTECH Support

Services being procured on an other than full and open competition basis pursuant to 10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will

Satisfy Agency Requirements, subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
