INSTRUCTIONS TO OFFERORS
1. On behalf of the 99th Readiness Division (RD) the U.S. Army Contracting Command - New Jersey has a new requirement for windows to be replaced at the Londonderry Armed Forces Reserve Center (AFRC) located at 64 Harvey Road, Londonderry, NH 03053-7413. The contactor shall furnish all plant, labor, equipment, materials, transportation, supervision and technical expertise to perform requirements in accordance with the Specification Of Work (SOW). All repairs outlined in the SOW shall be performed. The North American Industry Classification System (NAICS) code that apply to the principal nature of the acquisition: 236220 - Commercial and Institutional Building Construction – Size Standard of $39,500,000.00.
The period of performance for this requirement shall be 90 calendar days from the notice to proceed.
Place of Performance: Londonderry AFRC located at 64 Harvey Road, Londonderry, NH 03053-7413.
**Quotes shall be valid for 120 Days.**
THIS IS A 100% TOTAL SMALL BUSINESS SET-ASIDE.
2. Evaluation Criteria Award will be made to a Small Business who is deemed responsible in accordance with Federal Acquisition Regulation (FAR), and whose proposal conforms to the solicitation requirements. Although the Government intends to award without discussions, if the price is not determined to be fair and reasonable, negotiations may commence. Award will be made only after agreement has been reached on all terms and conditions, and a fair market price for the construction requirement to be acquired. The Government reserves the right to seek additional information if required to determine fair and reasonableness.
3. Disclosure of the Magnitude of Construction Projects (FAR 36.204) Advance notices and solicitations shall state the magnitude of the requirement in terms of physical characteristics and estimated price range. The estimated price is to be described in the terms of the following price range: Between $250,000 and $500,000.
4. A SITE VISIT IS HIGHLY ENCOURAGED FOR THIS REQUIREMENT. A Site Visit will be available upon request. All requests shall be submitted via email to the Contract Specialist and the Regional Facility Operations Specialist (RFOS), Leslie Gadsby Email: leslie.s.gadsby.civ@mail.mil, Work: (603) 537-8166, and Cell: (609) 744-0446. Visitors must have a valid driver's license or state issued identification.
5. Questions shall be emailed to the Contract Specialist, Frank Borelli at frank.d.borelli.civ@mail.mil and the Contracting Officer, Sharon Wilson-Emmons at sharon.wilson-emmons.civ@mail.mil. Questions must specify the section and/or paragraph of the Request For Quote (RFQ) for which the clarification is desired.
6. Quotes are due no later than 24 June 2020 at 10:00 A.M. EST and shall be submitted electronically to: Contract

7. BOND REQUIREMENTS: The contractor MUST furnish the required Performance and Payment Bonds within 10 Calendar Days after award.
8. Completing a Quote for Submittal
a. The Offeror shall provide the name, title, address, email address and telephone number of the company point of contact regarding business decisions made with respect to the quote and who can contractually obligate the company.
b. The Offeror shall submit a price for each FFP Contract Line Item Number. Offeror is required to submit a signed SF-1442.
c. The Offeror shall provide proof of Valid Certificate of Insurance in accordance with FAR clause 52.228-5 “Insurance - Work on a Government Installation."
d. The Offeror shall provide a Labor and Material Breakout of quote within the excel attachment titled, Contractor Cost Breakdown Form.
e. Contractor must have an “Active” registration in System for Award Management (SAM) to be considered for award. To obtain information on SAM or to register with SAM visit the web site at:

(a) The offeror certifies that --
(1) The prices in this offer have been arrived at independently, without, for the purpose of restricting competition, any consultation, communication, or agreement with any other offeror or competitor relating to –

(ii) The intention to submit an offer, or
(iii) The methods of factors used to calculate the prices offered:
(2) The prices in this offer have not been and will not be knowingly disclosed by the offeror, directly or indirectly, to any other offeror or competitor before bid opening (in the case of a sealed bid solicitation) or contract award (in the case of a negotiated solicitation) unless otherwise required by law; and

52.216-1 TYPE OF CONTRACT (APR 1984)
The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.
52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (MAR 2020)
(a) Definitions. As used in this provision--
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (b) of this provision.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 90 Calendar Days from the Notice to Proceed Date. The time stated for completion shall include final cleanup of the premises.

52.219-14 LIMITATIONS ON SUBCONTRACTING (DEVIATION 2020-O0008) (MAR 2020)
(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) Definition. “Similarly situated entity,” as used in this clause, means a first-tier subcontractor, including an independent contractor, that—
(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
(c) Applicability. This clause applies only to—
(1) Contracts that have been set aside for small business concerns or 8(a) participants;
(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) participants;
(3) Contracts that have been awarded on a sole-source basis in accordance with subpart 19.8;
(4) Orders set aside for small business concerns under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F), if the order amount is expected to exceed the simplified acquisition threshold;
(5) Orders competed among 8(a) participants in accordance with subpart 19.8 under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F), regardless of dollar value;
(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference; and
(7) Orders issued directly to small business concerns or 8(a) participants under multiple-award contracts as described in 19.504(c)(1)(ii).
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a NAICS code for—
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract. Other direct costs are excluded to the extent they are not the principal purpose of the contract and cannot be obtained from small business concerns;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 85 percent subcontract amount that cannot be exceeded; or
(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 75 percent subcontract amount that cannot be exceeded.
(f) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph
(e) of this clause will be performed by the aggregate of the joint venture participants.
(g) The Contractor shall comply with the limitations on subcontracting as follows:
(1) For contracts, in accordance with paragraphs (c)(1) and (2) of this clause— [Contracting Officer check as appropriate.] ___ By the end of the base term of the contract and then by the end of each subsequent option period; or
