About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for Solicitation SPE7MX-24-R-X021. The J&A states that Pacific Maritime Industries Corporation, Turnbull LLC, and Emeco Industries are the only approved sources for the NSN 2090002908392 "CHAIR, STRAIGHT" item, as they retain the necessary technical data and manufacturing knowledge that is not economically available to the government. A Sources Sought and Market Research Questionnaire were posted, but only two additional companies responded. The acquisition will be synopsized and solicited via the DLA Internet Bid Board System (DIBBS) for 30 days. The Contracting Officer will determine price reasonableness in accordance with FAR Subpart 15.4. The estimated total value of the J&A is undisclosed.

CUI

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7MX-24-R-X021

Controlled by DLA Land and Maritime – SAPD – ZAA.

CUI Category: Source Selection Information (See FAR 2.101 and 3.104).

Distribution/Dissemination Control: FED ONLY. POC: karen.sherrill@dla.mil and searching the Product Master – Approved CAGE Part Numbers database in SRM on April 1, 2024. See attachment 1 – Tech Certificate and attachment 2 - PID, Packaging and Marking.

The use of the authority cited above:

AMC 1 - Suitable for competitive acquisition for the second or subsequent time.

AMSC C - This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. Pacific Maritime Industries Corporation, Turnbull LLC and Emeco Industries are the only sources approved by the design control activity and they are the only known sources to own or possess the technical data necessary to manufacture the items coded AMSC C, which is not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part.

6. Efforts to ensure that offers are solicited from as many sources as practicable are: A Sources Sought and a Market Research Questionnaire were posted to SAM.gov from February 15, 2024 through February 22, 2024 looking for other sources of supply willing and able to produce this item. Continued Tender Company (SKWM9) and Green Meadows (SQGS5) emailed a response to the Contract Specialist (sec section 8 below). The acquisition will be synopsized on June 10, 2024 and will run for a period of 15 days prior to the solicitation opening. At the completion of the synopsis period, this acquisition will be solicited on the internet for 30 days via the DLA Internet Bid Board System (DIBBS).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable:

Certified Cost or Pricing Data requirements do not apply. In accordance with FAR Part 12.209, while the Contracting Officer must establish price reasonableness in accordance with 13.106-3, 14.408-2, or Subpart 15.4, as applicable, the Contracting Officer should be aware of customary commercial terms and conditions when pricing commercial items. Commercial item prices are affected by factors that include, but are not limited to, speed of delivery, length and extent of warranty, limitations of seller’s liability, quantities ordered, length of the performance period, and specific performance requirements. The Contracting Officer will determine whether the contract award prices are fair and reasonable in accordance with FAR Subpart 15.4. The buyer may request information other than cost or price data to support price reasonableness if necessary.

8. Market Research/Efforts to Obtain Competition:

Market research consisted of a sources sought notice, a formal market survey, a review of procurement/quote history, and a review of the results of recent market research undertaken to meet recent acquisitions of this item.

In accordance with 10 U.S.C. 3204(e)(2)(D) the market surveys on this project requested companies provide answers to general questions regarding their company size and status. The Long-Term Contract (LTC) questions included overall interest in the LTC, preferable length of contract, commerciality of the item and supporting documentation, delivery schedule, and the vendor’s ability to provide Certified Cost or Price Data. The vendors also had the opportunity to provide any additional information that they feel may be of assistance in building our Acquisition Strategy and possible solicitation development.
