FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Mission and Installation Contracting Command-Fort Bragg, Building 2-1105 Macomb Street, Fort Bragg, NC 28310
2. Description of Action:
a. The Fort Bragg Directorate of Plans, Training, Mobilization, and Security (DPTMS) requests a new sole source firm-fix-priced contract with InfiniSource Consulting Solutions, Inc, 201 Loudoun St. SE Suite 200, Leesburg, Virginia 20175. The Government projects award in March 2017 and fiscal year 2017 Operations and Maintenance funds will be used.
b. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services:
a. The Installation Management Command (IMCOM) DPTMS, Fort Bragg has a requirement for base support services. The Contractor shall perform support services for non-Governmental in nature tasks that exceed organic Garrison capabilities detailed within the Performance Work Statement (PWS). Support includes but is not limited to the Garrison Support Operations, deployment, redeployment, mobilization, demobilization, Army Force Generation (ARFORGEN) reset inclusive of the Controlled Material Destruction Facility (CMDF) operation, Force Modernization, Garrison, current, and future plans and operations on Fort Bragg. Additionally, the Contractor shall be prepared to react and accomplish additional requirements from higher headquarters related to changes or additions to directives, regulations, or policy.
b. Period of Performance: 1 April 2017 to 31 March 2018 Total Value$1,939,059.96
4. Authority: 10 U.S.C. 2304(c)(2) as implemented by FAR 6.302-2 Unusual and compelling urgency.
5. Reason for Authority Cited:
a. Overview.
1) As described at FAR 6.302-2, when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
2) The current Task Order W9124J-12-D-0005-1N01 is being performed by Davis-Paige Management Services, LLC. (Davis-Paige) and expires Friday, 31 March 2017.
Program: Support Base Services
FOR OFFICIAL USE ONLY
3) Not awarding this sole source action to ICS will result in unacceptable delays in the provision of deployment, redeployment, mobilization, and demobilization services for DPTMS and the warfighter.
4) ICS, is the only contractor with the capability to provide the required services without delay. Procurement of these services from another source will jeopardize the continuity of deployment and mobilization operations on Fort Bragg introducing a negative impact on the work of every DPTMS employee and Soldier. The Garrison’s operational effectiveness will be greatly reduced without the ability for Fort Bragg to rapidly deploy. The following background and alternatives further supports the authority cited.
b. Background.
1) Task Order W9124J-12-D-0005-1N01 was competitively awarded to Davis-Paige in March 2016, after all SBS MATOC contractors were given a fair opportunity to be considered.
The value of the Task Order with a base year and two option years was $4,990,592.71. The task order base period of performance ends 31 March 2017. The Contracting Officer has made a final determination that it is not in the Government’s best interest to exercise the option due to
c. Alternatives.
1) Use in–house personnel. DPTMS does not have the necessary personnel to provide these services. Acquiring the necessary personnel would result in unacceptable mission delays.
Therefore, continuation of services with ICS is the most efficient method to avoid costly interruptions to the support base services.
2) Use of a competitive contracting action.
The Government projects a re-competition of the requirements to secure ongoing support beyond this 12 month period.
3) Forego the Services. A break in service would cause delayed support which would cause an immediate impact on Soldier readiness.
d. Impact. Last year, Davis-Paige served customers in the Soldier Readiness Center (SRC); shepherded over Soldiers through the Mobilization/Demobilization (Mob/De-Mob) process; shredded over pounds of material in the Installation Controlled Material Destruction Facility (CMDF), and supported new equipment fielding to Soldiers in excess of pieces and . Without this contract, Warfighters would not receive timely Mob/De- Mob services, nor would Garrison Support functions be fully operational. It is critical to have installation, security cleared, and domain cleared experienced contract staff beginning 1 April 2017 to complete the many essential tasks outlined in the PWS to include the following:
1) Mob/De-Mob. On Saturday, 1 April 2017, the contractor is immediately responsible for Soldiers currently in the barracks and an additional Soldiers arriving over the weekend for processing through the Mob/De-Mob Station Monday morning, 3 April 17. Over the course of the upcoming week an additional soldiers will arrive at Fort Bragg to begin the process.
The contractor is also responsible for walk-in Soldiers which account for over of Soldiers served. Approximately are specialized Soldiers from Joint Special Operations Command (JSOC) and Special Operations Command (SOC) whose mobilizations and deployments are frequently unplanned based on the missions. A break in service would affect not only this specific group of Soldiers’ Mob/De-Mobs, but the many Soldiers the contractor will serve in the upcoming months.
2) SRC. The contractor provides services to three processing stations at the SRC supporting active duty Soldiers processing through the SRC every day equaling over the last 12 months. During the week of soldiers are currently scheduled to process through the SRC and without the contract, would not receive these services.
3) Installation Force Modernization Office (IFMO) mission. On 3 April 2017, inbound equipment shipments are scheduled to arrive. The contractor at the IFMO loads, unloads, stages, and stores inbound and outbound equipment shipments in addition to setting up and providing support to all New Equipment Training (NET) Classes. Rolling stock communication systems will arrive at the installation Central Receiving and Processing (CRP) yard on commercial trucks which are required to be down loaded by the IMFO contract staff. Additionally, bulk/crated equipment will arrive at the IFMO facility dock which require unloading and staging in the warehouse for a new equipment fielding to active component units on Tuesday 4 April 2017.
Support is scheduled and required for NET from 3-7 April 2017.
4) CMDF. This week scheduled appointments totaling pounds of Personally Identifiable Information (PII), sensitive or classified printed material for destruction /shredding would not be completed. Another appoints for pounds of material would not be shredded/destroyed by COB Wednesday 5 April 2017. Such labor is essential in supporting Operations Security (OPSEC) IAW Fort Bragg (FB) Regulation 530-1, Information Security (INFOSEC) and other applicable Army regulations. Not only would these appointments be cancelled but walk in customers with printed materials for destruction and computer hard drives requiring degaussing would also not be served.
6. Efforts to Obtain Competition: Effective Competition: Because this is a sole source action, effective competition is not applicable.
7. Actions to Increase Competition: The MICC-Center Fort Bragg is currently working a new requirements packet to issue a fully competitive action to support DPTMS, Fort Bragg using the following milestones:
8. Market Research:
the requirement was competed previously in fiscal year 2016 under the SBS MATOC. Proposals were received from four (4) of the seven (7) SBS awardees on 18 February 2016. However,
9. Interested Sources. In accordance with FAR 5.202(a)(2), this action will not be synopsized.
10. Other Facts
a. Procurement History.
Contract: W9124J-12-D-0003-1N01 Contractor: Tatitlek Support Service Award Date: 18 July 2013 Period of Performance: 18 July 2013 – 30 April 2016 Dollar Amount: $9.3M
Contract: W9124J-12-D-0005-1N01 Contractor: Davis-Paige Management Services Award Date: 05 April 2016 Period of Performance: 18 April 2016 – 31 March 2019 Dollar Amount: $ 4.2 M
b. Award to any other source would result in a disruption as well as increased effort and cost that would be unlikely to be recovered through competition. ICS is the only source that can immediately perform a contract of this magnitude and complexity for the period of 1 April 2017 through 31 March 2018 without unacceptable mission delays. The exception to other than full and open competition is the only feasible alternative to obtain the required services until the new competitive Support Base Service follow-on action is awarded. ICS is the only source that has the necessary management and labor structure in place that will ensure continuity of services for the major functional areas, with the required security clearances, for the interim period.
