Justification and Approval (J&A) for Other Than Full and Open Competition
FOR OFFICIAL USE ONLY
March 2018 FOR OFFICIAL USE ONLY Page 2 of 4
I. Contracting Activity.
Department of the Air Force, Agile Combat Support,AFLCMC/WNKAC, 235 Byron St Ste. 19A Robins AFB GA 31098-1670 Program Name: Environmental Tester Repair PR #: FD2060-18-35091NSN: 4920-01-139-2801MH
II. Nature and/or description of the action being processed.
This is an overhaul repair of the Environmental Tester. Previous contract FA8904-15-D-0003 was awarded to FXC Corporation on a Sole Source basis. This justification allows for the issuance of a requirement contract to FXC Corporation, 3410 S. Susan Street, Santa Ana CA 92704-6936. A Firm-Fixed Priced (FFP) five-year requirements contract is contemplated
III. Description of supplies/services required to meet agency needs.
This procurement is for the overhaul repair of the Environmental Tester, NSN 4920-01-139-2801MH, P/N 811-00148J.
The Best Estimated Quantity (BEQ) is 10 each. The Environmental Tester is designed to test environmental sensors and automatically evaluate their functional condition. The overhaul repair of the Environmental Tester includes inspection, bench check, disassembly, functional checks, adjustments, test, and calibration in accordance with TO 33D2-39-26-1 and upgrade to the latest configuration as applicable to specific Part Numbers 811-00148J/811-00148.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2304(c) (1) as implemented by FAR 6.302-1. The supplies required by 404th Supply Chain Management System (SCMS)/GUMAC are available from only one responsible source, and no other type of supplies will satisfy the 404th SCMS requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Environmental Tester was originally manufactured by FXC Corporation. They are the only known source with the test data, skills, test procedures, test equipment and all special tooling to repair this item. The Government has no data or test equipment for the repair of this item. Therefore, in accordance with FAR 6.302-1 full and open competition is not possible.
The Environmental Tester is designed to test the Environmental Sensors on the ACES II Ejection Seats. Inability to test Environmental Sensors would ground aircraft until required testing is accomplished. Failure to approve this requirement will jeopardize the safety of crewmembers.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This requirement will be synopsized on the Beta.SAM web page citing conditions which preclude full and open competition. The Air Force does not have any known detailed repair/test procedures to adequately repair subject item.
The item has been previously procured only from FXC. Complete data is not available to allow for competition of requirements. The data is proprietary and the contractor is unwilling to release the rights or sell the data. FXC has the item technology expertise, historical test and performance data.
Last contract awarded to FXC, in June 2015 was to repair approximately 49 Environmental Testers. This contract was a five year requirements contract.

This tests equipment is installed onto MIL-DTL-9479. The standard ACES II design is detailed in MIL-DTL-9479 (military-unique); no other commercial standards, regulations, journals, organizations, process guides, or professional societies or organizations are known at the time of the completed Market Research Report. There are no commercial opportunities since FXC is the only source which has the manufacturing data and test equipment to repair this item.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
A cost and price analysis will be made based on available/historical pricing for the Environmental Tester to determine price reasonableness. The overall cost of this requirement will be fair and reasonable to the Government. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Management Agency (DCMA) and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
The AFLCMC/WNUS Human Systems Sustainment Branch at Warner Robins Logistics Complex maintains extensive contacts with industry in order to keep abreast of new technologies and corporate capabilities. This is done through participation in various trade shows and conferences, such as:
1. The Survival and Flight Equipment (SAFE) Symposium held every year in Oct (introduction of new products and briefings by industry and Government).
2. World Wide Aircraft Egress Systems Executive Working Group (AESEWG) held every other year. The last AESEWG convened in Oct 2018 (in Reno, NV)
FXC is the only source which has the manufacturing data, and test equipment to manufacture/repair this item. There are not at least two small business sources capable of meeting the government’s requirement.
The Environmental Tester was originally manufactured by FXC Corporation. They are the only known source with the test data, skills, test procedures, test equipment and all special tooling to repair this item. The Air Force does not have any known detailed repair/test procedures to adequately repair subject item organically. The Air Force only has the calibration technical orders.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
