1.1.1 Submit questions, comments, and requests for revisions via CalOptima’s online solicitation portal by the Deadline for Questions and Comments. Responses will be posted on CalOptima’s online solicitation portal as they are completed. The portal will not accept questions or comments after the deadline.

1.1.2 Requests for revisions to specifications, or substitution of an alternate item “as equal” to one specified, must include a description of the specification to be modified, a description of the specification or item to be substituted, and a justification for the revision. Include samples of the proposed new products/goods as appropriate. Any testing of suggested alternate materials will be at Contractor’s expense. CalOptima will not pay for samples or for testing.

1.1.3 Bids that include exceptions or revisions to the contract or specifications, and conditional bids, may be considered non-responsive and rejected.

1.2 Communication

CalOptima solicitations, once published, are confidential and no bidder or person acting on behalf of a prospective bidder may communicate with or discuss the solicitation with any officer, agent, or employee of CalOptima other than the Designated Point of Contact.

Violation of this rule by a bidder or bidder’s representative may result in rejection of the bid and the bidder being found non-responsible, being barred from participating in this or future procurements, and becoming subject to other legal penalties.

1.3 Pre-bid meeting and site visits

1.3.1 Answers to questions raised prior to and at the pre-bid meeting will be posted on CalOptima’s online solicitation portal.

1.3.2 If the pre-bid meeting is mandatory, bidders who did not attend the pre-bid meeting will be disqualified from submitting bids.

1.4 Modification or Withdrawal of Bids

1.4.1 Prior to the Due Date and Time bids may be withdrawn or replaced at any time without penalty and may be resubmitted. Revisions and modifications to bids may be made by withdrawing the bid and submitting a new bid. To avoid confusion, notify the Designated Point of Contact of the replacement.

IFB # 27-015 5 10/15/2026

1.4.2 After the Due Date and Time, bids may not be modified unless clarification is requested by CalOptima.

1.4.3 Bids may be withdrawn without penalty due to mistakes or mathematical errors, if a bidder provides evidence of a mistake or error within five business days.

1.5 Prohibited Prior Work

1.5.1 No person or entity may submit a bid in response to this solicitation if that person or entity has:

A. Been a single entity that drafted or directly assisted CalOptima in establishing specifications and requirements for this procurement, or

B. Had access and exposure to information pertinent to this procurement that is unavailable to other bidders.

1.5.2 Bidders that received assistance from any such person or entity will be disqualified.

1.5.3 The prohibition does not apply to general, non-specific advice or information offered to CalOptima that would not create a competitive advantage for a potential bidder, nor does it apply if multiple sources were consulted for suggestions and advice prior to release of the solicitation.

1.6 Revisions to the Solicitation

CalOptima may revise or reissue this solicitation, in whole or in part, for any reason.

Revisions will be posted as addenda on CalOptima’s online solicitation portal. No other revision of this solicitation will be valid. Bidders are responsible for ensuring that they have received all addenda prior to submitting bids, and for compliance with all changes, modifications, or requirements put out through addenda. CalOptima will not be responsible for a bidder’s failure to check CalOptima’s online solicitation portal prior to submitting a bid.

1.7 No Commitment

This solicitation does not commit CalOptima to make an award, nor will CalOptima pay any costs incurred preparing and submitting bids, or in making necessary studies for the preparation of bids. CalOptima may reject all bids and cancel this solicitation for any reason.

1.8 Bonds

1.8.1 For public work projects over $25,000, a bid bond in the amount of 10% of the bid price is required for construction contracts.

IFB # 27-015 6 10/15/2026

1.8.2 For public work contracts over $25,000, both a payment bond and a performance bond are required prior to commencement of work, each for 100% of the bid price.

1.8.3 Bidders may submit a bid bond electronically as the 10% bid security. If submitted electronically, the bid bond must be issued by an admitted surety insurer licensed to issue surety bonds in the State of California

1.8.4 Electronic bid bonds will only be accepted if executed and authenticated through a verified third-party electronic bonding platform integrated with BidNet (e.g., Surety2000).

1.8.5 Bidders using electronic bid bonds must input their unique electronic bond verification code or identification number into the designated field within BidNet prior to the designated bid closing time.

1.9 Subcontracts

1.9.1 If subcontractors are to be used, the identity of each subcontractor and the work to be undertaken by each must be provided with bids, per CA Public Contract Code §§4100-4114. Bids without this information will be rejected as non-responsive.

1.9.2 No contractor or subcontractor may be listed on a bid or awarded a contract for a public works project unless registered with the Department of Industrial Relations, per California Labor Code §1725.5.

1.10 Minimum Self-Performance Requirement

1.10.1 The Prime Contractor must perform work equivalent to at least 20% of the total contract price. This means workers employed and paid by the Prime Contractor, using equipment owned or rented by the Prime Contractor.

1.10.2 Failure to meet the designated threshold or misrepresenting subcontracted percentages may render the bid non-responsive.

1.11 Bid Pricing

1.11.1 Use only the Price Form included with this solicitation. Complete it as instructed and ensure that it contains all required information in all tabs. Use of any other price form, an incomplete price form, a hand-written price form, or failure to submit prices as directed may result in the bid being found non-responsive.

1.11.2 List all subcontractors on the pricing sheet. Break out and describe the work to be done by each subcontractor, and using the appropriate tab, provide the subcontractor’s contact and license information. If work is to be self-

IFB # 27-015 7 10/15/2026

performed, state “self” on the pricing sheet. Do not leave blanks for any work included in the bid.

1.11.3 The bid prices will remain firm during the contract term unless otherwise agreed to by CalOptima.

1.11.4 While CSI divisions are provided on the pricing sheet for convenience, the Total Bid Price must reflect the entire project as represented in the bid documents, including all materials, equipment, supplies, general conditions, site security, mark-ups, allowances, and sales taxes required to complete the project.

Bidders may insert additional CSI categories and lack of a CSI division for pricing will not give rise to any change order.

1.11.5 Include a daily rate with the bid submission. This will be used, if required, for changes in the number of days to complete the work that are not the fault of the contractor.

1.11.6 Calendar days to complete the project will be based on the schedule provided by bidder and will be calculated from CalOptima's formal Notice to Proceed.

1.11.7 All workers employed on public works projects must be paid the prevailing wage published by the California Department of Industrial Relations.

1.12 Estimated Quantities

If the solicitation results in an indefinite delivery / indefinite quantity, or requirements contract, the actual amount of goods or services requested by CalOptima may be less than the maximum value of the contract and there is no guarantee, either expressed or implied, as to the actual quantity of goods and services that will be authorized under the contract.

1.13 Submission and Opening of Bids

1.13.1 Prior to submitting a bid, check CalOptima’s online portal for addenda. Bidders are responsible for compliance with all addenda and revisions to the procurement documents.

1.13.2 Allow time for all documents to upload in CalOptima’s online solicitation portal . Failure to fully complete an upload prior to the due date and time may result in rejection of a bid.

1.13.3 Complete all documents electronically. Other than signatures, hand-written responses, whether or not submitted electronically, may be rejected.

1.13.4 CalOptima may waive any irregularities in a bid if the waiver does not substantially change the offer or provide a competitive advantage to a bidder.

IFB # 27-015 8 10/15/2026

1.13.5 No bids submitted by email, or any modifications to previously submitted bids made by email, will be considered.

1.13.6 Bids must be signed by a legally authorized representative of the entity submitting the bid.

1.13.7 Failure to comply with the requirements of this IFB or evidence of unfair bid practices will be cause for rejection of the bid.

1.14 Public Records

1.14.1 All bids and all materials submitted with bids become the property of CalOptima.

1.14.2 CalOptima is subject to California Public Records Act (California Government Code, Section 7920 et. seq.). With selected exceptions, the contents of any submissions will be treated as open records and will be open to inspection by interested parties after a contract is executed or CalOptima rejects all bids.

1.14.3 If submitting confidential or proprietary information as part of a bid, clearly delineate any limits on the use or distribution of that material in writing.

Documents protected by law from public disclosure will not be disclosed if clearly marked with the word "Confidential" on each applicable page, with each confidential provision clearly identified. A mere list of confidential pages will not suffice to meet this requirement. Requests to treat the entire bid as confidential will be rejected and will result in no part of the bid being treated as confidential. By marking any portion of a bid as confidential, the bidder agrees to indemnify, defend, and hold CalOptima harmless from any subsequent litigation or costs arising from CalOptima’s withholding of those materials under the California Public Records Act.

1.14.4 Trade secrets may be marked as confidential only to the extent they meet the requirements of the California Uniform Trade Secrets Act (CUTSA). Only information claimed to be a trade secret at the time of submittal to CalOptima and marked as confidential in a bid will be treated as a trade secret.

1.14.5 Public record requests for materials regarding a solicitation will be denied as premature while the solicitation is ongoing, until a contract has been executed or the solicitation has been cancelled.

1.15 Mistakes in Bids

1.15.1 If there is an obvious disparity between the unit prices or lump sum of the lowest apparent responsible bidder and other bidders, CalOptima may contact the apparent low bidder to validate the bid. This does not relieve a bidder from the responsibility of submitting a correct bid and no change to the bid price will be allowed. If the bidder can provide convincing evidence to the Designated

IFB # 27-015 9 10/15/2026

Point of Contact that the bid was a mistake, the bid for that item or items may be withdrawn without penalty.

1.15.2 Bidders have two business days after the unofficial bid tabulation is announced to notify the Designated Point of Contact, in writing, of any alleged mistakes in bids. The communication must include evidence that supports the existence of the mistake.

1.15.3 If the basis of award is “all or nothing”, and a mistake was made, then the entire bid may be forfeited. If the basis of award is “line by line”, the bidder’s other line-item prices may be considered. If the basis of award is “by groups” and the mistake is part of any group or line items within a group, the entire group will not be considered for award.

1.16 Electronic Signature

By submitting a bid or quote electronically, the bidder acknowledges that it has made a legal offer, is bound by all responsibilities of a legal offer, is subject to penalties for failing to be bound by a legal offer exactly as if the bid or quote had been physically signed and that the person whose signature is electronically affixed is authorized to sign and submit the bid or quote.

1.17 Acceptance and Award

1.17.1 Award, if made, will be to the responsive, responsible bidder offering the lowest price or prices.

1.17.2 After receipt and review of bids, an unofficial tabulation will be announced.

Posting of the tabulation does not constitute an award. CalOptima will issue a Purchase Order or contract to the successful bidder.

1.18 Determination of Responsibility

Prior to awarding a contract, CalOptima will make a determination of a bidder's responsibility based on information submitted with the bid, information submitted upon CalOptima request, information resulting from CalOptima’s inquiry of bidder's references and investigations into the bidder’s background, and CalOptima’s own knowledge of the bidder. CalOptima may consider matters such as the bidder’s integrity, compliance with public policy, record of past performance, and financial and technical resources.

CalOptima will not contract with any bidder that is debarred, suspended or otherwise ineligible for the award of a contract or grant by any Federal agency or from participating in Federal Healthcare Programs. Bidders determined to be non-responsible and who cannot be made to be responsible within timelines set by CalOptima for protests will not be considered further.

IFB # 27-015 10 10/15/2026

1.19 Required with Bid Submission

1.19.1 Price form. If a pricing form is provided with the solicitation, that is the form that must be used. Bids that do not include the official price form will be rejected. If self-performing work, indicate “self” in the appropriate line – do not leave the line blank.

1.19.2 For public work bids:

A. A bid bond for public works projects over $25,000

B. A letter from a surety confirming that it will provide a payment bond and a performance bond

C. Non-collusion affidavit, in compliance with CA PCC § 7106 (2023)

iii To the extent applicable, the documentation shall include copies of court orders, judgments, or final administrative determinations, along with proof that all fines, penalties, or back wages have been paid in full.

iv Failure to provide the required disclosures and supporting materials pursuant to this section may result in disqualification of the bid.
